How can I claim the money I paid for an off-plan property due to overdelay in delivery?
Q: Greetings to all on this helpful forum and many thanks for previous replies. We have a pertinent question about an execution judgment against a developer in Ajman. The flat was bought in 2006 on plan. By the delivery date Dec. 2008, there were hardly 3 concrete floors. We had paid by that time AED 155,000. We stopped paying the PDC cheques and opened a civil case. We won a judgment for execution in 2018 for payment of the whole amount plus interest plus expenses. So far no payment and they seem to be open for business. Does anyone here on this forum know why that is and how long this can go? What would be the reason for this delay and are there any assurances that the amount will be paid? Would a court order for payment remain not executed indefinitely and why? An answer to my email address would suffice for confidentiality. Thank you

My wife works in a private school and wants to resign due to salary reduction. What to do?
Q: My wife works in a private school in Abu Dhabi. After the first 2-year contract, her contract is now being renewed every year. Her new one-year contract came with a revision of salary and position title and was given to her in the last week of the academic year. As per the contract, both employer and employee are obligated to provide a 3-month or 90-day notice period. In this case, a revision of the contract without giving the notice period is legal or not? If she resigns without accepting this offer, it leaves her without a job for a year as all schools are done with recruitment for the next academic year. How can we address this issue?2024/06/13

How can I claim my unpaid salaries if my visa is about to expire and the employer did not pay?
Q: My company has held almost 5 to 6 months of my salary. On 16 May, my contract expired and the company refused to pay me my salary. I asked them for an update as I didn`t travel to work due to lack of funds. There was no reply for 2 days and on the 3rd day, I decided to resign. They accepted my resignation after 2 days. The next day, I completed my handover process and since then I have been following up with them by visiting the company and by email. They have not provided me with the final settlement details yet with all this happening while I am in my grace period. I filed a complaint with the Ministry of Labor. The Ministry representative contacted the finance manager and they told him that the owner was out of the country. Once my grace period is over, who will pay the overstaying charges? I have not signed the cancellation and I have to stay back so that I can get all my pending salaries and EOS. Please help2024/06/13

Q: Dear Sir/Madam, I have invested money in a company in the UAE and got post-dated cheques. They requested to delay the payment for a long time. Now, I deposited one cheque and it bounced. I am creating a cheque execution case. However, I have a few more cheques to deposit that they owe me. They gave me around 5 cheques, of which 3 will cover the money they owe. Can I claim all the cheques? Will I face legal issues from them?

Is a rent increase notice sent by the previous property management still valid?
Q: Good afternoon, I have a Real Estate property management license in Dubai. I recently entered into a management agreement with a landlord of a fully occupied building. Now, I am dealing with a situation where I can`t send rent increase notices 90 days prior because my company was not managing the building 90 days ago. If the previous real estate company did send these formal notices, can we consider those valid for us as well? In the worst case, where we cannot reach an agreement with the tenant and open a lawsuit in RDC, can we present the notices that were not made by us but were still made in compliance with the laws? As per RERA and UAE laws, can these formal notices for rental increases be sent via email to the tenant`s registered email address? Or must it be a notarized rental increase notice from a notary public for the judge to approve the rental increase?
