Q: Hello, How does the insurance claim process work in a traffic accident in Dubai? What is the procedure? Suppose a person gets into a car accident, and the accident report states that they are not at fault, with the medical report showing minimal injuries. Where should the claim be filed? Is it filed with the insurance company of the party at fault? If the insurance company fails to provide adequate compensation, what is the next step? Should a civil claim be filed in Dubai court, or is there an insurance claim authority to handle this? If the insurance authority also fails to provide compensation, is an appeal made to the court? Additionally, how much compensation can be requested for minimal injuries, what types of compensation can be claimed, and what kind of proof is required?

Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property
Q: Hi, I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building. The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024. One of the articles in the MoU states: In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates. I need help urgently.

My employment contract with the company is not signed by me. Is it still considered valid?
Q: Dear Sir/Madam, I am a tennis coach in Dubai. I have been with my company for 9 months and am seeking to resign. I have been approached for a position with another company. I am yet to receive an offer of employment. I would like to enquire if the issues I have with my company as stated below are legal: 1. My original employment contract between myself and the company is not signed by me. Is it deemed valid? 2. I also noticed that my job description differs from my employment contract (tennis coach) and visa (telecommunication assistant). 3. My employer has deducted funds from my salary for visa contributions that they state I am liable for. Is this correct? 4. Can I resign with immediate effect, and what are the implications thereof? 5. Can I terminate the tenancy contract is the tenant did not pay on the agreed time?
Q: I have a property to rent in Dubai and found someone to rent it. He paid the deposit and both parties signed contracts. The move-in date was the 12 September and he stated that he would pay the three cheques on the 12 September by 2.00 pm. No payment arrived on 12 September so we are planning to pull out. He did send a picture of 2 cheques and offered to make a payment late last night online for the first payment. No Ejari was registered as yet Can I pull out as the cheques were not delivered as agreed even though he offered late last night to pay the first installment online? The last online payment he made took 3 days to arrive in the account. I want to legally pull out. How do I do this and can I do it without any penalty? Does he lose his deposit and can he make a claim against me? If so, what does his legal action look like, i.e. what can he do? Regards+6

How to close a company with an expiring license and an inactive partner?
Q: Hi, I was part of a trading license that was used only for the visas of two partners, with no business activity. Now, the license is about to expire, and I need to close the company. The parents of the deceased partner are not cooperating, and the second partner is also not interested.
