What can I do if the landlord evicted me to sell the apartment and rented it for a higher price?
Q: I was given a legal notice to evict my apartment by the landlord because he wants to sell the apartment but no one has come to see the apartment once in 10 months. I found out that the landlord has multiple units in the same building and gave a similar notice to all. In some cases, he renewed the lease for another year after increasing the 35 to 40 percent rent and in some cases, he rented out after 3 months. My question is if a tenant got evicted and then offered first refusal to move back in then what is the point? The tenant has already moved to a new apartment and can`t accept the offer to move back. Unit registration delays, slow construction. Can I cancel SPA for a refund?
Q: Hi, I purchased a unit in July. I`ve requested Oqood several times to no avail. They responded that the registration will take time, and the delay is from DLD. I checked with DLD, and they informed me that no registration application had been made in my name. Additionally, when I purchased the unit, I was promised several things, including Golder Residency, and a flexible payment plan of (70/30), but that was all untrue. Furthermore, I realized that the developer provided their direct bank account rather than an Escrow account, which raised a red flag for me. The contract stated that the completion time is July 2024, but the construction progress is still under 20% as per the DLD website. I have the intention to cancel my SPA and request a refund. Q: Hi, My tenant has not paid the full installment of the last rent payment—AED 5000 left. He hasn`t paid the last two months of the Empower bill, and it`s now disconnected. I bought a property and the seller sent an eviction notice to the tenant. How to ensure eviction?
Q: Hi I bought a residential property on 31-Oct-2023. It has already been on lease to tenants by the seller. The seller has already served a 1-year legal eviction notice from Dubai Courts on 25 August 2023. The tenancy contract expiry will be the 30th of June 2024, and the new owner/buyer wants to stay in the said apartment after the expiry of the contract and ensure that the property is vacated on time and does not get extended beyond 24 August 2024. (Q1) Kindly confirm if it is required by law that a new 1-year legal notice has to be issued by the buyer or if the old legal notice issued by the seller is still valid. (Q2) The tenant company has kept 6 bachelor boys from their company in the flat, which I heard was illegal for the JLT area to have bachelors and even more than 4 boys. Please confirm if anything can be done about that. (Q3) Due to 6 bachelor boys, the 5-year-old flat is not being well maintained and the condition worsening. Kindly advise on the action to take. The legal notice to the tenant via notary public was not handed. Did I have to send it by email?
Q: Respected Lawyers, I am a landlord and my tenant did not pay the rent. I issued a 30-day legal notice through the notary public. The Dubai Courts authorized service provider Aramex pasted the notice on the unit door as nobody opened the door to accept the notice. At the same time, I did not send the notice to the tenant through email. My question is will the RDC judge accept this as the notice has been served based on Aramex`s acknowledgement?
