Should renewal be 9 or 12 months if an eviction notice was sent 3 months before expiry?
Q: Dear Lawyers, I sent an eviction notice 3 months before the expiry of the contract. During renewal, the tenant is asking for a 12-month contract, but I refused and only offered 9 months to complete the eviction notice period. Am I legally right, or should I sign the 12-month contract and file a case against him in September?

Is an MOU still binding after delays due to rain if it contains a force majeure clause?
Q: Dear Sir/Madam, I signed an MOU on March 22, expecting building completion in April. The MOU had an expiry date of April 22; however, due to rain on April 15, the completion was delayed until May 30, 2024. I received the BCC on June 17 from the developer and paid for the pre-title deed on the seller`s behalf to expedite the process. Now, I have completed the pre-approval and valuation, but the bank is asking for the handover notice to release the final cheque, which the seller is refusing to share. The seller claims the MOU has expired, but it includes a force majeure clause. So, is this MOU still binding or not?

Q: Hi, Late at night, around 1 AM, I was speeding at 163 km/h in an 80 km/h zone in Khalifa City. I received a fine from the police and 23 black points. When I talked to the police, they told me I have to go to the traffic department for this issue. They also mentioned that the traffic department will initiate a case against me, potentially leading to prosecution. Will the case go to court? What charges will I face? What fines am I likely to pay? I heard that the court could also impose jail time for this offense. There was no accident or injury involved.

The employer agrees to withdraw the theft case, but the prosecutor refuses. What now?
Q: Dear Sir/Ma`am, I`m an accused in a theft case at my workstation. The amount stolen was 7000 AED. I surrendered, confessed, and agreed to pay the entire amount immediately to my employer. However, he still called the police and filed a case. At the same time, the police recovered the entire 7000 AED from me, but my boss was still not ready to drop the case. After a few days, he somehow agreed to an out-of-court settlement, demanding 10000 AED. We agreed to it and, in return, requested him to withdraw the case. We paid him the amount, and he got a letter from the typing center to withdraw the case. When he went to the police, they said the file had already been moved to the prosecutor. We went to the prosecutor, and they said the file had been moved to them, but they hadn`t registered the case in their system yet. Now the prosecutor doesn`t want to drop the case, as he wants legal action to be taken against me. Please assist with how to withdraw this case from the prosecutor. If it can`t be dropped, what actions might be imposed on me?2024/07/16

Sending a 12-month eviction notice to a tenant before the end of the tenancy contract
Q: Hello, My tenant`s current tenancy contract is due for renewal on 24th July 2024 (the contract period end date is 24th July 2024). However, I would like to give a 12-month eviction notice to my tenant before the end of the existing tenancy contract. Can I do it? If I give a 12-month eviction notice on 15th July 2024, the end date to be mentioned at the time of renewal of the new tenancy contract would be the end date of the 12-month eviction notice, right? Please confirm.

Can I cancel my house sale contract without extra fees after personal plans changed?
Q: Dear Lawyers, I signed a Form F with a buyer for the sale of my house as we were planning to leave the country. The contract was signed about a month ago, but the handover is not until August. Due to personal circumstances changing, we are no longer leaving Dubai and would like to cancel Form F. The Form F contract stipulates that we have to pay the buyer 10% of the purchase value. The real estate agent is now claiming that we also have to pay the buyer`s real estate commission and the conveyancing fee. Our understanding is that the 10% penalty is the only penalty. Is a non-renewable rental contract clause enforceable under UAE law?
Q: Dear Lawyers, While signing a rental renewal contract, the following clause is added: "This contract is a non-renewable contract, and the tenant agrees to vacate the premises at the end of the tenancy contract. He acknowledges that he has no right to file or claim in the future any lawsuit or compensation claim against the owner regarding this property, including what’s in it." The tenant signs the contract. My questions are: Q1. Is it legally enforceable within the UAE legal system, as it basically contradicts the basic rights of residents and tenants in the UAE? "No one has the right to prevent another person from resorting to the judiciary." Q2. This was used as a pressure instrument by the landlord as a condition of renewal after serving an eviction notice. This is all documented over emails. Q3.
