Unpaid for 5 months: Should I leave immediately or file a complaint with MOHRE?
Q: Good day! I would like to seek advice regarding my situation. I am currently employed by a Freezone company under a limited contract valid until October 2024. The issue is that they haven’t paid our salaries for 5 months (since February 2024). We have been receiving monthly promises that they will pay and settle the amounts, but we haven`t received anything. I tried talking to the management and sent them emails, and they again promised that they will settle everything in 2 months. I want to know my rights and if it is possible to leave without the notice period since they are already in breach of contract. Additionally, is it better to complain to MOHRE immediately before my resignation, or should I wait for the 2 months they promised? Thank you for the insights!

Is a non-renewable rental contract clause enforceable under UAE law?
Q: Dear Lawyers, While signing a rental renewal contract, the following clause is added: "This contract is a non-renewable contract, and the tenant agrees to vacate the premises at the end of the tenancy contract. He acknowledges that he has no right to file or claim in the future any lawsuit or compensation claim against the owner regarding this property, including what’s in it." The tenant signs the contract. My questions are: Q1. Is it legally enforceable within the UAE legal system, as it basically contradicts the basic rights of residents and tenants in the UAE? "No one has the right to prevent another person from resorting to the judiciary." Q2. This was used as a pressure instrument by the landlord as a condition of renewal after serving an eviction notice. This is all documented over emails. Q3. Can I sue the landlord for using the pressure tactic of serving me an eviction notice, pressing me for a rental increase, and making me sign this clause? All communications are documented.

Q: Dear Sir/Madam, My husband legally resides in the UAE and owns a company here. He is in France now for summer vacation, and I want to file for divorce in the UAE. Can he force me to move back to France to avoid the divorce? We have two children in school here, and he is now acting as if he doesn`t approve of their continuing school in the UAE. I can prove that he is a UAE resident and owns a company and several cars in the UAE. Can he force me to move with the children to France? Q: Hello, I kindly ask for clarification of the following situation: The Dubai Family Court of First Instance gave the father visitation rights, and he has a Sharia Execution Case for implementation. At the appeal, it was a tragic verdict: the judges rejected his visitation rights because the marriage was invalidated due to religious differences. - Is this decision implemented automatically, or is there an execution procedure, with an execution writ, similar to the first instance? - Is it possible for the father to still meet the child until the execution procedure is completed? - Does Chapter 5 of the Federal Decree by Law on Promulgating the Civil Procedure Code, which deals with Executing Execution Writs and Decisions Related to Personal Status Matters, apply to the appeal or only to the first instance? Q: Dear Lawyers, Is it possible for my parents to withhold my passport from me? Due to my strict family, as an Emirati female above the age of 21, my mother is withholding my passport from me. I have the opportunity to study for my master`s abroad, and my flight is due in less than 3 weeks. She hasn’t allowed me to renew my passport, nor is she aware of the opportunity due to my fear of the abuse I might receive. There is a history of both physical and emotional abuse in the past; however, the proof is only my memory. I have a voice message proving that she won’t give me my passport, and I’m afraid that they will hurt me upon knowing I’m packing my bags or lock me up. What can I do?

Bank filed a civil case over a loan: Better to settle with the bank or in court?
Q: Good day, Sir, I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019. I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. Can I renew my lease despite the agency adding an eviction clause without my consent?
Q: Hi, The real estate agency that leased me the apartment included: "Tenant confirmed that they will vacate the property after the end of the contract" under additional terms in my Ejari without consulting me.
