Our tenant is trying to delay eviction for sale and her cheques have bounced. How to evict her?

Q: Hi, We have an apartment that we are trying to sell and we also have a tenant living there. Her contract is until the end of May 2023. We sent her an eviction notice through notary public on Dec 2022 and she has 1 year to vacate the apartment. She wants to extend her contract from May to Dec as she is still allowed to stay til December as per notary notice. However, we are trying to stop her extension as she has bounced cheques, and she has been very uncooperative with agents viewing the apartment which is delaying the process of selling the apartment. What can I do with this?

What can I do if the landlord rented the apartment after evicting me for personal use?

Q: My landlord served me a 12-month notice to vacate saying he wants to move in himself. I know he will not move in and did this to rent the apartment at a much higher rate. I will vacate as per the notice. If he uses the apartment for any purpose other than his own living, what legal options will I have? Do I need to inform him of anything before I vacate?

Is the notice to vacate still valid after the agreement to renew the tenancy?

Q: Hi, My landlord sent me a 12-month notice to evacuate because they wish to sell their apartment. They initially wanted to increase the rent, but I spoke to them and agreed to the increase. We then agreed to renew the tenancy agreement based on the rental increase. However, I still have the notice because the landlord said she was unable to cancel it, as there is no option to cancel on the system. She said that once we renew the contract, the notice will be automatically invalidated. Is this true? I am renewing my contract in accordance with their terms of rent increase, but the landlord has been unable to retract the notice. How does she invalidate or retract the notice? What are my best options here? Thanks!

Can a landlord increase rent above RERA limits using DLD valuation?

Q: Dear Sir/Madam, My landlord in Dubai wants to increase my rent by an amount that is double the permitted increase by the RERA index (10%). I have insisted on capping the increase at the RERA index amount (5%). The landlord is threatening to request a Dubai Land Department (DLD) valuation, which he says will override the RERA index amount and likely result in a much higher increase (he says up to 40%). This is because my rent is generally low for the market. Can the DLD valuation really override the increase that is permitted by RERA?

ادعاء الخصم بيع المنقولات المحجوز عليها قبل قرار الحجز. ماذا أفعل؟

س: السلام عليكم، ادعى خصمي أنه باع المنقولات المحجوز عليها قبل صدور القرار بوقف التنفيذ في القضية، وأتى بعقد مبايعة مع أحد معارفه بتاريخ سابق لقرار وقف التنفيذ. أعلم يقينًا أن المبايعة صورية ولم تتم على أرض الواقع وأنها مجرد حبر على ورق، ولكن لا أملك إثباتًا. هل توجد طريقة قانونية لإجبار البائع أو المشتري ليثبت أنه قام بتسليم أو استلام المبلغ المذكور في المبايعة؟ أو قام المشتري بنقلها أو إعادة بيعها إلى مشترٍ آخر؟ أرجو إفادتي!

Can the landlord evict me or increase the rent by sending a two months notice for that?

Q: My landlord wants to evict me (60 days notice) because he wants to sell the property. I told him that he has to give me a 12 months notice which he sent and we received. He also wants to increase the rent above the RERA Index Calculator. I informed him that I am not willing to pay the increase above RERA calculator and also because he did not give us a 3 months notice for the increase and asking me to leave in 2 months. He does not want to renew the contract saying I did not confirm to him my intention to stay (as per contract it says 2 months notice to be given by the tentant or landlord if they want to stay or leave) and that I should leave in 2 months. I am aware that he knows we want to stay since we are discussing rent and eviciton in 12 months the landlord is using this now to evict us. We want him to be fair and want to understand our rights.

Q: Dear Sir/Madam, My landlord wants to evict me for "personal use of the property," but I am sure he wants to rent it out. My eviction notice came two months after my rent renewal, which means that at the end of my lease, I have to either renew my lease for two more months (which I am not sure is possible) or move out two months before the notice period ends. 1) If I choose the latter option, will I still be able to file a case against my landlord for evicting me so that he can rent out the property? 2) How much does it cost to file a case, how long does it typically take to win, and how much compensation is awarded? Is it worth it to file a case?
