Can employer force me to work after contract ends if the visa is still valid?
Greetings,
My labor contract expires on August 22, 2023. I submitted a notice of non-renewal on August 7.
However, my boss said that I need to continue going to work because my Emirates ID indicates that my visa expires on October 12.
She threatened to take me to court if I do not comply. Which one should I follow?
Thank you!
Dear Questioner,
Good day!
Please be informed that as per Art. 42 (2) of the current labor law, the employment contract shall be terminated upon the expiry of the date specified in the labor contract, not in Emirates ID.
The validity of the employer-employee relationship is determined by the employment contract.
Accordingly, you may demand the settlement of outstanding payment upon the expiry on 22 August 2023 and the employer shall proceed with the cancellation of the visa, further to such settlement.

Dear Client,
Thanks for your question! I hope you are doing well. I will definitely assist you in this matter.
Certainly, if your labor contract expires on August 22 and you've given a notice of non-renewal, you might have the right to stop working after your notice period ends.
The expiration date on your Emirates ID could be due to administrative processes.
