Employer asking to pay recruitment fees after 5 months of work: Is this legal?

Q: Hi! I have been working at a school in the UAE for 5 months now. I have submitted my resignation, and my employer is asking me to pay recruitment fees as part of my final settlement. Is this legal, even if I am serving my notice period? In my offer letter, my probation period is stated as one month, but in my contract, it is stated as six months. How do I file a complaint? Can we get out of a real estate contract if the agent lied about the property?

Q: Hello, We signed a Form F to purchase an apartment, but later, we discovered that the real estate agent lied about the apartment`s amenities. We were not allowed to view the apartment before signing because we were told it was rented out on a short-term basis, which we have proof was a lie. The apartment has many issues that were not disclosed to us. What are our chances of getting the contract canceled without penalty?

Can the landlord increase my current office contract by 19%?

Q: My landlord sent me an email to renew the current office contract with a 19% rent increase. Our office is in Business Bay and he mentioned in the email that the price is still reasonable knowing that the offices in the same building with the same area size are more expensive. My question: Is that legal to increase the rent by more than 10%?

Security guard's breach of company accommodation: Can I take legal action?

Q: Dear Sir/Madam, I was at my company accommodation when my roommate and some of his friends were having a small gathering and consuming alcohol (legally purchased from MMI). Suddenly, the security guard and the accommodation assistant in charge breached into the room without knocking or ringing the doorbell. They took all the liquor bottles and recorded a video of everyone, including myself. I agree that consuming alcohol in staff accommodation is not allowed, but that is not my problem because I did not consume any alcohol. My question is, is it legal for them to breach someone`s privacy and take a video? If it is illegal, how can I take action against them?

Can I cancel the eviction notice to the tenant after sending it?

Q: Good morning, We bought a house in November 2022, made the eviction letter, and rented ourselves a house. Our lease is expiring in August and must renew it by the end of this month. Our tenant told us they will move this summer but did not hear from them yet. Can we just send them a letter specifying that they can stay and renew their rent if they wish or what does the law say in that case? Thank you in advance for your answer.

Is a 3-year-old POA valid in Dubai?

Q: Hello Experts, I am in the process of buying a townhouse in Dubai (Mira Oasis). I am a Dubai resident, but I am currently outside of Dubai. Unfortunately, I am unable to travel to Dubai to complete the DLD transaction. I have given my brother a full power of attorney (POA) in Dubai to carry out all transactions on my behalf, including property transactions. The POA was created three years ago. Can he carry out the property purchase and registration process on my behalf with a three-year-old POA? There is no expiry date mentioned on the POA, but I have heard that POAs are generally valid for two years only. Appreciate your advice!

Is it legal for my landlord to increase rent after changing company name?

Q: Hi, Our landlord increased the rent by 10% from last year. We moved in last September 2022, and our landlord took checks from ABC for a 2BHK at xxxxx Courtyard for 66,000. This year, he opened a new company (CDF), and we all tenants received new contracts with a 10% rent increase. Is this allowed? Can the company name be changed and the rent increased by 10%? I believe that the rent should not increase for the first two years, or that the rent should remain the same for the first year in the new company. Renting a villa after failing to sell it, even after offering it to the previous tenant?

Q: Dear Sir/Madam, I am a landlord and gave notice (through a Notary Public) to the tenant to vacate the villa for personal use or to sell it one year ago. The tenant vacated the villa after one year as per the notice. I failed to sell the villa after trying to sell it through multiple agents for the past two months. I re-offered my previous tenant the villa for rent for one more year as I failed to sell it, through email (7 days ago). However, I have not received any response to this email. Please advise whether I can proceed with renting the villa to another tenant as I am incurring losses by paying EMI, maintenance, etc. Please also advise if the previous tenant can still ask for compensation. How to settle a divorce case in execution with ex-husband who is outside the UAE?

Q: I got my divorce executed last year from Dubai & my ex hasn`t come back to Dubai yet. Now he is pleading to remove the execution case but I don`t trust him a bit because he doesn`t want to pay a penny. He says he will come to Dubai & settle whatever. I don`t trust him. What should I do?

Can landlords in Dubai increase rent if RERA index has not changed?

Q: Hi, I am an owner of an apartment in Dubai. It has been rented out for the past 2 years. The market rate of rent has now increased, however, the RERA index has not changed in the past 3 years. I gave my tenant a 90-day notice notifying him of an increase in rent, however, he is not accepting and will only pay as per the RERA index. The matter is now with the RDC, where he has filed a case against me. The RDC session is scheduled for next week. If I provide a DLD rent valuation certificate, will the RDC consider my request, or will they stick to the RERA index? In case the tenant wins the verdict, will I have to pay any legal fees? Regards,

What is the procedure to evict a tenant and renew the lease after buying a new apartment?

Q: Hi, I just bought an apartment in Dubai on 4 May 23 but there is a tenant whose Ejari from the previous owner is valid until 18 Dec 23. The Ejari with the same T&Cs has been transferred to my name today. My questions are: 1) Can I issue him an exit notice now? If I do so, does it mean that based on the 12-month notice period he will have to vacate my premises on June 24? 2) The tenant continues to stay after the tenancy contract validity i.e. 18 Dec 23 based on the notice period. Do I have to register a new Ejari with him from 19 Dec 23 onwards or I can just wait for his notice period to get over based on the exit notice? 3) A friend said that I have to wait for the current Ejari to get over for the 12-month notice to get started i.e. when the current Ejari expires on 18 Dec 23. This means I can give him an exit notice on June 23 but he will vacate the house on Dec 24 only. Is this correct? Please help
