Can the employer refuse my offer to pay compensation instead of serving notice upon resignation?
Q: Hi there. I have resigned in March. My last day is June 12th. When I finish I will have completed 11 months. I have offered compensation in lieu of notice. My company has rejected it. Is this legal for them to reject? Secondly - as said the last day is June 12th. My employer told me today they will not pay me my May salary in May. Instead, they will hold it and pay in my settlement in June. Is this legal? I work in a free zone but their employment rights they have said are as per MOHRE.

My receivable commission has been delayed by the company. How can I claim it?
Q: Hi Team, I would like to ask. I`m an agent in the UAE, and my receivable commission has been delayed by my agency which is above AED 1 million. However the company is not running well lately, and it has a risk of insolvency. If it really happens, who should I claim my commission from? If there are still commissions not paid by the developer to the company, can I claim that part from the developer directly? Many thanks.

The landlord demands increased rent without proper notice. What to do?
Q: Dear Sir/Madam, I have been a tenant of an industrial unit since 2017. In 2022, the landlord`s real estate forced extra rent on me, and without much thought, I agreed to it. In 2023, they asked for another increase just one day before the tenancy expired. At that time, I filed with RDC and the tenancy was renewed. Later, the real estate sent me an email for non-renewal for the year 2024, but since it was not an official legal notice, I filed again with RDC and deposited the cheques. Now, the real estate wants to renew with a 10% increase in rent. I received the email 6 days prior to expiry, and I informed them about the law requiring a 90-day notice as per RERA. Yes, it is a challenge for me to fight for my rights, but I am not interested in giving the real estate an undue advantage in the case of renewal. RERA should look into the facilities and amenities that the property has before granting them rights to increase the rent as per the Index. Kindly guide me!

It looks like some corrosive fluid was sprayed on the top and one of the car door`s paint and the roof-top glass are damaged. My employer holds my passport and asks for visa expenses to cancel it. Should I pay?
Q: Dear Sir/Madam, I am an expatriate in Dubai. I joined a company in Dubai, and my contract started in November 2023. It is a limited contract. Due to some issues with the management, they informed me that I would have to leave the company in March 2024, which I did. Upon asking them to cancel my visa so I can return home, they said I have to pay around 5000 AED towards the visa expenses. I have asked them for the exact amount, but they haven’t provided it yet. My passport is with them. I would like to check whether I have to pay the visa expense to them. Since I am not aware of the formalities, I haven’t approached the Labour Department to get my passport back to leave. I fear they may cause more trouble if I initiate a complaint. I would like to seek your valuable advice on how to proceed to claim my passport and exit UAE. Please help!

What can I do if the landlord evicted me to sell the apartment and rented it for a higher price?
Q: I was given a legal notice to evict my apartment by the landlord because he wants to sell the apartment but no one has come to see the apartment once in 10 months. I found out that the landlord has multiple units in the same building and gave a similar notice to all. In some cases, he renewed the lease for another year after increasing the 35 to 40 percent rent and in some cases, he rented out after 3 months. My question is if a tenant got evicted and then offered first refusal to move back in then what is the point? The tenant has already moved to a new apartment and can`t accept the offer to move back. This will allow the landlord to rent out again at a higher price. Please advise2024/05/06

The floods damaged my property. Who fixes it and compensates me?
Q: Dear Sir/Madam, My property in Dubai was damaged due to floods and is now mostly uninhabitable. The property management/builder is not taking any steps to rectify the situation. Much of the damage occurred because a water pump in the nearby lake (part of the community) failed. If it had not failed, much less water would have entered the property. Q: Hello, I’m a tenant living in Dubai in a rented apartment. During winter, the air conditioning in common areas and the ground floor lobby of my building is switched off. In summer, they are switched on but limited to 10-14 hours a day. I have written emails to management, but they continue with the same practice.
