My husband's family want to send me and my kids back to my country. What to do?

Hi

My husband is working in his uncle’s company in Dubai with a salary of AED 8,000 monthly. I am not earning. During the 12th board, they told us to go to India, but we said we did not want to go.

Before, one time we went, so my husband’s uncle told him not to pay the rent, saying once they come to the road, they will go to India. My husband kept on saying he would pay the rent.

One day we came to the road for not paying rent, and we stayed the whole night in the car, then went to a hotel. After that, the uncle’s family took us to their house to talk.

The kids did not want to go to their house because, for the last four years, they have threatened to cancel our visas.

So they stood on the road waiting for me and told me that if I didn’t want to go to India, then he would pay rent only for one year, and other than that, I should not ask him for anything.

He told me to write and sign that everything else I have to handle. I refused, and the uncle was yelling at me. I came out and waited for my husband for a long time, but he did not come, so we went to a hotel.

Now it has been 8 months, he is not giving any money for our expenses, and he took my savings of 25,000 AED by cheating.

Dear Inquirer,

From your message, it appears there are serious issues involving your husband’s employment rights, family-related disputes, and possible financial exploitation.

These matters may involve both labour law and civil/legal remedies in the UAE.

To properly assess your situation and advise on the best legal course of action, it is important to review the details and documents.

We recommend that you book a consultation with FUTURE VISION ADVOCATES & LEGAL CONSULTANCY so we can guide you on the appropriate legal steps, or arrange for us to represent you directly if needed.

His family has no right to force you to give up or travel.

You have a legal right to alimony and housing, and you can resort to court to claim them urgently.

As for your savings (AED 25,000), you can file a lawsuit to recover them.

Dear Madam,

I am very sorry to hear about the abuse, financial neglect, and threats you have experienced.

The UAE's Federal Decree-Law No. 13 of 2024 on Protection Against Domestic Violence provides you with strong legal protection against physical, psychological, verbal, and economic abuse, including financial control and threats related to visa cancellations.

You have the right to:

- Report the abuse and financial neglect to the police or the Ministry of Human Resources and Emiratisation.

- Request protective orders against your husband and his family to prevent further harassment or threats.

- Access shelters and support services for victims of domestic violence.

- Seek legal remedies, including claims for financial support and protection for you and your children.

Your safety and well-being are paramount. If you wish, our legal team can assist you confidentially by guiding you through reporting processes, obtaining protection, and pursuing legal action.

Please do not hesitate to reach out for help and legal assistance.

Best regards.

Thank you for contacting us via Legal Advice Middle East.

Your situation involves financial neglect and coercion within a family and employment setting.

We have advised in similar cases where a husband was working under a relative, but the relative used control over salary and visa status to pressure the family.

The court treated this as both a labour and family matter, ensuring the wife and children received their rights regardless of what the employer/relative demanded.

Legally, your husband’s uncle cannot use visa threats or employment pressure to deny your family housing and basic expenses.

If your husband earns AED 8,000 monthly and is not providing you and the children with sufficient support, you may file a maintenance case (nafqa case) in the Family Court.

The court assesses his income and can order him to pay you monthly for housing, food, children’s schooling, and other basic needs.

This obligation is on your husband, not his uncle, even if the uncle is the employer.

If the uncle withheld your husband’s wages or forced you to sign documents, your husband can also complain to MOHRE (Ministry of Human Resources and Emiratisation) for unpaid salaries or coercive employment practices.

As for the AED 25,000 of your savings that were taken, if you have proof, you may also pursue a civil or even criminal complaint for misappropriation.

The best practical step now is to secure your immediate rights through Family Court for maintenance. At RASHID ALKAITOOB ADVOCATES & LEGAL CONSULTANTS, we have successfully obtained urgent maintenance orders for spouses and children in similar situations, ensuring that the family is not left without housing or living support.

To give you precise guidance, we would need to review your marriage documents, your husband’s employment contract, and any evidence regarding the withheld support and savings.

Our multilingual consultants (Arabic, English, Russian, Hindi, Chinese) are available to assist you confidentially.
