Can the new landlord evict us instantly for violating the "family use only" clause?

Q: Good Afternoon, We rent around 50 apartments for hotel staff accommodation in Dubai. This building has been sold to another person. The new owner is asking us to evacuate the building as soon as possible because he is selling these apartments. We have had the same accommodation since last year. Now, he is using a point mentioned in the contract: "3. This flat is for (Family Use Only), otherwise, the landlord has all rights to vacate the tenant from the property instantly and the tenant loses his/her rights and all the benefits under this lease, and the tenant agrees to this term. Pets not allowed." My question is: Does he have the right to force us to leave, and what is the grace period allowed for us to evacuate the apartments? Our current contract expires in January 2025. Should we vacate at the end of our tenancy or rely on the new owner's title deed date?

Q: Hi there! Our landlord sold the apartment we are currently staying in. We were aware they were on sale, but we never received any legal notice about it. We only received the title deed under the new owner`s name and issued the rest of the cheques to him. Should we vacate the apartment at the end of our tenancy contract, or rely on the title deed`s date (not sure if it is the correct document though)? Thanks in advance!

Can I appeal if landlord falsely claims rent non-payment despite evidence?

Q: Hi, I received a 30-day legal notice for missed rent on 26th Jan. I transferred the rent to the landlord by 7th Feb. I have communication from him that it was received. The subsequent months up until March were all paid and acknowledged by the landlord. A couple of weeks before renewal, he tried to increase the rent from 56k to 70k. On the contract renewal date, I filed an offer and renewal case, which the landlord did not respond to. On 8th May, he filed a case of First Instance stating he was still owed rent from the previous contract, which was already paid and acknowledged. I then uploaded the documents, but in English, and the decision went in his favor. Can I still appeal this enforcement?

Q: Hello Everyone, I know it has been discussed quite a few times; however, it`s not clear. Can the landlord increase rent according to the valuation certificate? My current rent is AED 71,400. When I check the RERA Rental Index, below is the text being shown: When renewing real property lease contracts, the maximum percentage of rent increase for real property in the Emirate of Dubai is 5% of the rent of real property unit, where the rent is 11% to 20% less than the average rental value of similar units. The rent for a two-bedroom apartment in Port Saeed ranges from 72,000 to 88,000 AED per year (excluding water, electricity, or any other fees). The increase amounts to 3,570 AED per year. The landlord`s valuation certificate states AED 85,000. Therefore, my question is whether the rent can be raised to AED 85,000 using the valuation certificate, or if the increase should be limited to 5% since the valuation falls between 11-20%.

Moved into a new apartment with incomplete maintenance and Tawtheeq. What to do?

Q: Hello, We recently moved into a new apartment on the first of this month. Upon arrival, we discovered that maintenance had not been completed, and the Tawtheeq had not been changed to our name. When we inquired with the agent, they explained that the previous tenant`s contract did not end until the 8th of this month, and they had not terminated the contract. As a result, we are currently without power, water, and unable to register for AC. How to claim my share in a company from a partner who is trying to put hand on everything?

Q: On June 23rd, I was introduced to a gentleman through a friend to partner with on developing a new software solution. For his end of the deal, he was to produce 45% of the software to a spec which was agreed in June, and then once it was built to that spec the company would take over payments. The company was established Aug 23rd. In September, he started asking for payments for 50% of the costs, circa 10k Euro or development would stop. To date, I have paid almost 70k Euro to him for the development. The software only became useable, still not to the agreed spec around 90 days ago. Since then he has been trying to get myself and my wife (jointly we own 45%) out of the company through various means. He tried to steal the domain by accessing my personal Tasjeel account to transfer to his own but this was stopped. He is now threatening to force company closure, no refund of our money, and keep the software for himself. What can we do? He has used almost all my cash to date to get to this point.

An Ajman company driver died in a Sharjah accident. Which court for insurance?

Q: Dear Sir/Madam, Our company driver passed away in a road accident. He hit a heavy truck from behind and died on the spot. His family is in his home country. I have obtained the legal heirship certificate and had it attested. The insurance company requires a letter from the court mentioning the amount to be disbursed. How can I make sure I can enter the UAE if I paid my entire pending loan after leaving?

Q: Good day, I`m using a credit card with one of the banks in the UAE. I received an SMS stating that my card was added to Apple Pay, followed by a debit transaction of AED 15,000, then two OTPs, and finally seven debit transactions. By the time I blocked the card, a total of eight transactions had occurred, amounting to more than AED 90,000. I immediately called the bank after blocking the card and reported all the fraudulent transactions. I also sent Dispute Forms the same day.
