Given the expired lease and invalid eviction notice, can I stay and continue to pay rent?

Q: Dear Sir/Madam, My landlord gave me notice on plain paper last year when the lease was renewed. He wrote two reasons for eviction: one that he may sell the property and the other that he may move in. The eviction letter was signed by him only, but the property has two owners (husband and wife). This year, when he asked me to vacate the property, I informed him that, according to the RDC, the notice needs to be from a notary public or sent via registered mail. I then submitted an Offer and Deposit with the RDC, but the landlord didn`t respond. The lease expired on May 10th. The landlord hasn`t followed up with anything so far. According to RERA, the rental contract is automatically renewed unless terminated by the courts (for non-payment, eviction, etc.). What course of action should I take now? Should I send an email to the landlord with the cheques, mentioning they are ready since I already submitted the Offer and Deposit, or should I file a case? Or should I wait for the landlord to approach me or file a case?

What's next if a tenant won't pay or vacate despite winning the case in RDC court?

Q: Dear Sir/Madam, The tenant didn`t pay rent for over 7 months. I filed a case, and finally won; the RDC court verdict is to evict the tenant and for them to pay all rent and legal fees. I contacted the tenant, who refused to move out or pay. What`s the next step? Do I file for execution via RDC, or will it be automatic? How much does it cost, and how long does it take? The tenant is arrogant and said he will not pay until I proceed with execution from RDC, and then he will ask for a one-year payment plan! The whole procedure is very unfriendly to the landlord, with the tenant risking nothing while the landlord incurs lawyer fees, interest losses, and significant time and effort.

What's more important: the tenancy contract or UAE rental laws on tenancy renewal?

Q: Hello, I hope you can advise me, please! I`m a tenant in Dubai. The owner/agency didn`t send me the rent increase notice 90 days in advance. It was sent to me on Thu, 18 Apr, 22:16. My lease expires on June 24, 2024. So it`s 78 days instead of 90. But they claim that in the signed contract there is a statement: "In the event that the tenant wishes to renew the lease at the end of the tenancy, they should notify the landlord in writing 90 days prior to the expiry date of the rental contract." Since I didn`t do this, they demand to increase my rent by the maximum amount possible as per RERA. As far as I can understand, according to the law, if no one notifies anyone before 90 days, the default is to extend the lease. So there is no increase. What is more important according to law, the signed contract, or UAE laws in this case? Thank you very much, hope you can advise and help me!

What can I do if the landlord evicted me to sell the apartment and rented it for a higher price?

Q: I was given a legal notice to evict my apartment by the landlord because he wants to sell the apartment but no one has come to see the apartment once in 10 months. I found out that the landlord has multiple units in the same building and gave a similar notice to all. In some cases, he renewed the lease for another year after increasing the 35 to 40 percent rent and in some cases, he rented out after 3 months. My question is if a tenant got evicted and then offered first refusal to move back in then what is the point? The tenant has already moved to a new apartment and can`t accept the offer to move back. This will allow the landlord to rent out again at a higher price. Please advise

Unit registration delays, slow construction. Can I cancel SPA for a refund?

Q: Hi, I purchased a unit in July. I`ve requested Oqood several times to no avail. They responded that the registration will take time, and the delay is from DLD. I checked with DLD, and they informed me that no registration application had been made in my name. Additionally, when I purchased the unit, I was promised several things, including Golder Residency, and a flexible payment plan of (70/30), but that was all untrue. Furthermore, I realized that the developer provided their direct bank account rather than an Escrow account, which raised a red flag for me. The contract stated that the completion time is July 2024, but the construction progress is still under 20% as per the DLD website. I have the intention to cancel my SPA and request a refund. Will that be doable?

A tenant defaulted on rent. 30-day notice or eviction?

Q: Hi, My tenant has not paid the full installment of the last rent payment—AED 5000 left. He hasn`t paid the last two months of the Empower bill, and it`s now disconnected. I have a cheque bounce report from the bank due to insufficient funds. Additionally, I caught him overcrowding the unit without my permission. Although he promised to leave on Nov 30 (the last day of the Ejari contract), the Ejari has expired, and he is still in the apartment. Is this against the law? What if, for any reason, the landlord changes his/her mind to sell the apartment after evacuation? What do the regulations say?
