Will the contract be automatically canceled if the bank does not process the mortgage?
Q: Hello, Legal Advice ME I am writing to seek your advice on my ongoing process of buying an apartment. I have signed contract F, which is valid until 15 Aug 2024. My plan was to buy it financed by a mortgage. I got my pre-approval and signed the contract, then passed it to the agency to complete all needed paperwork. The agency took over with the bank, and then I found out that the apartment, although not a hotel, is listed as a hotel apartment on the title deed. The bank said processing this would take a very long time. I applied with a different bank, again all pre-approved, but as soon as they found out about the property type stated on the title deed, they said they cannot finance it. My questions are: - If the first bank is unable to process all the paperwork on time, will the contract be automatically canceled? - Can I cancel the contract based on the fact that I was not made aware of the property type stated on the title deed before signing the contract? Would I get the 10% deposit back?

What can I do if the villa I rented is not in a livable condition and the rental cheque bounced?
Q: Hi there. I have taken a villa for rent in Mirdif, Dubai, and the owner handed over the property in an unlivable condition. So I didn`t want to stay in the property and wanted to end the contract. For now, the last rent cheque bounced and I am concerned that the landlord might file a case. I need legal help with the same.+4

Filing for custody and adultery after divorce if ex-wife abandoned children for boyfriend
Q: Dear lawyers, I have been divorced mutually in Dubai. The children have been living with me because my ex-wife chose to live with her boyfriend. Due to financial conditions, she chose a new life with a new man, abandoning the kids and her past. Now, as I legally want custody, she is creating drama, and her current boyfriend is taking advantage. She had a relationship with him before the divorce. I couldn`t file for adultery as I was focused on my career and children. Can I do it now? All evidence is present. The children are residing in Dubai, and she has completely stopped meeting them as her boyfriend controls her. He is married too and has children he has kept abroad.

I canceled the Ejari for my tenant after he subleased my apartment. Can I file a case?
Q: I am a landlord. I gave my apartment to a guy who did not pay any rent and used my apartment for subleasing. I got so angry that I canceled the Ejari online on DLD and it got canceled easily. Now I sent an eviction notice to the tenant as the tenant is absconding and granted a broker his POA. So I am planning to file a case in RDC. How to claim unpaid rent from a service agent to manage holiday home services for our apartment?
Q: We appointed a service agent to manage holiday home services for our apartment in Dubai. The agent completed all legal formalities with Dubai Economy and Tourism and commenced operations. However, the agent defaulted on the AED 50,000 payment of the app., and their offices are now closed. We got the mobile numbers of the agent’s officials. We believe we can also make the following compensation claims: 1. for our opportunity cost. 2. for the mental distress we endured. 3. For administrative costs incurred while chasing the agent, preparing claims, filing a complaint to DET, and related activities. We complained to DET, but it was closed as DET found the agent`s office was shut. DET advised us to pursue any suitable legal action. Accordingly, we have the questions on the following matters: 1. What are the appropriate steps to recover our legal entitlements? 2. What is the procedure for claiming the legal and associated costs from the defendant?

How can I remove a travel ban and fine in a criminal case to go to my home country?
Q: Hi. I am having an ongoing civil case in Sharjah. I need to travel to India because my father passed away yesterday. Therefore to do the last rites, I really have to travel to my home country. But the problem I am facing is that I have a pending fine to be paid in the criminal court which is 100,000 with which I have a travel ban. I have done nothing wrong to the company that I was working for but I still have gone through so much such as being put in jail for 8 days, not renewing my visa, and taking money from my account. I haven`t worked for the last 2 years and all my savings that I had in this country were all put to run the case. How is the start date of work calculated in case of disagreement with the employer upong resignation?
Q: Hello, I started working remotely and signed an offer letter in April 2023. As I was transitioning from another job, my offer letter said that I would work part-time in April, and I started working full-time on May 10, 23`. I landed in Dubai and got my employment visa and contract when I landed in July, although my offer letter was signed in April and I`ve been working since then. Now, I`m resigning, but my employer is calculating my annual leave and gratuity pay from July 23` (to avoid paying my gratuity pay and deduct fewer annual leave days from my notice period). Should my start date be counted from April 2023, since I started working in April, or from July? Developer asks for full year's service charges despite purchase at year-end. Can I refuse?
Q: Hello, I bought a property from a developer in Q4 2023 and got the keys handed over in November 2023. They have returned to me to pay additional service charges for the entire year although I purchased the flat from the previous owner in the last quarter of the year. I sent them multiple emails to explain the reason behind it and to ask them to send any legal statement showing that the new owners are responsible for paying additional fees, though this is unfair from my perspective as I have been the owner of the property starting from Nov 2023. Some friends told me that they received a letter from their lawyers which they sent to the developer questioning this procedure and refusing to pay this. Since I don`t have such a statement to send to them as well, is there any opportunity for somebody to help me in writing one, hopefully getting the chance not to pay the additional fees? Thanks!+2

An Ajman company driver died in a Sharjah accident. Which court for insurance?
Q: Dear Sir/Madam, Our company driver passed away in a road accident. He hit a heavy truck from behind and died on the spot. His family is in his home country. I have obtained the legal heirship certificate and had it attested. The insurance company requires a letter from the court mentioning the amount to be disbursed. The policy clearly states AED 200,000.00 in case of death. That is what we are hoping they will pass on to the family. Which court should we approach in this case? The accident occurred in Sharjah, and the company is based in Ajman. Your advice would be greatly appreciated!

What to do if my painting is copied and displayed in public without my permission?
Q: Dear Sir/Madam, I recently discovered that one of my paintings has been copied and displayed for 2 years in a public space/establishment in Abu Dhabi. I created the painting in 2018 for the celebration of the Year of Zayed. I noticed it last Sunday when I passed by the establishment. I tried to communicate with the project manager through a call and WhatsApp, but he didn`t answer. He replied once saying he would check, but never got back to me. I also tried to email the company but didn`t receive any response. I exhibited the painting in the same year, and I still have it with me. I never agreed to anyone using my painting or waived my rights to it. Now, my question is: do you think this is a form of plagiarism? Can you give me advice? As an artist, I feel this is not right.
