How can I remove my business partner from the company if he left the country and is not responsive?
Q: I am writing to formally seek your guidance and assistance regarding my Technical Trade License and associated joint bank account. I hold a Technical Trade License together with my business partner, Mr. K. M., who has been out of the country for the past 2–3 months. During this period, he has been unreachable and has not responded to any calls or communication. Additionally, my partner has taken an amount of AED 30,000 from me, which has not yet been repaid. We also maintain a joint bank account under the company, which I wish to close. However, the bank requires both partners’ signatures for cancellation. As my partner is absent and not cooperating, I am unable to proceed. In view of the above, I kindly request your advice and support on the following: - The process to remove my partner’s name from the Trade License. - Guidance on how to proceed with closing or freezing the joint bank account in the absence of my partner’s signature. I can file a case in India.

Q: An "A" individual / Company by mistake transfers/deposits some funds to another "B" company. "B" company, despite certain follow-up efforts with "A" Company to recall or claim back the wrong payment, remained unresponsive, and “A" company could not track the depositor information. In such cases, what is the time frame within which "A" Company is liable to retain in suspense? Can "A" company deny the claims of "B" company in the future, as it was written off by "A" company after a few months of tracking.

Q: Dear Legal Advisor, Assalamu alaikum wa rahmatullahi wa barakatuh, I recently reverted to Islam, and my marriage was solemnized in a civil court in the Philippines. There is no divorce law in the Philippines, and even if there were, it would take a significant amount of time and money. Could you please advise if I can file for divorce in the UAE through the Family Court or Sharia Court? What are the chances that my divorce will be granted? Am I liable for the previous owner’s unpaid service charges when buying a Dubai property?
Q: Hello, I am purchasing an apartment in Dubai from a seller who originally bought this flat at an auction. There were outstanding service charges from the building management company prior to the auction. That pending amount was never updated on the Mollak system as a write-off, and until now, it appears as outstanding on the statement of account. When I buy this apartment, an NOC is being issued stating that there are no dues from the owner, and based on that, I intend to finalize the deal. I would like to know if, in the future, I may be asked to clear these pending service charges by the owners` association. The building management company is trying to clear the outstanding amount with Mollak, but it seems it’s taking a lot of time. What should I do?

How can I claim my settlement if the company is inactive but some branches still operate?
Q: Hello, I got a judgment from Dubai Court stating that the employer should do my settlement. It’s been years, but I still haven`t received the payment in my account. When I checked with Al Adheed Center, they said if the company is not active, it’s not possible to get the money. However, it’s a group of companies, and a few branches are still running. Is there any chance to claim it, or can I appeal directly to the court?

Can I file a case against a friend for privacy breach if he claimed I scolded him for his act?
Q: On Jan 2, 2025, one of my close friends did a privacy breach and recorded me and my van in some specific place. On Feb 5, when I called and asked him why he did this to me, he went and gave a complaint that I scolded him and threatened him. The same case was later closed by the PP when we negotiated outside the station and apologized. At this juncture, can I file a privacy breach case against him, which happened on Jan 2, 2025, and on Feb 5 I scolded him only for the privacy breach that happened on Jan 2?

Q: Hello, I`m in Canada, and I filed for divorce. My husband, who owns a real estate company in Abu Dhabi, kidnapped our children and took them to the UAE to avoid the divorce and force me back to him. My children are twin boys, 8 years old, and a 10-year-old girl. What can I do? I want to follow them and take my children back, but he says his local Emirati connections will file criminal cases against me and have me jailed if I go there. What can I do remotely? Does the UAE return kidnapped children to their mother? In the UAE, a guardian cannot legally kidnap their own child; what does this mean for my case? If I report him, what happens to my children? Q: Hello, I am a chartered accountant and a regulated officer in DIFC. Recently, I was forced into a fight (the other party started it), and things escalated. The other party called the police and filed a case against me for fighting and using bad language. The police detained me for a night and released me the next day, informing me that my friend, who was present at the time, and I have a travel ban. The other party is well aware of my position and frequent travel, seemingly trying to blackmail me into lifting the case.
