Can the new landlord evict us instantly for violating the "family use only" clause?

Q: Good Afternoon, We rent around 50 apartments for hotel staff accommodation in Dubai. This building has been sold to another person. The new owner is asking us to evacuate the building as soon as possible because he is selling these apartments. We have had the same accommodation since last year. Now, he is using a point mentioned in the contract: "3. This flat is for (Family Use Only), otherwise, the landlord has all rights to vacate the tenant from the property instantly and the tenant loses his/her rights and all the benefits under this lease, and the tenant agrees to this term. Pets not allowed." My question is: Does he have the right to force us to leave, and what is the grace period allowed for us to evacuate the apartments? Our current contract expires in January 2025. Should we vacate at the end of our tenancy or rely on the new owner's title deed date?

Q: Hi there! Our landlord sold the apartment we are currently staying in. We were aware they were on sale, but we never received any legal notice about it. We only received the title deed under the new owner`s name and issued the rest of the cheques to him. Can I appeal if landlord falsely claims rent non-payment despite evidence?

Q: Hi, I received a 30-day legal notice for missed rent on 26th Jan. I transferred the rent to the landlord by 7th Feb. I have communication from him that it was received. The subsequent months up until March were all paid and acknowledged by the landlord. A couple of weeks before renewal, he tried to increase the rent from 56k to 70k. On the contract renewal date, I filed an offer and renewal case, which the landlord did not respond to. On 8th May, he filed a case of First Instance stating he was still owed rent from the previous contract, which was already paid and acknowledged. I then uploaded the documents, but in English, and the decision went in his favor. Can I still appeal this enforcement?

Can the landlord increase rent according to the valuation certificate?

Q: Hello Everyone, I know it has been discussed quite a few times; however, it`s not clear. Can the landlord increase rent according to the valuation certificate? My current rent is AED 71,400. When I check the RERA Rental Index, below is the text being shown: When renewing real property lease contracts, the maximum percentage of rent increase for real property in the Emirate of Dubai is 5% of the rent of real property unit, where the rent is 11% to 20% less than the average rental value of similar units. The rent for a two-bedroom apartment in Port Saeed ranges from 72,000 to 88,000 AED per year (excluding water, electricity, or any other fees). The increase amounts to 3,570 AED per year. The landlord`s valuation certificate states AED 85,000. Therefore, my question is whether the rent can be raised to AED 85,000 using the valuation certificate, or if the increase should be limited to 5% since the valuation falls between 11-20%.

Moved into a new apartment with incomplete maintenance and Tawtheeq. What to do?

Q: Hello, We recently moved into a new apartment on the first of this month. Upon arrival, we discovered that maintenance had not been completed, and the Tawtheeq had not been changed to our name. When we inquired with the agent, they explained that the previous tenant`s contract did not end until the 8th of this month, and they had not terminated the contract. As a result, we are currently without power, water, and unable to register for AC. We are concerned about potential liability, as it seems we may have moved in illegally before the previous tenant`s contract ended. What should we do in this situation, and are we liable for anything regarding our move-in? Our contract states it begins on the 31st of May, and we have paid all fees to the agent and owner.

Am I obliged to accept the 25% judgment of my labor dues offered by the court liquidator?

Yesterday, I heard from my friends the court liquidator committee they are listing the employee for settlement. When I went, I found they were asking me to accept 25% of the judgment or leave it. I had no choice but to sign a paper they gave me. Can I claim compensation from my previous landlord for vacating me to increase the rent?

Q: My landlord evicted me after sending me a court notice that he intends to sell the property. I even told him that if this is just about increasing the rent, I would be happy to do that since my wife is undergoing cancer treatment and moving is difficult for us. Nonetheless, he asked us to vacate and is now renting the apartment out (but there does not seem to be any Ejari registered).
