اقتضى الفصل 305 جديد من مجلة الحقوق العينية أن "كل حق عيني لا يتكون إلا بترسيمه بالسجل العقاري..."، وجاء بالفصل 278 منها : "لا يتكون الرهن العقاري إلا بعد ترسيمه...". ومفاد هذا أن الترسيم قد أصبح سنداً لنشأة الرهن العقاري، فلا يوجد هذا الرهن سواء بين أطرافه أو تجاه الغير إلا بإشهار كتبه. Legal blog
