Can we stop deportation from the UAE after serving a sentence if we have a criminal case in our home country?
Can we stop deportation from the UAE after serving a sentence if we have a criminal case in our home country, India, and there's a threat to life and imprisonment due to that case there if we get deported?
Hello,
Thank you for your inquiry.
In the UAE, deportation after serving a prison sentence is generally mandatory for foreigners convicted of certain crimes. This judicial deportation is enforced upon completion of the custodial sentence.
However, under the new Dubai Decision No. 1/2025, there is an expanded judicial mechanism that allows the Tribunal for the Review of Deportation and Travel Ban Orders to consider suspending or cancelling deportation orders on humanitarian grounds or other justifications.
This includes cases where the individual may face persecution, a threat to life, or severe consequences in their home country after deportation.
To seek prevention or suspension of deportation based on your brother’s criminal case threat in India, a formal application must be submitted to the relevant UAE judicial or immigration authority, providing evidence of the danger faced, family hardship, and rehabilitation efforts during incarceration.
The Ministry of Interior has discretionary power in such cases.
It is highly advisable to appoint specialized legal representation immediately to file these petitions and present the best case for relief.

Yes, you can try to stop or suspend deportation, but it is rare and requires urgent legal action. The routes are:
- Appeal or request suspension of the deportation order in the UAE courts.
- Apply to GDRFA/ICP for exemption on humanitarian/medical grounds.
- As a last resort, approach UNHCR UAE if you face persecution or life danger in India.
