Terminating an employee after sick leave and claiming compensation
Q: Hello, My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go. I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me. I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment. The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training. Does my employer have the right to charge me such a fee and not pay my salary?

What can I do if my employer terminated me without a prior notice?
Q: Without any prior notification or warning letter, the company suddenly says today don`t come. We will terminate your employment. From today 30 days will be your notice period that will be paid. Your MOHRE contract date is 5 days after your termination. So no gratuity will be entitled. What do actual labor laws say? 1. Gratuity - they take MOHRE date. But the joining date is only to be calculated, am I correct? 2. Without written warning or notification, they cannot terminate me on the same day. The reason is due to no sales generated. 3. Because it is termination, I like to request to hold my visa until I find another job for 2 or 3 months. Is it possible? What does the law say? How to contact the court to file a divorce after finishing the conciliation sessions?
Q: Salam Aleykum, Please, I request your help. I have a case in Dubai Court about a divorce request. I had all the Conciliation Sessions and I finished that on Feb 14. The Conciliator asked me to request an appointment with the judge to explain to him my case. But supposedly the Court should send me an email with the document needed to request the appointment and I am still waiting for it until now. So, where can I complain about it or ask where is the document? I wrote many times in different emails in the Court but no one answered me. Q: Hi, My landlord sent me a legal notice informing me of his intention to sell the apartment. As a result, he will not be renewing the tenancy contract which ends on 31-07-2024. The legal notice is dated 21-02-2024. I am aware that as per RERA there needs to be a 12-month notice in such cases. Q: Hello, I have been working in the UAE as an expatriate for the past 7 months in a company but they are delaying my salary for multiple months. I have pending salaries of 4-5 months, and no proper response while asking. They didn`t provide medical insurance also to the employees as per the UAE labor law. All the employees have had these salary delay issues for the past 3-4 years. They are not fulfilling the salary increments or whatever benefits they accepted during the interview.
