Should we vacate at the end of our tenancy or rely on the new owner's title deed date?
Q: Hi there! Our landlord sold the apartment we are currently staying in. We were aware they were on sale, but we never received any legal notice about it. We only received the title deed under the new owner`s name and issued the rest of the cheques to him. Can the landlord increase rent according to the valuation certificate?
Q: Hello Everyone, I know it has been discussed quite a few times; however, it`s not clear. Can the landlord increase rent according to the valuation certificate? My current rent is AED 71,400. When I check the RERA Rental Index, below is the text being shown: When renewing real property lease contracts, the maximum percentage of rent increase for real property in the Emirate of Dubai is 5% of the rent of real property unit, where the rent is 11% to 20% less than the average rental value of similar units. The rent for a two-bedroom apartment in Port Saeed ranges from 72,000 to 88,000 AED per year (excluding water, electricity, or any other fees). The increase amounts to 3,570 AED per year. The landlord`s valuation certificate states AED 85,000. Therefore, my question is whether the rent can be raised to AED 85,000 using the valuation certificate, or if the increase should be limited to 5% since the valuation falls between 11-20%. أسئلة وأجوبة

Is it normal for a company to require an initial payment for visa and work permit?
Q: Sir/Madam, I am currently in India and have received an offer letter from a company based in Fujairah, UAE. They have asked me to contact a travel agency for the work permit and visa process. It seems I have to make an initial payment for these processes (the offer letter says it is the company`s official policy), and it will be reimbursed later. Is this normal? Please guide me. Can the landlord send an eviction notice by email if I refused rent increase?
Q: My rent contract ends on 9/8/2024. I contacted the landlord for renewal and he asked to increase the rent. He didn’t send any notice for an increase before 90 days, so I declined the requested increase. He called and said I should accept the increase or I have to leave. One day later, yesterday, he sent me (email) a notice to evict the apartment for selling, and he wrote he would provide a partial contract until 28 May 2025. Since I asked before in an email to share a copy of his EID, he used the same email subject to share the eviction notice. Can he do that before the contract renewal? He was willing to renew with higher rent and when I refused, he came with an eviction notice. What if pretends to sell it but doesn’t sell (shifts the ownership to wife)? How to check if it`s sold? Can he send the eviction notice through email or should be through registered mail? If emails are accepted, can he send them under another email subject (subject used: a copy of EID or passport)? How can I get my labor rights after filing execution without response from the employer?
Q: I have got the final labor case judgment date of 20/03/2024 and I waited for more than one month, but the company did not respond. So I registered an execution case dated 30/04/2024 in Dubai Courts and issued a notice to the company. One person visited the company location but a person from the company said that the company was not there, so the court representative took a picture of the location and reported back to the court. On 23/05/2024, I visited the Al Adheed Center again and they issued a digital notice by email, and till now the company has not responded. I need your expert advice, what should I do now? Will the contract be automatically canceled if the bank does not process the mortgage?
Q: Hello, Legal Advice ME I am writing to seek your advice on my ongoing process of buying an apartment. I have signed contract F, which is valid until 15 Aug 2024. My plan was to buy it financed by a mortgage. I got my pre-approval and signed the contract, then passed it to the agency to complete all needed paperwork. The agency took over with the bank, and then I found out that the apartment, although not a hotel, is listed as a hotel apartment on the title deed. The bank said processing this would take a very long time. I applied with a different bank, again all pre-approved, but as soon as they found out about the property type stated on the title deed, they said they cannot finance it. My questions are: - If the first bank is unable to process all the paperwork on time, will the contract be automatically canceled? - Can I cancel the contract based on the fact that I was not made aware of the property type stated on the title deed before signing the contract? Why did my employer falsely file an absconding case against me?
Q: Dear Sir/Madam, Before my visa expired, I informed my manager and the owner that I did not want to renew it. I have all the proof that I left the job and the accommodation with the owner and manager`s approval. However, after a few months of waiting for my cancellation papers, they falsely filed an absconding case against me, which they later removed, citing a filing error and miscommunication with the owner`s staff.
