We believe we can also make the following compensation claims: 1. for our opportunity cost. 2. for the mental distress we endured. 3. For administrative costs incurred while chasing the agent, preparing claims, filing a complaint to DET, and related activities. We complained to DET, but it was closed as DET found the agent`s office was shut. DET advised us to pursue any suitable legal action. Accordingly, we have the questions on the following matters: 1. What are the appropriate steps to recover our legal entitlements? 2. What is the procedure for claiming the legal and associated costs from the defendant?

Q: Hi. I am having an ongoing civil case in Sharjah. I need to travel to India because my father passed away yesterday. Therefore to do the last rites, I really have to travel to my home country. But the problem I am facing is that I have a pending fine to be paid in the criminal court which is 100,000 with which I have a travel ban. Q: Hello, I started working remotely and signed an offer letter in April 2023. As I was transitioning from another job, my offer letter said that I would work part-time in April, and I started working full-time on May 10, 23`. I landed in Dubai and got my employment visa and contract when I landed in July, although my offer letter was signed in April and I`ve been working since then. Now, I`m resigning, but my employer is calculating my annual leave and gratuity pay from July 23` (to avoid paying my gratuity pay and deduct fewer annual leave days from my notice period). Should my start date be counted from April 2023, since I started working in April, or from July? Developer asks for full year's service charges despite purchase at year-end. Can I refuse?

Q: Hello, I bought a property from a developer in Q4 2023 and got the keys handed over in November 2023. They have returned to me to pay additional service charges for the entire year although I purchased the flat from the previous owner in the last quarter of the year. I sent them multiple emails to explain the reason behind it and to ask them to send any legal statement showing that the new owners are responsible for paying additional fees, though this is unfair from my perspective as I have been the owner of the property starting from Nov 2023. Some friends told me that they received a letter from their lawyers which they sent to the developer questioning this procedure and refusing to pay this. Q: Dear Sir/Madam, I have been a tenant of an industrial unit since 2017. In 2022, the landlord`s real estate forced extra rent on me, and without much thought, I agreed to it. In 2023, they asked for another increase just one day before the tenancy expired. At that time, I filed with RDC and the tenancy was renewed. Later, the real estate sent me an email for non-renewal for the year 2024, but since it was not an official legal notice, I filed again with RDC and deposited the cheques. Now, the real estate wants to renew with a 10% increase in rent. I received the email 6 days prior to expiry, and I informed them about the law requiring a 90-day notice as per RERA. Yes, it is a challenge for me to fight for my rights, but I am not interested in giving the real estate an undue advantage in the case of renewal. RERA should look into the facilities and amenities that the property has before granting them rights to increase the rent as per the Index. Kindly guide me!

Q: Hello, I hope you can advise me, please! I`m a tenant in Dubai. The owner/agency didn`t send me the rent increase notice 90 days in advance. It was sent to me on Thu, 18 Apr, 22:16. My lease expires on June 24, 2024. So it`s 78 days instead of 90. But they claim that in the signed contract there is a statement: "In the event that the tenant wishes to renew the lease at the end of the tenancy, they should notify the landlord in writing 90 days prior to the expiry date of the rental contract." Since I didn`t do this, they demand to increase my rent by the maximum amount possible as per RERA. As far as I can understand, according to the law, if no one notifies anyone before 90 days, the default is to extend the lease. So there is no increase.
