ماذا يحدث في حالة عدم إتمام صفقة بيع عقار بسبب الإجراءات الرسمية؟
س: عزيزي، لقد وقّعت على نموذج "و" وكذلك ملحق ينتهي سريانه في 5 سبتمبر. في البداية لم أكن أعرف الإجراءات، ولم أكن أعرف أنه يجب عليّ سداد الرسوم المعلقة حتى أتمكن من بيع العقار الخاص بي. ظننت أنني سأتوصل إلى اتفاق مع المشتري، ووافق على ذلك مقابل تعويض سأتحمله أنا والوكالة. بعذ ذلك ذهبت إلى دولة الإمارات لمدة ثلاثة أسابيع ولكن لم يحدث شيء حتى عدت إلى فرنسا مرة أخرى. طلبوا مني العودة لتوقّيع العقد الأصلي لأن البنك لا يريد قبول النسخة الموقّعة. سؤالي هو؛ بما أن العقد الأصلي مرفوض وليس لدينا نسخة أصلية ولكن نسخة بي دي أف موقّعة، فهل يُعد هذا العقد ساريًا؟ أم أنه لا يُعد ساريًا ما لم يتم التوقيع على النسخة الورقية الأصلية؟ هل يمكنني الانسحاب من صفقة البيع؟ أيضًا، إذا كان العقد ساري حينها، ماذا سيحدث بحلول تاريخ الانتهاء؟ هل يمكنني الانسحاب من صفقة البيع مع العلم أن شهادة عدم الممانعة معلقة ولا يمكن تسجيل العقد في دائرة الأراضي والأملاك؟ شكرًا لك. أسئلة وأجوبة
