Can the new landlord rent the apartment once the tenant leaves?

Q: Hello, I am buying a unit that is already rented out. The previous owner sent an eviction notice for sale to the tenant. I have some questions: 1. If the tenant is served an eviction notice of 12 months, do I still need to serve a notice after buying? 2. After the transaction, when the tenant leaves after 12 months, can I rent the apartment? I don`t need to wait 2 years in this case. Is that right? Thanks in advance!

Q: Hi, I am an Indian National married to an Indian in India and I am currently not residing with my husband. I stay separately with my son. I have a few questions regarding my case: 1. My request for temporary maintenance towards me and my son was rejected because I am working. Why isn`t maintenance given to working women, and how does this affect the final judgment? 2. How long does it usually take from the witness hearing to get the final judgment? 3. Will local courts accept Indian laws if submitted, even if the other party disagrees? 4. Will our company be liable for accidents of workers who are sponsored by another company?

Q: Hi, I am running a startup company in a home renovation business. We have some laborers coming on a daily basis and working on the site and they are paid on a daily basis. Our company is not their sponsor and we simply hire them for a few days to do some labor work. The question is during the work (e.g., while drilling or demolishing) if something happens to one of these laborers, will we be responsible? given they are not directly employed or sponsored by us, should they have their own health insurance while working? How can we protect the business?

I have signed Form F and got the mortgage but the seller is in breach. What to do?

Q: Hi I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023. When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual. Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress. So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller. So I need to ask the following: 1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23? 2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller? 3. What is your advice? Can the brokerage company of the property buyer withhold the commission of the seller's company?

Q: I am writing to seek your legal expertise and advice on a pressing issue concerning a property sale transaction that my brokerage company has facilitated. Here are the details: Our brokerage company represented the seller in a property sale where the property was sold with an existing rental agreement in place. As per the terms of the agreement, the rental balance was supposed to be given to the buyer, who is now the new owner of the property. In this transaction, our company is entitled to a 40% commission, and the buyer`s brokerage company is entitled to 60%. However, the buyer`s brokerage company, which has complete control over the buyer`s funds, has transferred the entire 100% commission to their own account. They are currently withholding this commission, stating that they will release it once the rental balance is paid to the buyer. Unfortunately, we have lost contact with the buyer, as he has blocked the seller`s agent, making it impossible for us to fulfill this condition.

س: سيدي/سيدتي، قدّم موظف مستندًا ومرفقاته إلى بلديتين للحصول على شهادة عدم ممانعة من اتصالات لقطعة أرض. الموظف، الذي لا يجيد اللغة العربية ولا الإجراءات المتبعة في تلك البلدية، قدّم بالخطأ نموذجًا مُعبأً مسبقًا من مشروع آخر (مُختوم من البلدية)، وقام ببساطة بتغيير معلومات المشروع وتقديمه. أدرك الموظف الخطأ لاحقًا وصححه في إحدى البلديتين. أما في البلدية الأخرى، فقد اعتبروا أن الموظف قد زوّر المستند، ورفعوا دعوى قضائية. ألقت الشركة باللوم على الموظف في كل شيء، مع أن تقديم هذه الطلبات لم يكن من اختصاصه. ماذا سيحدث في هذه الحالة، عندما كان الأمر مجرد خطأ بسيط؟ لم يتضرر منه أحد، ولم يكن المشروع قد بدأ بعد؛ كان مجرد شهادة عدم ممانعة لقطعة أرض.

How will the gratuity be calculated if the company changed my contract and salary?

Q: Dear Sir, I started to work in a company on 28-Feb-2012. In 2014, due to a change in the name of the company/license, they canceled the visa and gave me a new visa to continue. While they changed my visa, they gave me 2 years of gratuity/EOSB. After that, in June 2020, my package was changed due to a specific contract & accordingly, the MOL contract document was changed for visa processing. The changed package is more than previous. Now I have resigned, Please advise; 1. What will be the timeframe to calculate the EOSB (from 2012 or 2014)? 2. Would I receive a gratuity based on my current basic income for the whole year of service (2012/2014 to 2023 Sep.) or my previous pay scale (up to year 2020) & 2020 to now with my current pay scale?

A tenant offers to pay rent after 30-day notice: What are my options?

Q: Dear Sir/Madam, Rental dispute with my tenant. Timeline of events: 1. Cheque due date: June 8, 2023. 2. Gave him 25 days as requested. 3. Raised a formal police complaint for a bounced cheque (as the account was closed/fraud) on July 3, 2023. 4. Again asked him to pay up or vacate; he asked for more time and I gave him more time. 5. Sent him a formal 30-day legal notice to pay and vacate the property on August 2, 2023. 6. On August 24, he called me to offer a partial payment; I said he had to pay in full by the due date. 7. On August 25, I received the RDC notice of offer and deposit, in which he stated the following: "The applicant requests your kind approval to accept an offer and deposit a cash amount of AED XXX in exchange for the rental value." If I accept the notice, how much time will he be given by the court to pay the amount? If I reject the offer, what will be the implications? Can I still open a case against him to vacate the unit when the 30-day legal notice expires on September 1?
