I rented an apartment and paid to discover construction noises next door. Can I terminate the lease without penalty?
Q: I moved to a new apartment in Dubai DIFC (paying AED 250,000 annual rent) and I paid in one cheque. There is construction next to my apartment which is quite noisy and disturbs me. This will continue for 2 more years. They start to go higher and louder. I`m in the 60th floor. As I record Podcasts and work from home, I need a silent environment. In my contract, it is written: "In the event of the Tenancy being terminated by the Tenant before the expiry of the Tenancy Period, the Tenant shall be liable to pay 2 months’ rent as a penalty for such termination. The Tenant shall give notice of not less than 2 months." Would it be possible for me to get out of my lease agreement without penalty? I can stay 2 more months and give notice, but I wouldn`t like to pay the 2 months penalty (46,000 AED). Would it be possible to force the landlord to put soundproofing on his cost? A company that does soundproofing could add a glass layer and soundproof one room for 20,000 AED. Many thanks for your help A.

Q: I had a cheque case against my company. I got the first judgment to close the file, but the plaintiff filed an appeal. The court has blocked my company, and I couldn`t renew it. Q: Hello, I am trying to leave the country. My father is my residency sponsor and guardian. I am 19 years old and not from the UAE. Am I allowed to travel alone without my father’s consent? I am planning to run away and seek asylum abroad because they are abusive, and I have proof of it. My father does not know that I am traveling, but after I pass immigration, he might receive an SMS notification that I have passed immigration and exited the country. Can I resign during probation without paying the training and visa costs mentioned in the contract?
Q: Hello, A month ago, I joined a company with a probation period of six months, but now I have received another opportunity that is better for me. However, my contract states that I must pay 5,000 AED to my current employer for training and visa costs if I choose to terminate the contract of my own free will. However, I have not received any training so far. The contract states: The Second Party shall be obliged to pay back the value of the training (which is estimated at an amount of 5,000 AED) when they terminate the employment contract based on their own free will (within one year) from the date of commencement of their contract, without prejudice to the First Party`s legal or contractual obligations. (The amount agreed upon for the value of the training period must be commensurate with the employment period of the employee). Can I resign from my current company and join another without paying?+1
