Facing mental and financial harassment from my husband. What can I do?

Hello,

My husband is mentally harassing me for my salary. He wants my full salary and savings. He knows I am an epilepsy patient, so proper sleep is very important for me.

Still, he fights with me all night. He just wants my salary. Last year, I left him and went back to India, but after a few months, he came to me and assured me he wouldn't misbehave with me.

But now he has again started fighting with me all the time for my salary. According to him, my salary is his asset because after marriage, I came to Dubai.

Please help me and suggest.

Hello,

File a complaint for verbal or psychological abuse. Seek protection orders. Ask for a divorce based on harm or harm to health (physical or mental).

If you feel unsafe at home, you can apply for a temporary protection order from the police or the Dubai Foundation for Women and Children (DFWAC).

What is the process for this? How much is the cost?

Hi,

I'm so sorry you’re going through this. Please remember, your salary is your own and no one can force you to hand it over, even your husband.

What he is doing is not right, and in Dubai, there are laws to protect you from this kind of mental and financial abuse.

Please keep records of his behavior, and if you ever feel unsafe, you can contact the police or organizations like the Dubai Foundation for Women and Children for help.

You can also reach out to the Indian Consulate for support. Your health and safety are most important.

Don’t hesitate to seek help. If you need more information or support, let me know. You are not alone.

Hello,

Thank you for reaching out and sharing your situation!

I'm truly sorry you're experiencing this. Under UAE law, your salary and personal savings remain your sole property, and your husband has no legal right to demand or control them.

His actions, coercing you financially, disturbing your sleep despite your medical condition, and repeatedly pressuring you for money, constitute psychological and economic abuse, which is now recognized as a form of domestic violence under Federal Law No. 13 of 2024.

You are fully entitled to report this behavior to the police and request a protection order. In addition, support organizations such as the Dubai Foundation for Women & Children can assist with legal, psychological, and shelter services.

If you are considering separation or divorce, you also have the right to file under the updated Personal Status Law, which allows for no-fault divorce and claims for financial maintenance.

I would be happy to schedule a confidential consultation to guide you through your legal options and next steps.

Warm regards,

Hello, dear questioner,

It is best to file a divorce case based on harm, with proof of harm, so that he does not harass you again.

If you have children, you are entitled to child support, education expenses, and housing expenses, which he must bear.

We can help you with this matter.

For further discussion, please share your WhatsApp number.

I'm sorry to hear about your situation!

It's important to address issues of mental harassment and financial control, as they can have serious implications for your well-being. Here are some steps you can consider taking:

1. Contact Authorities: If you feel threatened or unsafe, you should contact the local authorities. The UAE has laws against domestic violence, and mental harassment can be considered a form of abuse.

2. Reach Out to Support Services: There are organizations and support services in the UAE that can provide assistance to individuals facing domestic issues. Consider reaching out to them for support and guidance.

4. Document Everything: Keep a record of any incidents of harassment or abuse, including dates, times, and details of what happened. This documentation can be useful if you decide to take legal action.

5. Consider Counseling: If you are open to it, counseling or therapy can provide support and help you cope with the emotional impact of your situation.

6. Plan for Your Safety: If you decide to leave the situation, make sure you have a safety plan in place. This might include having a safe place to go, access to your important documents, and a way to support yourself financially.

7. Financial Independence: It’s important to maintain control over your own finances. Ensure that your bank accounts and financial assets are secure and that you have access to them.

Dear Questioner,

Thank you for reaching out and sharing your situation!

I'm truly sorry to hear about the emotional distress you are facing.

Please note the following under UAE law:

- Mental and Emotional Abuse:

What you are experiencing may fall under domestic abuse, which is recognized under UAE law. Emotional and psychological harassment, especially when it affects your health and well-being, can be grounds for legal protection.

- Your Salary and Savings:

Under UAE law, your salary is your personal property, regardless of marital status. Your husband has no legal right to demand or control your earnings unless you voluntarily share them or have a joint agreement.

- Legal Options Available to You:

You can file a police complaint for domestic harassment or emotional abuse. You may also consider seeking a protection order under the UAE's family protection framework.

If the situation persists or worsens, you can explore divorce or separation under UAE family law, based on harm or abuse.

Given your medical condition (epilepsy), protecting your health and peace of mind is essential. We can assist you with the appropriate legal steps and represent you in filing the necessary complaints or initiating family court proceedings.

Please feel free to contact our office if you would like to schedule a confidential consultation.

You are not alone. We are here to support you.

Best regards,

Mohammed Salah

Thank you for contacting us via Legal Advice Middle East.

What you’re experiencing amounts to psychological and financial abuse, and the law in the UAE allows you to act firmly to protect yourself and your child.

We recently assisted a client in a nearly identical situation, where the husband exploited her health condition and pressured her for financial control. We helped her secure legal protection and initiate the necessary steps to regain her freedom and dignity.

You are under no legal obligation to surrender your salary or savings to your husband, regardless of marital status or residency. His demand, threats, and night-long fights not only violate your personal rights but also endanger your health, especially considering your epilepsy.

You have the legal right to:

1. File a protection order under the Family Protection Law to stop harassment and prevent further abuse.

2. File for divorce or separation with child custody, if the abuse continues or escalates.

3. Initiate a financial independence claim to protect your income, assets, and future rights.

Given your medical condition and the repeated cycle of harm, we strongly advise starting with a legal notice or protection request immediately. We can assist you discreetly in preparing the file, representing you in court, and ensuring your child’s well-being is fully safeguarded.

There is no law in the UAE that compels a wife to hand over her salary to her husband.

The salary is considered your own money according to the UAE Personal Status Law.

Psychological abuse is grounds for divorce due to harm:

According to the Personal Status Law, a wife has the right to seek divorce due to harm if it is proven that she has been subjected to physical or psychological abuse.

You are not obligated to give your salary to your husband. UAE laws do not grant a husband automatic rights over his wife’s income.

Harassment, emotional abuse, and threatening behavior can be grounds for a protection order or even a criminal complaint under UAE law.

If the abuse continues, you can file a police report and/or approach the Personal Status Court to seek:

- Separation or divorce, if needed.

- Protection from abuse.

Your health condition makes this more serious; sleep deprivation and mental harassment can be documented and used as evidence.

We can support you with filing a complaint or guiding you through the legal process safely and discreetly.

Please share your WhatsApp number so we can contact you privately and assist you step-by-step.

I understand how emotionally exhausting and stressful this must be, especially when you're managing a medical condition like epilepsy and facing constant pressure at home.

Please know that your salary and savings are legally yours, regardless of your marital status. No one, not even your husband, has the right to demand or control your income against your will.

What you're describing could amount to emotional and financial abuse, and there are legal ways in the UAE to protect yourself, your health, and your finances.

You have options, including filing a police complaint for harassment, seeking protection through the Family Guidance Section of the court, and even exploring separation or divorce under UAE laws if this continues. The law is on your side, and you do not have to live in fear or under pressure.

Let’s speak privately so I can guide you through the steps based on your circumstances and help you protect your rights.

Please contact me directly on WhatsApp or call me at [-----------] to discuss further. You're not alone, and we can take the right legal steps together.
