I bought a property and the seller sent an eviction notice to the tenant. How to ensure eviction?
Q: Hi I bought a residential property on 31-Oct-2023. It has already been on lease to tenants by the seller. The seller has already served a 1-year legal eviction notice from Dubai Courts on 25 August 2023. The tenancy contract expiry will be the 30th of June 2024, and the new owner/buyer wants to stay in the said apartment after the expiry of the contract and ensure that the property is vacated on time and does not get extended beyond 24 August 2024. (Q1) Kindly confirm if it is required by law that a new 1-year legal notice has to be issued by the buyer or if the old legal notice issued by the seller is still valid. (Q2) The tenant company has kept 6 bachelor boys from their company in the flat, which I heard was illegal for the JLT area to have bachelors and even more than 4 boys. Please confirm if anything can be done about that. (Q3) Due to 6 bachelor boys, the 5-year-old flat is not being well maintained and the condition worsening. Kindly advise on the action to take. The legal notice to the tenant via notary public was not handed. Did I have to send it by email?
Q: Respected Lawyers, I am a landlord and my tenant did not pay the rent. I issued a 30-day legal notice through the notary public. The Dubai Courts authorized service provider Aramex pasted the notice on the unit door as nobody opened the door to accept the notice. At the same time, I did not send the notice to the tenant through email. My question is will the RDC judge accept this as the notice has been served based on Aramex`s acknowledgement? Q: Dear Sir/Madam, My landlord had originally said that I could stay in the villa during the minor renovation (inside) and construction of a new building outside. He put it in writing and agreed that the tenancy value of the property would not increase significantly for two years based on these improvements. I then received an eviction notice due to renovation. I have lived in the same villa for 18 years. Landlord lied to evict tenants for higher rent: Is legal action worth it?
Q: Dear Questioner, Abusing tenant trust for fake eviction! We are based in Dubai and have had a good three-year relationship with our landlord, who is in Abu Dhabi. The building had a lot of maintenance issues, and I always kept him informed about the increasing problems. Six months before the contract expiry date, the landlord visited us and said: "I have decided to return to Dubai with my family. Thanks to our relationship since 2020 and the problems you`re facing in the building, I assume this is okay for you. I don`t want to send a legal notice. Can you please send me an email for eviction?" As we knew the family and trusted them, we accepted their request. However, after moving out, I saw that he was renting the house for a higher rent! Is it worth initiating a legal case, as he lied to us? By chance, in my email to him, I mentioned that "we are leaving as you told us that you`re moving into your house," and he responded positively. Q: Hello, Yesterday, I won a case against my landlord. The judge ordered a renewal of my tenancy contract for one (1) year, and the landlord must pay the expenses (3% of my annual rental). However, the judge is aware that I received an eviction notice from my landlord. As a result, I can only get an 8-month tenancy contract, not a one-year contract. Does the judge`s verdict of a 1-year contract renewal supersede the eviction notice, which only allows for 8 months?
