Q: Dear Lawyers, Is it mandatory to register the marriage in MOFA to live together here in the UAE? We are both Muslims from different nationalities and nikah was done in another country. 1. We both have our own visas and have no dependency on each other in terms of any legal ground. 2. We do not have any plan to have a child since we both are over 45 years old. 3. We have no requirement to register the marriage in our home country. Still, is it mandatory to register the marriage with MOFA? We appreciate your valuable input to clarify this.

Can the court expert extend the timeline of delivering his report?
Q: In my misdemeanor case of 150,000, the case is in the upper court and is with the Ruler`s Court expert. The case went to the Ruler`s Court expert in October 2023, and the expert picked the case in Jan 2024. He said that the report will be ready in Apr 2024. Now there is a 2-month extension. Is there any timeline as to how much time the expert can take? Also, is there a maximum time as to how much time the case can stay in the upper court?

What is last workday with differing notice periods in employer's and MOHRE contract?
Q: Hi, I need advice on the termination of my contract and notice period. I`m in the first year of my second fixed-term contract with my employer (a school) and was terminated on March 21st due to restructuring. My employer`s contract states that I must give one term`s notice, so they want my last working day to be July 5th. However, my MOHRE contract states that "the terminating party shall notify the other party of such desire 3 months as a prior notice before the determined date of termination, such period shall be similar for both." My employer argues that because we had a two-week spring holiday followed by a one-week Eid holiday, my notice period does not include the holidays. Can you please advise on what my last working day should be? Additionally, what is the correct end date of the notice period, and how can I get my employer to agree?2024/04/29

Can the employer force me to stay until my visa expires if my contract already expired?
Q: I have a doubt about my visa expiry. My MOHRE contract expired yesterday but my visa will expire on June 8, 2024, so my company is asking me to work till my visa expires. If I consider the visa date, I need to work for 26 months but as per the UAE law, the contract has been made for 24 months. So is it legal to work till the visa expires? Can I travel to Qatar if a collection agency told me I have a travel ban for an unpaid loan?
Q: Salam, I received an email from a company in the UAE - which is a collection agency - informing me that I had a travel ban and arrest warrant issued in the UAE for an unpaid loan a week ago. I currently live in the US. I have sent them many emails asking them how can I pay or make installments to settle this amount of 332,430 dirhams. I am currently working with them and trying to resolve the issue. My question is I would like to know if I travel for 5 days to Doha, Qatar in May, will I be detained or I will be ok? I don’t believe so I just want to be sure because I will be with my family. Thank you again.

Do I need to pay my company any compensation if I resign during probation?
Q: I worked for a company and due to the lack of work-life balance affecting my mental and physical health, I submitted my resignation according to the contract I signed. The contract stipulated a two-month notice period during my probation as I joined this company on 05 Dec 2023. I submitted my resignation on March 20 stating my last working day as May 20 But the company released me on April 16. However, for the month of March, I did not receive my salary. Now the company is asking me to sign the visa cancellation letter In this letter there is a clause stating "I certify that I have received all my dues up to date - Employee signature" but I have not received my salary. I also explicitly asked them whether they would deduct any amount for the visas as some people have told me that some companies do such things even when nothing is mentioned in the contract. They replied to that email stating they would provide dues but did not mention any specific date. Please advise me on how to proceed.2024/04/23

Q: Dear Sir/Madam, I am currently subject to a travel ban in the UAE, which prohibits me from leaving the country. Despite my critical circumstances, which include having multiple cases related to banking matters and cases in the Rental Dispute Centre, I find myself unable to travel due to this restriction. Complicating matters further, my wife is currently critically ill, necessitating my immediate need to travel. Given the urgency of my situation and the lack of a suitable guarantor, I am exploring all available options. I am currently running a small business in Dubai, and my brother is scheduled to join me in a few weeks.
