Does a tenancy contract supersede the laws of the Real Estate Regulatory Agency (RERA)?
Q: Dear Lawyers, Dubai Tenancy Question Addendum: 1. In case of not renewing the contract, the tenant shall inform the landlord 3 months prior. If the tenant fails to do so, they shall bear a penalty of 2 months` rent for not notifying the landlord. 2. Failure to execute the renewal (at the sole discretion of the landlord) shall result in the automatic termination of this agreement. 3. The landlord unequivocally objects to the tenant`s continued occupation of the premises after the expiry of this agreement. An overstay fee shall apply from the day following the expiry of the term. The tenant’s continued occupation shall not result in the automatic renewal of this agreement. Questions: A. Does this addendum supersede the laws of the Real Estate Regulatory Agency (RERA)? B. Does the contract automatically renew, or is it considered terminated as per the conditions of the addendum? C. How much should be paid to the landlord if the tenant vacates a week after the expiry of the contract?

How to return to Dubai after leaving with unpaid credit card and possible absconding?
Q: Hi I have queries related to my residence visa and re-entry. Under some circumstances, I had to leave Dubai, while I was on a resident permit. I could not return back to the country due to some personal emergencies back home. I had some credit card dues and dues with bank charges. It`s been almost 2 years and I want to return back to Dubai through a visitor visa. How would I know if I can apply for a visitor visa? I recently bought a house, and the tenant abandoned it without notice. What should I do?
Q: Hello, I recently bought a house. In the sale contract, it was mentioned that the house was rented; however, upon the sale, the owner had returned the deposit to the tenant, and the tenant had abandoned the property without informing me. When I checked with the owner, he said he returned the deposit to the tenant so the tenant could pay it to me and start a new tenancy contract. I would like to know the following: 1. Is the tenant or the landlord at fault? 2. How can I pursue legal action against the landlord if he is liable? 3. What are the total fees (including all legal expenses) to pursue litigation? Can my landlord evict me immediately for overdue rent?
Q: Good day, I have one pending rent payment. Since I lost my job, I haven`t been able to pay my last rent, which will be 15 days overdue on November 15. How can I get my visa canceled for new employment if my free zone company has gone bust?
Q: Dear Lawyers, I am a free zone employee who resigned from the company. The company went bust and cannot cancel my visa. I raised a dispute with the Free Zone Authority, which was then transferred to MOHRE, and now I have to approach Al Adheed. I need to cancel my visa so that I can get hired elsewhere. The Free Zone Authority advised me to submit a court letter. Is this the NOC they are requesting? My priority is not receiving my dues but rather getting my visa canceled.2024/11/12

Dubai Court placed a hold on my account for another bank's case: what are my options?
Q: Hello, I received an SMS and email from A bank stating that my bank account is on hold as per a Dubai Court order. I only have AED 2,000 left in my account, which is for my treatment and medication because I have breast cancer. I lost my job last year and was unable to pay my personal loan installment with B bank. It was B bank that filed a case and a travel ban with Dubai Court. But how can Dubai Court put a hold on my A bank account, even though the case is with another bank (B bank)?

Can the wife lose the custody of her children due to a medical condition?
Q: I am a Hindu and my husband has filed for divorce in Dubai. We both stay in Dubai. He claimed for custody of our 11-month-old twins. The divorce is because of domestic violence and interference by his mother. I have had a history of epilepsy (a very rare occurrence) since 2011. I have been taking regular medication and working since 2011 as a teacher. The last time I had a seizure was in August 2023 when I was pregnant. No one was hurt although I fainted. My husband is claiming for the custody on these grounds. I have been staying with my kids, all by myself for the past 2 months. My husband has left me and my kids and stays somewhere else. I have worked in the US (2015-16) all by myself and have been working as a teacher in Dubai for 1.5 years. I have been driving in India since 2007 with no accidents or fines. My epilepsy has never affected my profession or lifestyle. I have been to different countries all by myself. Are there fair chances of me getting custody of my 11-month-old twins?+4

A bank has been restricting my account for 2 weeks now with no explanation: what can I do?
Q: Dear Lawyers, It’s been two weeks since a bank restricted my account (Debit only) without any notification or warning. My account status shows as active though. I have made countless calls, visited the branch 3 times, and raised a complaint (which was closed by the bank without resolving the issue) too but no response at all. They give the same reply every time whether you call the helpline or visit the branch. No one knows the reason why it’s restricted and every time it is the same reply: “Please wait, we have sent the reminder to the concerned department” from the last two weeks. I have no cases, no liabilities to pay, and have evidence of all the transactions carried out on my account. I just want to know what steps I can take to at least understand the reason behind the restrictions. It seems like the people working at that bank don’t even care. It’s really depressing how they have been treating their customer for the last two weeks.2024/11/11

Is the manager of the company liable if his name remains on the license after resignation?
Q: I was registered as a manager or signatory for a company. One year ago, I resigned, lost access to the company’s documentation and bank account, and had my visa canceled by the employer. Currently, I am working in a new company in the UAE with a new visa. I recently revealed that my name is still on my old company’s trade license for an unknown reason. I was registered as a manager in that company based on a Power of Attorney. I am not an owner or a shareholder of that company, and my name is not mentioned in the MoA of my old company. To my knowledge, the owners and managers threw up their company, left the UAE, and did not care about the company’s fate. The company has never operated and has no money in the bank account. What should I do to remove my name from the trade license if the owners do not respond to my messages?
