How to claim an amount transferred by mistake to a company which is not responding or returning it back?
Q: An "A" individual / Company by mistake transfers/deposits some funds to another "B" company. "B" company, despite certain follow-up efforts with "A" Company to recall or claim back the wrong payment, remained unresponsive, and “A" company could not track the depositor information. In such cases, what is the time frame within which "A" Company is liable to retain in suspense? Can "A" company deny the claims of "B" company in the future, as it was written off by "A" company after a few months of tracking.

Can a Muslim revert woman in the UAE obtain a Sharia divorce and remarry?
Q: Dear Legal Advisor, Assalamu alaikum wa rahmatullahi wa barakatuh, I recently reverted to Islam, and my marriage was solemnized in a civil court in the Philippines. There is no divorce law in the Philippines, and even if there were, it would take a significant amount of time and money. Could you please advise if I can file for divorce in the UAE through the Family Court or Sharia Court? What are the chances that my divorce will be granted? If the divorce is approved, am I permitted to remarry in the Sharia Court? Thank you for your kind attention to this matter!

Facing mental and financial harassment from my husband. What can I do?
Q: Hello, My husband is mentally harassing me for my salary. He wants my full salary and savings. He knows I am an epilepsy patient, so proper sleep is very important for me. Still, he fights with me all night. He just wants my salary. Last year, I left him and went back to India, but after a few months, he came to me and assured me he wouldn`t misbehave with me. But now he has again started fighting with me all the time for my salary. According to him, my salary is his asset because after marriage, I came to Dubai. Please help me and suggest.

Am I liable for the previous owner’s unpaid service charges when buying a Dubai property?
Q: Hello, I am purchasing an apartment in Dubai from a seller who originally bought this flat at an auction. There were outstanding service charges from the building management company prior to the auction. That pending amount was never updated on the Mollak system as a write-off, and until now, it appears as outstanding on the statement of account. When I buy this apartment, an NOC is being issued stating that there are no dues from the owner, and based on that, I intend to finalize the deal. I would like to know if, in the future, I may be asked to clear these pending service charges by the owners` association. The building management company is trying to clear the outstanding amount with Mollak, but it seems it’s taking a lot of time. What should I do?

How can I claim my settlement if the company is inactive but some branches still operate?
Q: Hello, I got a judgment from Dubai Court stating that the employer should do my settlement. It’s been years, but I still haven`t received the payment in my account. When I checked with Al Adheed Center, they said if the company is not active, it’s not possible to get the money. However, it’s a group of companies, and a few branches are still running. Is there any chance to claim it, or can I appeal directly to the court?

Can I file a case against a friend for privacy breach if he claimed I scolded him for his act?
Q: On Jan 2, 2025, one of my close friends did a privacy breach and recorded me and my van in some specific place. On Feb 5, when I called and asked him why he did this to me, he went and gave a complaint that I scolded him and threatened him. The same case was later closed by the PP when we negotiated outside the station and apologized. At this juncture, can I file a privacy breach case against him, which happened on Jan 2, 2025, and on Feb 5 I scolded him only for the privacy breach that happened on Jan 2?

Q: Hello, I`m in Canada, and I filed for divorce. My husband, who owns a real estate company in Abu Dhabi, kidnapped our children and took them to the UAE to avoid the divorce and force me back to him. My children are twin boys, 8 years old, and a 10-year-old girl. What can I do? I want to follow them and take my children back, but he says his local Emirati connections will file criminal cases against me and have me jailed if I go there. What can I do remotely? Does the UAE return kidnapped children to their mother? In the UAE, a guardian cannot legally kidnap their own child; what does this mean for my case? If I report him, what happens to my children? Will they be held until I arrive to take them?

Can I temporarily lift a travel ban after being falsely accused in a fight?
Q: Hello, I am a chartered accountant and a regulated officer in DIFC. Recently, I was forced into a fight (the other party started it), and things escalated. The other party called the police and filed a case against me for fighting and using bad language. The police detained me for a night and released me the next day, informing me that my friend, who was present at the time, and I have a travel ban. The other party is well aware of my position and frequent travel, seemingly trying to blackmail me into lifting the case. Due to my job, I usually travel every 10–15 days, but I have been stuck here for over a month. Can we file for divorce in Dubai Courts if we have marriage certificate from the consulate?
Q: A question related to divorce between a Pakistani and an Indian national. I`m a Pakistani national (Male, Christian) married to an Indian national (Hindu). The only legal document we have is from the Indian Consulate in Dubai which is a marriage certificate issued by them in 2022. We have not registered our marriage with local authorities in Dubai or the UAE. Through mutual decision, we`ve decided to part ways. Given the above information, we need assistance in navigating the above. The Indian embassy insists on going to Dubai courts, which to me doesn`t make sense since we haven`t registered our marriage with local authorities here. Any help and advice would be helpful!

What to do if you get terminated and denied gratuity for a minor mistake?
Q: My brother has been working for a company for 11 years. In the last 3 weeks, he had an incident/accident and scratched a plane since he only had 1 person to assist him as the company was not hiring enough people. Senior staff like him are working more to train inexperienced new hires which adds to their workload working almost 12 hours/day including travel to DWC. The pilot said it was aesthetic and could be painted over but a police investigation ensued. Last week 3 managers and HR talked him down as the investigation concluded. He was terminated immediately with only this month`s pay and his 11-year gratuity will not be given by the company. It was not gross negligence or malicious intent, he just didn’t have enough people to help him. He owned up to the mistake and reported the incident within 24 hours. Can he fight for the gratuity?
