Q: I`m residing in Kingdom of Saudi Arabia and a citizen of India. I ordered a new Samsung Galaxy Edge Plus mobile on 05-04-2017 from www.dubaiphonestoes.com which is located in Office No-03, Ayal Nasir 116-447 Deira, Dubai, UAE. I received the product through DHL and Fetchr on 09-04-2017 and I paid SR1250. On 14-04-2017 when I unpacked the phone I was shocked because the phone was not the normal one what I ordered and it was a customized model mobile for AT&T. I can’t use my Saudi SIM-cards in the mobile. Also, the box for phone says the mobile color is Safire black and the product inside is gold. How it comes? They also specify the country of origin is Dubai and the product is from the USA. And when I made the order in the special request I mentioned I need a 64 GB Phone and they sent me a 32 GB phone. The website www.dubaiphonestores.com is registered in an Indian address and they are operating from Dubai. How can I legally fight with them with UAE laws?

س: قام زوجي بإعطاء شيك ضمان لشخص في دبي، ثم دفع المال نقدًا لهذا الشخص، ورفض الشخص إعطاءه الشيك بسبب أن الشيك لم يكن بحوزته. غادر زوجي دبي لاحقًا، وقام الشخص برفع قضية ضده. الآن المبلغ كبير، ولا نستطيع دفعه بسبب الخسارة. يريد زوجي أن يعود مرة أخرى ليستمر في أعماله في دبي بعد مرور سنتين، ولا يريد أن يتم إلقاء القبض عليه، بسبب أن هذا من شأنه إعطاء صورة سيئة. هل هناك أي حل نستطيع من خلاله دفع 20 % ومن ثم يستطيع القدوم إلى دبي بدون إلقاء القبض عليه أو أي حل أفضل من هذا دون أن يلقى القبض عليه؟ كل ما في الأمر أنه لا يريد أن يتم إلقاء القبض عليه. تقول الشرطة أن هناك حلين فقط: إما سداد كامل المبلغ، أو أن يسحب الشخص قضيته، بخلاف ذلك، فسيتم القبض عليه وسيخرج بكفالة.

Q: I have had a rented apartment in Dubai for more than 5 years. I CHOSE NOT to have a contract with Empower for A/C. Instead, I bought a portable a/c. The Landlord AND Empower are now saying that I have been living illegally and that I MUST pay AED 11,000 and then REGISTER with Empower and pay the monthly charges even though I do not have or want Empower services. Can employee be charged for visa expenses?

Q: Hi, I have been working in a company in Abu Dhabi for the past two and a half years. I gave my resignation less than a month ago. When I got this month salary, the salary amount was reduced. When I enquired about it, the company informed me that they will be charging me a certain amount from my settlement as visa cancellation process fee. When I called to the Ministry of labour, they told me that company cannot charge me any of such fee. So I would like to know whether I should move by complaining to the MOL, and if I do, what would be the probable result from that action. Thank you.

Fine for a cheque returned as unpaid

Q: Hi, I have a problem. The house owner in UAE, Dubai asked me today to pay a fine for returned cheque 5,000 AED in case the cheque bounced and it is written in the contract. Today they called me asking for the fine anyway they say they gave the cheque to another bank to collect the money and the other bank rejected it. I called my bank and they said no one gave them any cheque. So the owner wants the fine and the rent. What should I do?

Employment visa cancellation

Q: I was working at Dubai airport. I was given 2-year visa to work in the company, my visa will expire on 3rd of August 2017. Along the line, I applied in another company, was given appointment letter and was asked to submit my cancellation letter which I did after collecting it from my former company. When they went to an immigration center, they said in their system it was recorded that I have left Dubai since a year plus while I am still in the country. So they asked me to exit on the 7th of April while my visa will expire on the 3rd of August 2017... since have submitted my cancellation letter my visa is not out yet... someone told me that within 2 weeks visa processing will be done, so I don`t know why it is taking too long to be ready. Q: I was terminated from my company on the accusation of theft. My company said that they have a CCTV footage which they did not present during the committee meeting. There was no money or goods retrieved from me by my company security. They only have my admission. Since they were telling me that they will send it to the police if I won`t admit that happened on 19 March, the committee meeting which was supposed to investigate was held 2 days after. My company kept me suspended until the 5th of April and handed me the termination letter, which states that I am terminated from the 19th of March. What are my chances on this? I am so confused right now and I really need help.
