Limitation period for labour related matters
Q: Dear Sir, I have worked March 2008 to July 2011 in Mushrif National Construction LLC Central Market Project Souk - Abu Dhabi. My job designation was IT Assitant, my salary was Dhs 3200/- per month. Also, they have provided yearly two-way tickets and leave salary benefits. In July 2011 I went to India for long leave. The company terminated me on January 31, 2012. After that, they calculated my indemnity money Dhs 6044/-. Partly they have sent my pending salaries and my indemnity money, they have sent only Dhs 2000/- till now. They did not pay my balance indemnity money Dhs 4044/-. I have sent a lot of emails and mobile calls with no response from Mushrif National Construction LLC. Kindly please help.

Q: I have leased my property to the tenant who has been constantly delaying the rent and not honoring the cheques he delivered and I do not have the time to ask him every time to make the payment. Is there a way I can evict him or force him to leave the apartment?

هل التوقف عن سداد شيكات جريمة؟
س: مرحبًا، لي صديق اتفق مع صديق له على الشراكة في إنشاء شركة، ووافقا على تقسيم التكاليف وأن يقوم صديقي بتأجير مكان ودفع مبلغ معين من المال، فقام صديقي بتحرير شيكات بنكية بدلًا من دفع المبلغ نقدًا. وعندما حصل الشريكان على تصريح العمل، لم يقم شريك صديقي بتضمين اسمه (اسم صديقي) في الشركة. لذلك طلب صديقي من البنك التوقف عن تسديد قيمة الشيكات. والسؤال هو هل هناك مسؤولية قانونية على صديقي بسبب ارتجاع الشيكات حيث أنه طلب من البنك التوقف عن تسديدها؟2017/03/18

Real property amenities and the right to terminate a lease
Q: I have paid three cheques up until the end of November 2017 when it is being demolished. I need to move out into staff accommodation in August when the next cheque is due. The relationship with the landlord company is not great. I have had 4 cheques bounce. 2 - my fault, 2 - theirs. I am being charged 8 thousand for this which I will pay. They have however not kept the swimming pool clean. I have many emails with photos showing the green pool and requests for it to be kept clean. هل يمكن حل مشكلة شيك مرتجع في قسم الشرطة؟
س: تلقيت مكالمة من شرطة جبل علي حيث أن عليّ شيك مرتجع بقيمة 60 ألف درهم لبنك الخليج الأول ويريدون أن يروني في الصباح. أخبرني أحدهم أن هناك سياسة جديدة تسمح بتسوية قضايا الشيكات المرتجعة في قسم الشرطة، وعندما هاتفني الشرطي، طمأنني أنه يمكن تسوية المشكلة هناك في نفس اليوم. هل هذا صحيح؟ ماذا سيحدث إذا ذهبت إلى قسم الشرطة؟2017/03/16

إمكانية وجود بند للإنهاء المبكر لعقد الإيجار
س: مرحبًا، أنا أعيش وأعمل في دبي. تزوجت مؤخرًا وأريد إحضار زوجتي إلى دبي على تأشيرتي. لذلك، فإن أحد الشروط الأساسية هو إبرام عقد إيجار لمدة سنة واحدة. طبيعة وظيفتي قد تضطرني إلى الانتقال إلى بلد آخر في أي وقت. أيضًا، لديّ طلب مفتوح للهجرة إلى دولة أخرى، وقد أحصل على الإقامة الدائمة خلال بضعة أشهر أو نحو ذلك. في أي من الحالتين، فهناك احتمال أن أضطر إلى إنهاء عقد الإيجار قبل أن ينتهي رسميًا. يرجى تقديم المشورة إذا كان من الممكن ومن المقبول قانونًا وجود شرط خروج مبكر، مثل" يجوز للمستأجر (أو كلا الطرفين) إنهاء العقد في أي وقت بعد ثلاثة أشهر من توقيع العقد عن طريق تقديم إشعار لمدة شهر للطرف الآخر. لا يوجد بند جزائي في هذه الحالة ". بالطبع هذا يخضع لإيجاد المالك الذي يوافق على مثل هذا الشرط. لكنني وجدت أحدهم، فهل يمكن تعديل العقود القياسية لإضافة مثل هذا الشرط؟ شكرًا س. ج.2017/03/19

Responsibility for defects discovered after handover of the premises
Q: Dear Sir or Madam, Good Afternoon. Two months ago, we have moved from an apartment, settled all the bills, and collected our security deposit back from the agency. However, the agency is sending us an email saying that the cooker is not working at all at the moment, and that was caused by us. During our stay, we did have an issue with the cooker, smoked started coming out, and at that time we informed the building management as they had to shutdown the power. The oven was fixed afterwards by the building management and was working properly. We didn`t pay for anything. Please advise, can agency press charges against us, or do we need to pay for the new cooker, as that is what they are asking from us now? تبعات التخلف عن سداد مبالغ بطاقة الائتمان
س: بعد التخلف لمدة شهرين عن سداد مبالغ بطاقة الائتمان، قام البنك بتقديم شيك ضمان على حسابي بمبلغ 101000 درهم إماراتي، وارتُجع الشيك. قالوا بأنهم قدموا شكوى في الشرطة وأصدروا منع سفر ضدي. منذ حينها وأنا أسدد الحد الأدنى المطلوب، وأخطط لمناقشة موضوع السداد مع قسم التحصيل في البنك. بصفتي رجل أعمال، فأنا أسافر كثيرًا إلى بلدان أخرى. هل سأخضع الآن إلى المنع من السفر / سأحتجز في المطار / أذهب إلى السجن؟

Q: Hello Sir, I went to apply for a free zone company in the UAE through an agent and formed it and will get my trade Licence tomorrow. However, the agent told me to sign four blank papers (plain white papers). He told he need them to apply for my visa and immigration card etc. etc. and I won`t have to come to Ajman again. الاستخدام غير الشرعي للبطاقات الائتمانية
س: مرحبًا، عملت في دبي لثلاثة أو أربعة أشهر عام 2013، ثم تركت وظيفتي وعدت إلى الهند. كان حسابي البنكي لا يزال مفتوحًا حينها، وبدأ أحد زملائي يستخدم بطاقتي الائتمانية دون علمي بعد مغادرتي. كذلك قام هذا الزميل بإضافة اسمه إلى الحساب وأجرى بعض المعاملات المالية. كنت أتلقى رسائل من البنك عبر البريد الإلكتروني، لكنني ظننت أنها رسائل طفيلية أو ترويجية ولم أعرها اهتمامًا. لكن حدث أن تحققت من إحدى تلك الرسائل مؤخرًا فاكتشفت أن هناك من يستخدم بطاقتي بمبلغ كبير يصل إلى 12.000 درهم، ثم تحققت من الرسائل السابقة فوجدت أن زميلي السابق هو من قام بتلك المعاملات. لا أعرف ماذا ينبغي أن أفعل. هذا تزوير صريح يقوم به هذا الشخص باسمي، وأحتاج لأن أفعل شيئًا حيال ذلك. أحتاج لمساعدتك. تحياتي. شكرًا.2017/03/11
