If a DIFC employer requires a non-compete agreement, should they compensate the employee?

Dear Lawyers,

If my employer in DIFC requires a non-compete agreement that prohibits me from working in my specialty at another company, should they compensate me for this downtime?

What else can I do if I have spent my entire life developing in my field?

Which law regulates this issue in the DIFC zone?

Dear Questioner,

The law specifies that the agreement must be of a fixed term and specific to the region, so you can work in your specialty in another region.

For clarification and procedures, you can contact the Ministry of Human Resources and Emiratisation.

Best regards,

Dear Questioner,

The Dubai International Financial Centre (DIFC) has its own Employment Law that regulates non-compete agreements.

Non-compete clauses can't completely prevent you from working in your field. They must be reasonable in terms.

We will discuss the possibilities in detail. Kindly share your WhatsApp number to proceed.

Dear Questioner,

The employer does not compensate the employee in such a case, and the employee can work anywhere they wish provided:

1) They do not leak information from the first employer to the second employer, and 2) they do not take clients from the first employer to the second employer.

The non-compete clause does not mean depriving the employee of working in the field they understand.

Dear Questioner,

According to the DIFC Employment Law, an employer in the DIFC is required to provide reasonable financial compensation if they require an employee to sign a non-compete agreement that restricts their ability to work in their field for a specific period of time after leaving the company.

This compensation should be fair and take into account the employee's skills, experience, and potential loss of earnings.

If you feel that the compensation offered by your employer is not sufficient, you may negotiate with them for a higher amount or seek legal assistance to explore your options.

It is recommended to seek personal legal advice before signing any non-compete agreement to ensure that your rights and interests are protected.

The DIFC Employment Law regulates issues related to non-compete agreements in the DIFC zone.

It is important to familiarize yourself with the specific provisions of this law and seek legal advice if you have any concerns about the terms of the agreement imposed by your employer.
