A drug case was transferred from Sharjah to Dubai Public Prosecution. What is next?
Hi,
A criminal case (drugs) is being transferred from Sharjah to Dubai Public Prosecution, and the accused has been shifted to a Dubai police station.
However, no case details are registered in Dubai Public Prosecution. What should be the next procedure?
How can we get the new case number? Can we apply for bail in this case by visiting the police station?
Dear Questioner,
If a criminal case is transferred from one emirate to another, the new Public Prosecution will assign a new case number.
The accused can apply for bail at the new police station where they are currently being held.
The accused or their lawyer can also visit the Dubai Public Prosecution to inquire about the new case number and the status of the case.
It is important to note that the transfer of a case does not automatically mean that the accused will be released on bail.
The decision to grant bail will depend on the circumstances of the case and the discretion of the Public Prosecution.
It is recommended to seek legal advice from a lawyer in this situation.

Dear Questioner,
It usually takes time for cases received from other cities to be numbered according to the serial number of cases in the city that received the file.
in the meantime, a bail application cannot be submitted as you have to wait until the Public Prosecution receives the file and gives it a number.
Dear Questioner,
Thanks for your inquiry!
Regarding the above, we would like to inform you that, according to UAE law, if a criminal case is transferred from one emirate to another, the case number and details will also be transferred to the new emirate's public prosecution.
In this case, the accused should contact the Dubai Public Prosecution to obtain the new case number and details.
As for applying for bail, the accused can visit the Dubai Police Station where they are currently being held and request for bail.
The police will then forward the request to the public prosecution for their decision. It is important to note that the decision to grant bail is at the discretion of the public prosecution and is based on the severity of the charges and the accused's criminal record.
If the accused is granted bail, they will be required to provide a guarantor who will be responsible for ensuring that the accused attends all court hearings.
The guarantor must be a UAE national or a resident with a valid residence visa and must provide a valid ID and proof of residence.
If the accused is not granted bail, they will remain in custody until their trial. It is important to seek legal advice.

Greetings,

Hello,
Since the case has been transferred to Dubai, it indicates that the incident occurred within the jurisdiction of Dubai.
If the case has been referred from the police station to the public prosecution, it means that the preliminary investigation phase is over, and the case is now under the public prosecutor’s review.
You can find the new case number by entering the police complaint number on the Dubai Public Prosecution's website. This will show you the related cases and the latest updates on the case.
At this stage, the public prosecutor will review the collected evidence, including any drug tests and forensic reports.
Typically, a urine sample from the accused and any seized drugs are sent to the forensic lab for analysis.
Based on the forensic report, the prosecutor will decide whether to dismiss the case if the accused is found innocent or to refer it to court if the evidence suggests otherwise.
For cases involving large quantities of drugs, indicating potential trafficking, the case may be referred to the Abu Dhabi Capital Prosecution.
The accused can submit a bail application to the public prosecution (online).
However, it is important to note that bail is usually denied in drug-related cases due to the severity of the offense. Nonetheless, it is still worth trying if there are strong justifications for the bail request.

Dear Questioner,
You may obtain the case number from the relevant police station (to which the accused was transferred) or by inquiring from the Public Prosecution.
After investigation, the accused may request release with the security that the court deems appropriate.
