Can a landlord use the same evaluation certificate to increase the rent twice?
Q: Hello all, I`m renting a villa in the Springs area. Last year, the landlord made an evaluation certificate in March 2023 and 90 days before renewal, the property management company informed me that based on the evaluation certificate, the landlord would increase the price by 20%, I accepted it. Current contract from July 2023 till July 2024, rent value 160,000. In March 2024, I received an email from the landlord (92 days before renewal) that he wanted to increase rent again by 20% and attached the same certificate from March 2023 which has been used for the 2023 contract renewal. The certificate states that validity is 1 year. So when they sent an email with a notification, the certificate was still officially valid. Can the landlord use the evaluation certificate twice to increase property rent in 2023 and then in 2024? Why evaluation certificate is valid for 1 year if the market changes every month? How can I check that the certificate is not "fake"? Can the landlord use a certificate issued in March 2023 to increase the rent for the property, considering that the contract renewal date is in July 2024?

Temporary possession of brother's passport to leave UAE for an emergency
Q: Dear Sir/Madam, I am currently subject to a travel ban in the UAE, which prohibits me from leaving the country. Despite my critical circumstances, which include having multiple cases related to banking matters and cases in the Rental Dispute Centre, I find myself unable to travel due to this restriction. Complicating matters further, my wife is currently critically ill, necessitating my immediate need to travel. Given the urgency of my situation and the lack of a suitable guarantor, I am exploring all available options. I am currently running a small business in Dubai, and my brother is scheduled to join me in a few weeks. Is it possible for me to request temporary possession of my brother`s passport for a couple of weeks in order to leave the UAE to attend to my wife`s critical condition? Your prompt assistance and guidance on the available legal avenues would be greatly appreciated.

How can I get a refund after discovering that the goods are inauthentic?
Q: Dear Sir/Madam, We are a Dubai-based LLC that purchased merchandise from another Dubai-based LLC. The stock was delivered in Hong Kong for our Asia business. This transaction occurred between two Dubai firms and was out of scope. However, upon inspection, the goods were found to be inauthentic. We have given the supplier several weeks to provide evidence of their authenticity, but they have failed to do so. Tests conducted in China and Hong Kong have confirmed their inauthenticity. We are seeking a refund of €83,655 for the goods, as well as reimbursement for additional warehousing and shipping costs totaling approximately €15,000 since January. We possess all necessary evidence, including communications with the supplier wherein they confirmed the authenticity of the goods, as outlined in the contract terms and their invoice. Selling inauthentic goods is considered a criminal offense in some countries, and we cannot afford to be associated with such practices, resulting in significant losses for our business.

Q: Dear Sir/Madam, I would like to know if audio recordings are not allowed as evidence to upload on the Dubai Courts website. It`s because the system doesn`t allow me to do this. Most of my evidence consists of WhatsApp audio messages.

Signed MOU to buy property, but tenant refuses to leave. Can I cancel?
Q: Dear Sir/Madam, I have signed an MOU to buy a property. The MOU says that the property will be vacant on transfer. The current owner had given a 12-month notice to the tenant but the tenant is refusing to vacate. The owner has filed a case with RDC and the hearing date is also given. I worry that the tenant may not show up for the hearing and the hearing will be postponed beyond the MOU date. What are my options? Q: I`m a plaintiff (husband). On the 7th of Mar 2024, the first instance divorce judgment was provided based on Article 7 of federal law 41 of 2022 and based on Article 133 of civil code proceedings. Absconding status withdrawn from labor court, not from immigration. What next?
Q: Dear Sir/Madam, My employer put an absconding case against me in labor court. I won the labor case in court and requested for the withdrawal of the absconding status in the labor court, which was approved. However, my employer also filed an absconding case against me with immigration authorities. I received an email stating that an "Issued Outpass" has been approved and a document "Temporary Closure with Absconding" has been issued, giving me only 7 days to leave the country. Q: Dear Sir/Madam, I was overdue for my tenancy contract renewal; no one contacted me, and the contract expired 2 months ago. I have been living in this apartment for 2 years, and now the owner of the apartment wants to raise the price. I read that I had a grace period of 90 days to renew my contract, but the agency says that I only had 15 days. Who is right in this situation, and can I renew the contract at the old price?

Visa cancellation: Sign wrongful EOS or wait six months for automatic cancellation?
Q: Dear lawyers, I have a question about visa cancellation after termination and need urgent help. I got fired during probation and they told me to return everything immediately and not to serve during the notice period. So I returned to my home country before my last day of work (just 1 day earlier) due to a family emergency. After that, they settled my EOS and then initiated the visa cancellation. The EOS letter I signed at that time said "Termination Type: Termination by company". I was already out of the country at that time and they asked me to come back to UAE to cancel my visa but I didn`t. So now they said not to come back but asked me to sign a new EOS letter but this time it says "Termination Type: Out of country". If I sign this, can they put absconding on me? Can I just not sign it and wait for 6 months to get my visa canceled automatically? They do not seem to have good intentions, that`s why I need your help to ensure my rights are protected. How can I release funds from my accounts after being frozen for a year by the Central Bank?
Q: Hello, It`s been more than one year since all three bank accounts in Dubai were frozen suddenly without any notice. When I started to inquire regarding it I got the answer that my bank accounts are frozen by the Central Bank of the UAE. Although accounts are debit-frozen only. I had some heavy transactions in one of my accounts and there is a huge amount stuck in my bank accounts. I am willing to hire a lawyer or consultant who can assist me in releasing the funds from my accounts. I am currently out of the country but I still hold UAE residency. I got a lifetime ban because I could not pay my employment expenses. How to remove the ban?
Q: Hi I was working in a taxi company. Unfortunately, I was not able to pay their expenses which they spent on my visa fee and license. There was no other due payment on me, only the expenses that the company spent on the license and some other fees. They were holding my passport and I needed to come back home urgently. I told them that I couldn`t pay 9 thousand dirhams at once, so they put a lifetime ban on me. Can this type of ban be removed or not?
