I have a marital dispute with my wife. Can she come from India to the UAE and claim alimony?

I have a marital dispute with my wife in Kerala, India.

I lost my parents last year and I have given the power of attorney to my mother's sister in Kerala.

Now my wife is threatening me through WhatsApp and emails and demanding money.

She was under my family visa and three months back I canceled the same, and she is currently in India for the last 1 year.

My concern is if she comes here with a visit visa and makes any issues, what legal help can I get as per the UAE law?

I'm sorry to hear about your situation. Here are some steps you can take and legal options available to you under UAE law:

1. **Document Everything**

- Keep records of all communications from your wife, including WhatsApp messages and emails where she makes threats or demands money. This documentation could be crucial if you need to take legal action.

2. **Legal Consultation**

- Consult with a lawyer who specializes in family law in the UAE. They can provide specific advice tailored to your situation and help you understand your rights. We are honored to represent you legally. Please contact us on the phone or via email.

3. **Police Report**

- If you feel threatened, you can report the situation to the police. A formal complaint can provide evidence and may help if she attempts to create issues upon her arrival in the UAE.

4. **Power of Attorney**

- Since you have given power of attorney to your mother’s sister, ensure that she is aware of your current situation. She may be able to assist you in managing your affairs in India.

5. **Addressing Financial Demands**

- If your wife is making financial demands that you find unreasonable, a lawyer can help you respond appropriately. Discuss whether her demands have any legal standing, especially given that you have canceled her family visa.

6. **Preventing Entry Issues**

- While you can't stop your wife from entering the UAE if she has a valid visit visa, you can prepare legally to address any issues she may cause. Should she engage in harassing behavior, you could file a complaint upon her arrival.

7. **Family Court**

- If disputes escalate, you may need to file for divorce or take other legal action through the family courts in the UAE. A lawyer can guide you through the necessary procedures.

8. **Seeking Protection**

- In cases where there are legitimate threats to your safety or well-being, you can seek a restraining order or other forms of legal protection, which your lawyer can assist you with.

It's crucial to seek legal a lawyer as soon as possible given the complex dynamics of this situation. Being proactive and informed can help you manage any disputes that may arise effectively.

Dear N.

Thanks for your inquiry.

According to UAE law, if your wife comes to the UAE on a visit visa and causes any issues, you can file a complaint with the police. The police will then investigate the matter and take necessary action based on the evidence provided.

If your wife is making threats and demanding money, you can also file a complaint with the police or the public prosecution for harassment and extortion.

This can be done even if she is in India, as long as the threats and demands are being made through electronic means such as WhatsApp and email.

If your wife has any legal claims against you, she can file a case in the UAE courts. However, as you have already canceled her family visa and she is currently in India, it may be difficult for her to pursue legal action in the UAE.

It is important to note that the laws and procedures in the UAE may differ from those in India. It is advisable to seek legal advice from us as a lawyer in the UAE who is familiar with UAE law to understand your rights and options in this situation.

Kindly do not hesitate to contact us by email for further guidance.

Greetings

It depends on the problem your wife will cause. Currently, there is nothing to respond to.

We would like to know the purpose for which she is threatening you. She cannot legally create trouble against you in UAE.

But as a wife, she may have some rights according to the prevailing family law inside the country.

We will let you know the consequences and remedies in detail.

Kindly share your WhatsApp number to discuss this further.
