Q: Hi, I had an unpaid loan in the UAE, and because of that, I had a travel ban. The loan was settled two weeks ago. I have now received a new job offer in the UAE. There is a delay from the bank in providing the clearance letter. Can I enter the UAE with an email from the bank stating that the loan has been closed?

Can we terminate a staff member who did not return to work after annual leave?

Q: Hello, We have a staff member who was supposed to return to work on 15 September 2024 from annual leave (they went back to their home country). However, after trying to reach them, they finally told us on 12 September that they have a travel ban due to legal issues that they are being accused of. They said that they have a hearing on 13 Sep and will update us on the matter. However, we have not heard from them since then. We have tried to contact him but nothing. What are our options here? We unfortunately cannot keep waiting for them (as operationally, we needed him back), and due to this being a legal matter (we don`t want him to work for us anymore, it seems serious). Would Article 44 Clause 8 apply here? We haven`t heard from him in over 7 consecutive days, but it also states that it applies if they failed to give a legitimate reason (which technically they have?).

Should my landlord provide the exact rent increase 90 days before contract renewal?

Q: Dear Lawyers, I`m confused and seeking clarification, please! Every year, the landlord either doesn`t send the renewal notice at all or sends it without specifying the exact amount of the increase, only mentioning that it will be as per RERA market value. Am I not legally supposed to be informed of the exact amount (total or percentage) of any increase 90 days before the contract`s due date?

Recovering funds from a bounced check issuer who is abroad but still receiving a salary in the UAE

Q: Hi, I filed a case in the UAE over a bounced check for 100k AED. A judgment was issued against the check issuer, along with a travel ban. The problem is, the person has already left the UAE but is still receiving a salary in the UAE, paid into the same bank account the check was issued from (20k per month). Is there a way to deduct from their future income, or do I have to wait until they attempt to re-enter the country?

Can I claim compensation from the employer if he terminates me with a shorter notice?

Q: I moved from another country for a job almost 6 months ago. Based on the offer letter and employment contract I received and signed, I agreed to a 3-month probation and a 3-month notice period before coming to Dubai. Upon arriving in Dubai, I was then given a MOL contract which I was told was standard 6 months probation. I was told at 3 months that I had passed my probation. I have just come to my 6-month mark (just before my exact 6-month date) and have been told I did not pass my probation and have been given 14 days` notice. Where do I stand? The employer is not negotiating and is stating it is standing by the MOL agreement and not the employment contract. The company has bounced between the 2 agreements in order to suit its own interests.

Q: I have a marital dispute with my wife in Kerala, India. I lost my parents last year and I have given the power of attorney to my mother`s sister in Kerala. Now my wife is threatening me through WhatsApp and emails and demanding money. She was under my family visa and three months back I canceled the same, and she is currently in India for the last 1 year. Can I terminate the tenancy contract is the tenant did not pay on the agreed time?

Q: I have a property to rent in Dubai and found someone to rent it. He paid the deposit and both parties signed contracts. The move-in date was the 12 September and he stated that he would pay the three cheques on the 12 September by 2.00 pm. No payment arrived on 12 September so we are planning to pull out. He did send a picture of 2 cheques and offered to make a payment late last night online for the first payment. No Ejari was registered as yet Can I pull out as the cheques were not delivered as agreed even though he offered late last night to pay the first installment online? The last online payment he made took 3 days to arrive in the account. I want to legally pull out. How do I do this and can I do it without any penalty? Does he lose his deposit and can he make a claim against me? If so, what does his legal action look like, i.e. what can he do? Regards

Can we contest the non-renewal notice and claim renovation compensation?

Q: Hi All, I need your advice, please. We got a shell and core office in June 2024 and started the fit-out works. It’s almost 80% done. Now the property management has given us a non-renewal notice for next year, so we will only stay for one year. We replied and told them it would be better to stop now, as we don’t want to complete the renovation just to move out next year. We asked for a refund for our initial payment and for the fit-out construction. To what extent or how much can we claim for damages, such as the time and effort wasted? Since April, we haven’t had an office because they made us wait for a few months. Is it possible to contest this non-renewal? What are our rights? Please advise! Thank you!

How can I recover my money if the court fined the scammer but my lawyer says it's not possible?

Q: Dear Lawyers, I have been a victim of a scam. I already have a court order confirming that I was scammed, and the court has issued a fine of 250,000 AED for the scammer. However, my lawyer told me that the amount will go to the government. When I asked how we would proceed to recover my money, they claimed it’s not possible and that this is as far as they will assist me, leaving me on my own moving forward.
