Will the contract be automatically canceled if the bank does not process the mortgage?
Q: Hello, Legal Advice ME I am writing to seek your advice on my ongoing process of buying an apartment. I have signed contract F, which is valid until 15 Aug 2024. My plan was to buy it financed by a mortgage. I got my pre-approval and signed the contract, then passed it to the agency to complete all needed paperwork. The agency took over with the bank, and then I found out that the apartment, although not a hotel, is listed as a hotel apartment on the title deed. The bank said processing this would take a very long time. I applied with a different bank, again all pre-approved, but as soon as they found out about the property type stated on the title deed, they said they cannot finance it. My questions are: - If the first bank is unable to process all the paperwork on time, will the contract be automatically canceled? - Can I cancel the contract based on the fact that I was not made aware of the property type stated on the title deed before signing the contract? Would I get the 10% deposit back?

I got a new job and had to cancel my old residence visa, what to do with the visas of my dependents?
Q: Dear Sir/Madam, I have a residence visa and my 4 dependants (spouse and 3 kids) are under my sponsorship. I want to know if I got a new job and had to cancel my old residence visa, then what about my daughters` visas? Would I cancel them prior to my visa cancellation? Or are there any options for holding their visas and transferring to a new visa?

Why did my employer falsely file an absconding case against me?
Q: Dear Sir/Madam, Before my visa expired, I informed my manager and the owner that I did not want to renew it. I have all the proof that I left the job and the accommodation with the owner and manager`s approval. However, after a few months of waiting for my cancellation papers, they falsely filed an absconding case against me, which they later removed, citing a filing error and miscommunication with the owner`s staff. Is there any reason for the employer to do that? Could it be to avoid fees or something else? Please help me!2024/05/29

How can I take my kids to home country to protect them from my abusive husband?
Q: Dear Sir/Madam, My husband is refusing to renew my residency, and without it, I will lose my job by the end of this month. Since he wants me to go back to Nigeria, I asked him to allow me to take my kids, but he refused. I can`t leave the kids alone in Dubai because he constantly abuses them physically, verbally, and psychologically. When he is angry, he beats them with a drumstick even when they do nothing wrong and threatens to send them to a village in Nigeria to work on his dad`s farm. He slaps them hard, and the boys cry to me for comfort. He asked them to call me a witch and a bad person. When I was not working, he beat me constantly, saying it was because I was lazy and refused to get a job, despite my explanation that I had been trying. I need legal advice on how I can be allowed to take the kids with me back to Nigeria. Please, I want to find out what I can do.

The seller did not proceed with the transaction. Can the buyer claim the 10% fine?
Q: Dear Sir/Madam, Form F was signed between the seller and the buyer; however, the seller did not proceed with the transaction, resulting in its failure. The contract stipulates that if the seller breaches the deal without reason, they are obliged to pay a fine of 10%. Can I, as the buyer, take legal action?

In the MOA, it is written that for the General Assembly Meeting, the partners have to be informed about the date of the meeting through a registered letter to the address registered in the List of Partners. However, my partner asked me (by WhatsApp) not to send the meeting announcement through a registered letter to his address. Is it legal to send it by email instead of a registered letter?

Q: My friend got arrested by police at a public park. He was drunk and started a fight over there and they signed him a warning letter and left him. Q: We appointed a service agent to manage holiday home services for our apartment in Dubai. The agent completed all legal formalities with Dubai Economy and Tourism and commenced operations. However, the agent defaulted on the AED 50,000 payment of the app., and their offices are now closed. We got the mobile numbers of the agent’s officials. We believe we can also make the following compensation claims: 1. for our opportunity cost. 2. for the mental distress we endured. 3. For administrative costs incurred while chasing the agent, preparing claims, filing a complaint to DET, and related activities. We complained to DET, but it was closed as DET found the agent`s office was shut. DET advised us to pursue any suitable legal action. Accordingly, we have the questions on the following matters: 1. What are the appropriate steps to recover our legal entitlements? 2. What is the procedure for claiming the legal and associated costs from the defendant?

Q: I was served an eviction notice in November 2023. The contract terminates in August 2024. Do I need to sign a new contract for 3 months or will it automatically renew until November 2024? Do I have to pay the agent again for this contract?

Given the expired lease and invalid eviction notice, can I stay and continue to pay rent?
Q: Dear Sir/Madam, My landlord gave me notice on plain paper last year when the lease was renewed. He wrote two reasons for eviction: one that he may sell the property and the other that he may move in. The eviction letter was signed by him only, but the property has two owners (husband and wife). This year, when he asked me to vacate the property, I informed him that, according to the RDC, the notice needs to be from a notary public or sent via registered mail. I then submitted an Offer and Deposit with the RDC, but the landlord didn`t respond. The lease expired on May 10th. The landlord hasn`t followed up with anything so far. According to RERA, the rental contract is automatically renewed unless terminated by the courts (for non-payment, eviction, etc.). What course of action should I take now? Should I send an email to the landlord with the cheques, mentioning they are ready since I already submitted the Offer and Deposit, or should I file a case? Or should I wait for the landlord to approach me or file a case?
