How to protect my deposit if financing falls through?
Q: Dear Lawyers, I have verbally agreed on the sale price of a property I wish to buy. What happens if I sign the MoU, deposit my 10% security, and the finance falls through, or the bank undervalues the property, meaning I’d need a larger deposit? Can I get it written into the MoU that for such reasons I will not be liable to lose my deposit or cover agents` fees, and would this be legally binding?

Is it legal for my parents to withhold my passport?
Q: Dear Lawyers, Is it possible for my parents to withhold my passport from me? Due to my strict family, as an Emirati female above the age of 21, my mother is withholding my passport from me. I have the opportunity to study for my master`s abroad, and my flight is due in less than 3 weeks. She hasn’t allowed me to renew my passport, nor is she aware of the opportunity due to my fear of the abuse I might receive. There is a history of both physical and emotional abuse in the past; however, the proof is only my memory. I have a voice message proving that she won’t give me my passport, and I’m afraid that they will hurt me upon knowing I’m packing my bags or lock me up. What can I do?

Bank filed a civil case over a loan: Better to settle with the bank or in court?
Q: Good day, Sir, I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019. I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED. What will be the best way for me to proceed: approaching the bank or dealing with it in court? Best regards,

Can a tenant claim compensation if they leave early and I re-lease the apartment?
Q: Dear Lawyers, My Dubai tenant`s rental agreement is ending at the end of November 2024, and the completion of the 12-month legally served eviction notice (for reasons of personal use or sale) is at the end of March 2025. The tenant still has 9 months until the eviction notice date. However, the tenant has sent a notice stating that as per the above-mentioned eviction notice, he wants to vacate the property by giving one month`s notice, as per the tenancy agreement. I don`t have any problem with the tenant leaving as it is as per the tenancy agreement, but my question is, once the tenant leaves, can he still file a case and claim compensation if I lease the apartment to someone else within the next two years or not? How can I get a deposit refund after the seller refused to fix a faulty used car?
Q: Dear Lawyers, I agreed with a seller to buy a used car for which I paid a deposit, but the car failed an RTA inspection. The seller refused to fix the car and refund the money. After going back and forth, I agreed to pay part of the cost (300 Dhs) to save my deposit. We tried to transfer the car, but the office was closed, so it wasn`t done while I paid the balance amount as well. I took the car for a drive, and it became clear that the seller was lying. The car overheated after just 15 minutes. I immediately called him and paid for recovery to take the car to a garage of his choice. The mechanic said that either the head gasket is blown or the engine needs a replacement. I asked for a refund, but he refused. We went to the police station, where they tried to reason with him, but he refused to listen to them as well. The police eventually told me to file a case to claim my refund. I have proof of all the bank transfers and WhatsApp chats to back my claim.

Where can I dispute recurring deductions by courier company for past shipments?
Q: Dear lawyers, I run a small business in Dubai and use a courier company for delivering goods to customers (with cash on delivery payment). The courier accumulates COD payments and transfers them to us weekly, deducting their delivery charges. We have a renewing one-year contract with fixed shipping rates per kg. Recently, the courier company started making additional deductions for past shipments, which were already shipped and paid for, including: - In November 2023, they deducted approximately 1500 dhs for shipments completed in August and September 2023. - In May 2024, they deducted 3596 dhs for shipments completed from January 2023 to December 2023 (that contract has already expired). Previously, they explained that they "recalculated the parcel weights," but I cannot verify this because the items were shipped a long time ago (last year!). Questions: 1.
