Eviction notice to the tenant
Q: Hi, I have a flat in Dubai freehold and it`s tenanted till Jan 2017. Just want to know the law incase I want to sell it and the buyer wants it vacant, what will be the notice to the tenant?And if I want to renew the tenancy contract what will be the maximum notice period shall I put for the tenant to give me before they leave?

How to check if a person is blacklisted in the UAE
Q: Hi, I live in Australia and was wondering how I can find out if my cousin who is originally from Lebanon, has been blacklisted in the UAE for absconding from his employment? Also, I was wondering if his power of attorney who is not in the UAE can find out if there are any court cases against my cousin without having to travel to the UAE?

Real estate matter in the UAE
Q: We are from the UK and our broker found a buyer for a property. The MOU was agreed and had an expected transfer date and expiry date. The MOU stated that the buyer will prepare for NOC and the take transfer of the property during the period we are in Dubai.We arrived in Dubai during the agreed dates. The buyer did not prepare the NOC in advance but only after we arrived leaving insufficient time for the NOC to be completed. The buyer did give us a small cash advance on the sale which we still hold. On the day of the transfer, the buyer claimed they had an emergency and were not available to complete the process. We had to return to the UK.However, the buyer and broker are now expecting us to return to Dubai to complete the process. However, due to health restrictions we can not do this easily.Are we as sellers obliged to return and complete the transfer? Has the MOU effectively expired? Are we entitled to the buyer`s deposit? Can the MOU be terminated?Thank You.2016/11/22

Car sharing in the UAE
Q: Carsharing in the UAE + insurance.Our company is setting up a car sharing platform to be launched in Dubai. The concept will make the owners money and enable the hirers to get cheap rental rates.We have learned that it is illegal for private individuals to make money on their car unless they register it as a taxi or similar in RTA. We cannot find the actual law anywhere, and we are wondering why it is illegal?Is there a way to circumvent this issue? For instance by having the owners register their car on our site in a way that would accommodate the RTA requirement? The fines are big for individuals and we don`t want any of the customers being fined.In regards to the company, we are also looking for a way to not get fined for facilitating this service. How would we make sure of this? And what would be the insurance requirements in this case?Many thanks in advance!2016/11/18

س: لم تدفع الشركة التي يعمل بها زوجي الراتب منذ ثلاثة أشهر لجميع الموظفين فيها. توفى مؤسس الشركة في الأسبوعين الماضيين، ولكن لا يعلم الورثة الشرعيين بهذا. لذا، فليس لدينا أي أموال في الحقيقة، الفواتير والديون في تزايد، جميع الزملاء في نفس المأزق. برجاء المساعدة بشأن ما الذي يمكن فعله لحل هذا الأمر.

Q: Hello,I am a Syrian citizen living in Dubai for more than 13 years with valid resident visa and I would like to open a new LLC company in Dubai along with a local UAE sponsor (49% my share, 51% for the local sponsor). The company will offer and sell IT services/products (commercial license).I have the following questions:1 - Is it true that Syrians are mostly denied by DED due to security restrictions? Do you know any of your Syrian clients who received a license from DED recently? Are there any measures that I could take to improve my chances?2 - In case I had to issue a license under the UAE sponsor so he becomes 100% owner of my company (do I have another choice?) what are the legal steps that I should take to protect my rights? Q: I and my wife are going through the divorce. We are both expats. I work and she does not work. I am her sponsor. We have a one-year-old daughter. Who gets the custody of the baby after divorce? Once we get divorced, who will be her sponsor in the UAE? Does she have to leave the UAE? If she gets the custody, how can she stay in the UAE without a sponsor? Q: Good day! Need legal advice. Dubai-based LLC company with a local sponsor, in accordance with side agreement local partner receives an annual fee. But the company license was frozen for a long period of time and local partner was informed about it. Employment dispute assistance
Q: I started working with a developer`s hotels & resorts on Aug 17, 2015, as Director of Digital. They hired another Digital Director in early April. I was terminated July 28th. I have refused to sign the letter as I was going to Ireland that afternoon. I contacted them 2 days after and I advised that I would sign the letter based on the following: * Full payment of 30 days notice & holidays owed. * Full payment of yearly bonus, which, unfortunately, I had to learn after the payment of bonus to other staff members management did not approve. No reason was given for this. * Payment of value of flight home per year of completion of 1 year. * Payment for flight changes in December 2015 as per management request - AED 4K. * Gratuity payment as per UAE employment law.No response has been forthcoming. Am I better to go legal and just deal with them directly through a legal team? Should I go to Ministry of Labour? Any advice on a good employment law specialist would be most grateful.2016/09/06
