Can I petition for immediate eviction due to tenant violations and refusal to vacate after notice?
Q: Dear Lawyers, I have a question regarding an immediate eviction petition to the Urgent Judge. The tenant did not return the apartment on 26 January 2025, despite a 12-month legal notice that ended on 25 January 2025. The tenant rejected all gas and fire prevention maintenance for 12 months. Al-Fanar Gas submitted a report with the tenant`s signature and refusal after the tenant broke the gas detector. The apartment was sold, and the new owner gave the tenant 90 days` notice. The tenant refused to show the new owner the apartment and ran away, according to building management. The tenant ignored the 12-month legal notice, did not return the apartment, broke the gas detector, and refused gas and fire detection system maintenance. The deal will be voided if the new owner cannot enter the property promptly. Can I petition the Urgent Matters Judge for quick eviction based on the tenant`s violations?

Can I close my LLC company and pay off all my debts and liabilities if the the license is expired?
Q: Good Morning, I want to close my company (an LLC located in Sharjah) and leave. I have personal and company liabilities which I plan to settle before I leave. My company license ended in December 2024. Can I pay off personal debts and company liabilities without renewing the company license (including renewal of tenancy contract) in the next 2 to 3 months? I want to avoid license renewal fees and tenancy contract associated costs since I am anyways planning to leave. Is that possible? If so, how much time do I have? Thanks for your advice.

Can I finalize our divorce in the UAE while my wife is in her country?
Q: Hello, My wife and I are from two different countries (Egypt and Tunisia), and we both reside in the UAE. She recently traveled back to Tunisia, and while her residency in the UAE is still active, we are unsure if she will return. We have agreed to divorce and do not have children. How should we proceed with the divorce process? Does she need to be in the UAE to complete it, or can the process be handled remotely?

How can I exit a partnership linked to an expired license and accumulating fines?
Q: Good Day! I am a partner in a trading license with two other individuals. Both of them were managing the business together as a cash-based operation without a bank account, while I was working elsewhere as an employee. Now, one of the partners has passed away, and his parents are in conflict with the remaining partner, claiming he owes them money. However, the surviving partner insists that no money is owed and that everything is settled. The license has now expired and cannot be renewed because the deceased partner’s family is not cooperating, leading to fines due to the inability to renew it. Additionally, the remaining partner continues to conduct the same business, occasionally purchasing items under the company name. As I am a low-salaried individual and cannot afford court fees, is there a way to remove myself from this situation, or are there any authorities who can assist me in this matter? I am willing to help and provide whatever is required as evidence in this case. Please advise!

A contractor did waterproofing on my roof but water leaked and made damages. What can I do?
Q: A contractor recently did waterproofing on my townhouse roof and confirmed a warranty of 5 years (on WhatsApp). The payment receipt and invoice are available. In 4 months, water leaks from the roof damaged the false ceiling inside the house. When contacted, he avoids calls and delays by making some excuses. Is there any way I can get my money back?+1

Can Dubai Courts take steps to ensure that I see my child as per the joint custody order?
Q: I have shared joint custody orders issued in France for my child, which are recognized and enforced by Dubai Courts. Unfortunately, I haven`t been able to see my 3-year-old child for several months due to the mother’s non-compliance with the handover arrangement, despite fines being imposed for these violations. The police are assisting in supervising the handover process; however, because it takes place in the presence of the mother, it has become challenging. At only 3 years old, the child is too young to form an independent opinion about these arrangements and is currently under the mother’s influence. This raises concerns about ensuring the custody orders are effectively implemented. To my understanding, the police are limited to a supervisory role and may not have the authority to enforce the physical handover. Can Dubai Courts take steps to ensure the handover is carried out as ordered? If so, how would this process be enforced to uphold the custody arrangement?

Does the Abu Dhabi Family Court have jurisdiction over my U.S. assets in the divorce?
Q: Hello, Both my (now) ex-wife and I are Americans and non-Muslims living in Abu Dhabi. We are going through a divorce in the Abu Dhabi Family Court. My ex-wife is suing me for a (very large) financial support package, and I am being asked to disclose my personal financial information. Two questions: 1. Do the courts have any jurisdiction over the USD assets I hold in the USA? 2. Am I required to reveal any information about my company, which is an independent legal entity based in the USA? Canceling my MoU and getting my deposit back due to a low bank valuation and overpriced property
Q: Hi, I wanted to purchase a 2-bedroom apartment in JVC Dubai. I gave a 10% security deposit cheque to the seller. The price mentioned in the MoU is very high compared to other similar apartments in the same building. The bank’s valuation also came in very low. Since the valuation is much lower, how can I terminate the MoU and get my cheque back? The MoU ends on 1st October 2024. One of the articles in the MoU states: In the event that the Buyer fails to make the payments as agreed or fails to complete the transfer on the agreed date due to his own acts or omissions, the Seller has the right to terminate this agreement and retain the deposit, provided that the termination is due to a violation of the agreed terms, unless both parties agree amicably to different dates. I need help urgently.

How can I withdraw from a family business partnership while ensuring no liabilities?
Q: Hi, I’m one of three partners in a family business, where a father holds 50%, and two siblings hold 25% each, with 0% for the service provider. Does the service provider have any claims on the company if something happens to one of the partners? I’m currently the guarantor for a loan, and I have authority over vehicle sales and purchases. What are my rights to withdraw from the partnership? How can I do it legally without causing any liabilities for myself? Can the other partner take over as loan guarantor instead of me? What are the procedures? My father has authorized the siblings as dual signatories for bank cheques, but the bank has not yet approved this. Can I withdraw from the partnership before the approval is finalized? Please advise on the rights of a partner when withdrawing from a partnership.

Can my employer demand repayment of salary after acknowledging an increase?
Q: Hello, I currently work for an American company based out of the US, but my contract is through a legal entity in the UAE. I received a salary increase last December. I had to sign a salary increase document. I have been getting paid that salary since. Now the company has a registered entity in the UAE. While they were reviewing the financials to transfer our contracts from the current local entity to the new one, HR claims they made a mistake, stating that I have been overpaid. They are asking me to revert to my previous salary and pay back the extra money I received. I have the signed contracts and the emails where they are admitting that error. Note that the new salary has been submitted to the involuntary loss of job insurance, and I have also applied for a bank loan using the new salary, providing certificates from my current local employer with that salary to secure the loan. How to speed up buyer’s bank account opening and claim security deposit if delayed?
Q: Dear Lawyers, I am selling an apartment in Dubai to a US-based buyer. The Form F was signed at the end of May and has been extended twice to allow the buyer to secure financing. They have received pre-approval and are now waiting for the final offer letter. To obtain the final offer letter, the buyers (husband and wife) need to travel to the UAE to open a bank account. Due to personal circumstances, they cannot travel together, which means the bank account will not be opened for at least another two weeks. The Form F is expiring in three days. What are my recourses as a seller to: a) force the buyer to expedite their travel plans to open the bank account, and b) claim their security deposit held by the agent if they do not expedite their travel? Additionally, if I file a claim for their security deposit, will I be blocked from selling my property to someone else until the claim is resolved?

Can a new developer cancel my old SPA and take my unit if I refuse to sign the new SPA?
Q: Dear Lawyers, I have a question regarding a new developer taking over a property from an old developer who fled Dubai many years ago. The new developer is trying to get investors to sign a new SPA, which includes additional fees. I have not signed the new SPA yet. The new developer claims: "The Judicial Committee for Incomplete & Cancelled Real Estate Projects in the Emirate of Dubai approved the continuation of the project as planned and instructed the new developer to issue amended SPA contracts to all investors, taking into consideration that non-compliant investor contracts shall be canceled in accordance with the procedures and regulations applied." Accordingly, as per the verdicts, they request all investors to comply with the decisions and verdicts issued within a 15-day notice. I have paid 80% of the total fees, and the project is about 60% complete. Does the new developer have the right to cancel the old SPA and take my unit if I don`t sign the new SPA? Negotiate asset split and spousal support: direct talks, mediator, or lawyer negotiations?
Q: Hello, I am currently getting divorced from my wife in Abu Dhabi. We are Americans, got married in the US 6 years ago, and are both non-Muslims. We are officially divorced and we wrapped up custody proceedings for our 19-month-old daughter last week and it was decided for 50/50, joint custody. I believe the next stage is for asset split and spousal support. Is that best handled with one-on-one talks with my ex-wife, or the use of a moderator, or have lawyer-to-lawyer negotiations? Also, can spousal support be paid from the former wife to the former husband? In the US this is very possible. I am very concerned about this as my ex-wife makes considerably more than I do (we moved to Abu Dhabi so she could take a lucrative position). Thank you!+1

Is an MOU still binding after delays due to rain if it contains a force majeure clause?
Q: Dear Sir/Madam, I signed an MOU on March 22, expecting building completion in April. The MOU had an expiry date of April 22; however, due to rain on April 15, the completion was delayed until May 30, 2024. I received the BCC on June 17 from the developer and paid for the pre-title deed on the seller`s behalf to expedite the process. Now, I have completed the pre-approval and valuation, but the bank is asking for the handover notice to release the final cheque, which the seller is refusing to share. The seller claims the MOU has expired, but it includes a force majeure clause. So, is this MOU still binding or not?+4
