What can I do if the tenant is subletting my property and not paying rent?
Q: The tenant is not paying and subletting nor getting utilities connected in their name. He also changed the door lock after moving in. His security cheques and rental cheques are bouncing & he knows that he will get a. notice so he is prepared for that too. He is part of a tenancy scam where these people pay the first month`s rent as cash then the security deposit post-dated cheque which gets bounced. Can we file a lawsuit directly or do we have to first send a notary notice for vacating and cheque bounce? Can one notice serve both? And can we go to our flat and get details of those staying there? Please advise. They also changed locks and only last month Ejari was signed.

How can I get a refund from a contractor who failed to complete renovation work?
Q: Dear Lawyers, I hired a contractor for my apartment renovation, and we agreed on the scope of work based on the quotation they provided. I have paid them almost 90% of the total value, but they have not completed the work on time and have not used the materials specified in the quote. They have also significantly delayed the project, and despite multiple follow-ups, they never provided the milestone details for the payment schedule, nor did they adhere to the timelines they committed to. I have payment details, the agreed-upon quotation signed by them, as well as email exchanges and WhatsApp group discussions. However, I don’t have a formal contract or agreement. I made payments whenever they requested, but they have cheated me, resulting in a significant loss of time and money due to delays. I am seeking legal help to obtain a refund from this company and take necessary action against them.

As a partner who loaned money to the company, should I sue the company or my partner?
Q: Dear Lawyers, I am a 50% partner in a company. I had given a 2M AED loan to the company about 10 years ago. There are expert reports and bank records to prove the loan. The company does not have any bank balances or assets. Should I start a lawsuit against the company and demand 2M AED, or should I start a lawsuit against the other 50% partner and demand 1M AED? One benefit of suing the company is that I can obtain an acknowledgment of debt, and later in an execution case, I can issue a certificate of solvency to have the other partner arrested. However, suing the other 50% partner directly would include their name in the executive writ. Please guide me! (I believe all necessary legal information is provided here. What are the chances of recovering my money from a fraudulent immigration company?
Q: Good Morning, A fraudulent company committed to providing results from the AIP program in Canada. I paid approximately AED 80,000 in November 2023, and they gave me a post-dated cheque to ensure my amount. They failed to deliver the results as promised; the owner himself decided to roll back the program and proceed with a refund, but he eventually did not fulfill his commitments, even after agreeing to installments. We have been chasing him since March 2024, but he is not responding. He has nothing to say, and currently, he is not in the UAE. In this case, how can I recover my hard-earned money, which is for our children? How can I file a case? Currently, I am living in Saudi Arabia. I know there is some platform where I can raise an online complaint, but I’m not sure how long it could take to finalize the case. What are the chances of winning? Many people have been trapped in this fraud; I am not the only one. The owner committed this fraud through his sales employee with over 100 victims.

How can I evict non-paying tenants after their cheque bounced?
Q: Dear Lawyers, I rented my apartment to a tenant. Before they moved in, they mentioned having a money issue and agreed to pay one month`s rent first. They said they would pay the deposit and the next month`s rent the following month. They also agreed to sign one open cheque for the deposit and one cheque for each month’s rent. In the one month they stayed, I received three notifications from the management team regarding violations of building rules, such as putting decorations on the door. At the end of the month, the cheque bounced due to signature issues, which implies that all the cheques cannot be deposited. I have tried to contact them, but they do not respond. I realize this could become a serious problem. What can I do now to reduce my loss and evict them? Thank you!

Are WhatsApp messages and bank receipts valid evidence against a scammer friend?
Q: Hello! I got scammed by my friend. She asked me to give her money, promising to return it, but when I asked for my money, she refused to give it back. There’s no contact between us except for WhatsApp messages, and I transferred the money to her via bank (I have the bank receipts). A few days later, I discovered that she scams many people like this, including her colleagues. She claims that she’s broke but uses this money in stock trading. Everyone is afraid to come forward because they don’t want to spend money on a case they believe they will never win. People around me told me that without a written agreement, I can’t go to court because I will definitely lose. They said, “You don’t have any solid evidence.” However, I have WhatsApp messages and know three people whom she scammed and took thousands from. What do you advise me to do? Q: Hello, My tenant`s current tenancy contract is due for renewal on 24th July 2024 (the contract period end date is 24th July 2024). However, I would like to give a 12-month eviction notice to my tenant before the end of the existing tenancy contract. Can I do it? If I give a 12-month eviction notice on 15th July 2024, the end date to be mentioned at the time of renewal of the new tenancy contract would be the end date of the 12-month eviction notice, right? Please confirm.

Bank filed a civil case over a loan: Better to settle with the bank or in court?
Q: Good day, Sir, I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019. I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED. What will be the best way for me to proceed: approaching the bank or dealing with it in court? Best regards,

Is a rent increase notice sent by the previous property management still valid?
Q: Good afternoon, I have a Real Estate property management license in Dubai. I recently entered into a management agreement with a landlord of a fully occupied building. Now, I am dealing with a situation where I can`t send rent increase notices 90 days prior because my company was not managing the building 90 days ago. If the previous real estate company did send these formal notices, can we consider those valid for us as well? In the worst case, where we cannot reach an agreement with the tenant and open a lawsuit in RDC, can we present the notices that were not made by us but were still made in compliance with the laws? As per RERA and UAE laws, can these formal notices for rental increases be sent via email to the tenant`s registered email address?
