المنازعات الضريبية من الألف إلى الياء وفق قانون الإجراءات الضريبية الجديد

تأتي هذه المقالة ملخصاً موجزاً لإجراءات المنازعات الضريبية في دولة الإمارات العربية المتحدة على النحو الذي رسمها المرسوم بقانون اتحادي رقم 28 لسنة 2022 بشأن قانون الإجراءات الضريبية الاتحادي.

مجال الأثر المنشئ للترسيم (1)

أقر القانون عدد 46 لسنة 1992 المؤرخ في 04\05\1992 مبدأ المفعول المنشئ للترسيم، إلا أنه أجل تنفيذه مدة ثلاث سنوات من تاريخه، ثم مدد المشرع في الأجل مدة ثلاث سنوات أخرى بمقتضى القانون عدد 37 لسنة 1995 المؤرخ في 24\04\1995، ثم مدد فيه مدة ثلاث سنوات أخرى بموجب القانون عدد 30 لسنة 1998 المؤرخ في 20\04\1998، غير أنه استثنى من التمديد الرسوم العقارية المحدثة بعد دخوله حيز النفاذ، أي أن كل رسم محدث بعد قانون 1998 أصبح خاضعا للأثر المنشئ للترسيم.

الحجز التحفظي وفقا لقانون الاجراءات المدنية الاماراتي رقم 42 لسنة 2022

تُعدّ إجراءات الحجز التحفظي من أهم الوسائل القانونية التي تُمكّن الدائن من حماية حقوقه وضمان استيفاء ديونه قبل صدور حكم نهائي في النزاع. ويستند هذا الإجراء إلى نص المادة (247) من قانون الإجراءات المدنية الاتحادي، التي أجازت للدائن طلب توقيع الحجز التحفظي على أموال مدينه في حالات معينة تثير الخشية من ضياع الحق أو تهريب الأموال. وتبرز أهمية هذا النظام في كونه يوازن بين حماية حقوق الدائن وضمان عدم التعسف في تقييد أموال المدين، وفق ضوابط دقيقة رسمها القانون وأكدتها أحكام محكمة التمييز.

حجية الترسيم الإداري
