Can a free zone company open its branch in another free zone?
Q: I`m a partner in a UAE free zone company with telecommunications trade license. Can I open my 100% ownership firm with the same telecommunications trade license in another free zone in the UAE? Kindly advise. If not, then what is the way out? Thank you

Destiny of the customer's cheques issued before the closure of a company
Q: I wrote out post-dated cheques to a removal company. This company has now been closed by the DED, and their license expired in July 2017. This has not been renewed and it has all been confirmed by the DED. I cannot get my cheques back from them as there is no one to contact. I am afraid however that they are still going to try and encash the cheques, which have been made out to the company and not an individual. What do I do please? Dubai Police referred me to Dubai Court but I have not been successful with either of them.2017/10/04

Wrongfully accused of harassment and losing EoS gratuity
Q: Hi, I need advice. I have been working for the last 30 years, and the last 10 years were with one company. I have received termination stating harassment while requesting for a face to face check with the people, facts were not disclosed. Now, they have informed me that they`ll detain my gratuity amount which I feel I deserve. Harassment case - it was a complaint raised by few colleagues stating improper touching, which was not the actual case. Hence, received a termination for the same. Never given a chance to speak. However, I have not been such a person and have not done such a thing in overall 30 years of service. Now, gratuity has been held considering the harassment clause.

Neutral party entrusted with the belongings of divorcing couple
Q: I was requested by a couple who were leaving the UAE to retrieve their belongings, as they could not fit them into their luggage. One of them is my friend and co-worker, and the other is a Swiss national whom I only know via my friend. The instructions were to hold on to the belongings until they were able to send me an address and money to ship them to their new location in the USA. In the short time they`ve been in the USA, a string of events had led them to separate. The Swiss national moved back to Switzerland and has been making legal threats and physical harm threats to me if I do not send his belongings to him. Since the bags contain both of their belongings, I have decided to send the bags to my friend in the USA so that the belongings can be divided in front of a divorce lawyer. Does this break any legal grounds on my part? He is making threats to open cases in Dubai and the EU. Is this possible based on these grounds?2017/10/03

الاستقالة خلال فترة التدريب بسبب التحرش الجنسي
س: اسمي روي. أنا مواطن فيليبيني أعمل بالمنطقة الغربية من إمارة أبو ظبي كمعالج بالتدليك منذ شهرين. أعمل بعقد محدد المدة، وأريد أن أقدم استقالتي بسبب مناخ العمل غير الصحي بالشركة. الأمر يتلخص في أنني مررت بعدة تجارب سيئة مع الإدارة والعملاء، حيث أن أكثر العملاء يجبرونني على ارتكاب أفعال جنسية مشينة مثل تدليك أعضائهم التناسلية ولعقها وغير ذلك. لا أستطيع تحمل الأمر أكثر من ذلك وأريد أن أستقيل لأن العمل هنا مؤذٍ نفسيًا وعقليًا بالنسبة لي. كيف يمكنني المغادرة دون التعرض للعقوبة؟ مع العلم أن مديري ورئيس الشركة لم يسمحوا لي بالاستقالة ولا يفهمون ما أمر به من خوف وصدمة. أحتاج لمساعدتك.2017/10/03

استئناف حكم ترحيل شخص بسبب تعاطي الحشيش
س: مرحبًا، تم القبض على ابنتي من منزلنا بدبي في يوم 29 أغسطس لتعاطي المخدرات. كنا قد عدنا من الإجازة قبل ذلك بأسبوعين وقامت ابنتي بتعاطي الحشيش حينها. والآن مرّ على حبس ابنتي شهرًا وكانت جلسة الاستماع بالأمس، وقد صدر حكمًا بتغريمها 5000 درهم بالإضافة ترحيلها من الإمارات وسوف نستأنف على هذا الحكم يوم الأحد. والسؤال: ما تكلفة استصدار حكم بإطلاق سراحها بكفالة؟ هل يمكن إلغاء حكم الترحيل؟ نحن نعيش في دبي منذ 30 عامًا وليس لدينا مكان آخر نرسلها إليه.2017/10/02

Q: Hi, I have a company that designs and manufactures solar powered products. I do the design and the products are manufactured by local workshops. I would like to draw a contract/agreement with the workshop to guarantee the work for my client. I would like this to be legally binding. My employer doesn't pay me the salary. What are my rights?
Q: It`s my first job experience in Dubai, I am hired by a hotel as chef de partie. I signed my contract on 19 July 2017 with no mention of my joining date on it, but on 1st of August I was called to join immediately. Now it`s been more than one and a half month but there is no sign of salary. The restaurant in the hotel is not officially opened yet. Whenever I ask for the salary, the management says that the restaurant is not started yet and ask me to either resign and pay all the expenses. Is there any right for me to do something? Moreover, the hotel is paying the employees salary via cash.2017/10/01

س: استعادة مبلغ من متعهد غير مهني، بلا عقد، ولا عمل قمنا بشراء عقارات من شركة رويال إستيتس في حديقة دبي للاستثمار – وقمنا بدفع 25% تقريبًا من القيمة الكلية، لكن الشركة انتهكت القانون في مسألتين على الأقل، حيث لم تعطنا العقد خلال 15 يوم من تاريخ الحجز، كما أنهم لم يوقعوا عقدًا معنا. ولم يبدأ العمل في الموقع حتى الآن. المتعهد مستمر في اختلاق الأعذار منذ سنتين، وهو غير مهني وغير متعاون. الشركة تحتفظ بأموالنا دون وجه حق، وقد أصبحت وثيقة الحجز لاغية لأننا اشترينا العقار عام 2015. هل هناك طريقة لاستعادة أموالنا من حساب الضمان الخاص بقسم الأراضي والممتلكات بدبي مباشرةً؟ لا حاجة لرفع قضية إلى المحكمة حيث أن انتهاك الشركة للقانون واضح للجميع، وأنا متيقن من أن دبي حريصة على سمعتها وعلى تسهيل الأمور على المستثمرين الأجانب دون تعقيدها. أقدر نصيحتك القانونية في هذا الموقف. شكرًا

Responsibility of a pet owner for the nuisance caused to others
Q: Hello, this morning I went to a park with my three dogs and let two off the leash. My dogs ran barking towards a jogger, who got scared and ran towards me. After that, he called the police and took a picture of me and my car. The picture of me, he deleted then directly. Afterwards, I left with my dogs. What could happen in this case? Is he able to do anything to me with the police? What if my dog bites someone? What are the possible consequences? In my tenancy contract, nothing is mentioned regarding pets, but my landlord approved my dogs. If my neighbour complains about barking, is there anything which could happen? What is required to hold someone liable for verbal sexual harassment if nothing has been recorded or no witness was there? Thank you, Marie
