Who should submit a dispute to RERA/RDSC if the rent increase is unlawful—the landlord or tenant?

Q: Dear Lawyers, My Dubai landlord is proposing a 9.52% rent increase, which I believe is unlawful. The current rent falls within the RERA rental index range, and no increase is permitted according to the index. The landlord’s representative has been uncooperative in providing proof of a Power of Attorney (POA) or any justification for the proposed increase. Questions: 1. Whose responsibility is it to submit a dispute to RERA/RDSC if the proposed rent increase is unlawful—the landlord`s or the tenant`s? 2. What evidence is required from the landlord (or their representative) to legally justify a rent increase that exceeds what RERA allows? 3. If the Ejari is not renewed due to a dispute at RDSC, will utilities (e.g., DEWA) and services be affected for the tenant?

I recently bought a house, and the tenant abandoned it without notice. What should I do?

Q: Hello, I recently bought a house. In the sale contract, it was mentioned that the house was rented; however, upon the sale, the owner had returned the deposit to the tenant, and the tenant had abandoned the property without informing me. When I checked with the owner, he said he returned the deposit to the tenant so the tenant could pay it to me and start a new tenancy contract. I would like to know the following: 1. Is the tenant or the landlord at fault? 2. How can I pursue legal action against the landlord if he is liable? 3. What are the total fees (including all legal expenses) to pursue litigation? Can the wife lose the custody of her children due to a medical condition?

Q: I am a Hindu and my husband has filed for divorce in Dubai. We both stay in Dubai. He claimed for custody of our 11-month-old twins. The divorce is because of domestic violence and interference by his mother. I have had a history of epilepsy (a very rare occurrence) since 2011. I have been taking regular medication and working since 2011 as a teacher. The last time I had a seizure was in August 2023 when I was pregnant. No one was hurt although I fainted. My husband is claiming for the custody on these grounds. I have been staying with my kids, all by myself for the past 2 months. My husband has left me and my kids and stays somewhere else. I have worked in the US (2015-16) all by myself and have been working as a teacher in Dubai for 1.5 years. I have been driving in India since 2007 with no accidents or fines. My epilepsy has never affected my profession or lifestyle. I have been to different countries all by myself. Are there fair chances of me getting custody of my 11-month-old twins?

Can a newly added no sharing clause impact a 5-year living arrangement with friends?

The landlord served me an eviction notice for sale. Can I stay if I prove his intention is to increase rent?

Q: I have been renting an apartment in Dubai for 5 years. The landlord was not happy last 3 years as they were not able to raise rent more than the RERA calculator. In 2023, they sent me an email, non-notarized, asking me to evict the property for the reason of personal use. I refused this as it did not go through court and the contract was renewed for another year. This time, in 2024, they sent a court eviction notice with a reason for sale. It was sent 12 months before the end of the contract. In the period since the notice was sent, they did not try to sell the property or list it anywhere for sale. My question is, can I dispute the notice based on the reason they do not show any intent to sell, and that I suspect they only want me out so they can re-rent it higher?
