Non-compliance with the dissolution agreement of a business partnership
Q: I had a partnership in a business before, but I agreed with my partner to sign a cancellation of partnership and he will pay me back my capital every month. He didn`t pay and it`s already 2 weeks. I filed a case in the public prosecution but it was rejected as the prosecutor is saying that it should go to the civil court. I don`t have the 10% for the civil court. Is there any other way to proceed with this?

Conditions for applying a vague non-competition clause
Q: Hello, I would like to know if a non-competition clause also applies when starting a similar business in a niche industry. My non-competition clause is very vague and does not specify the area, industry and it`s for 2 years. Does this hold up? And if it doesn`t, could they file a civil case? Thank you!

Leaving the UAE without proper employment visa cancellation
Q: In 2013, I was working in the UAE on an employment visa. I had to return back to India in short time with the intention of joining back in a week`s time but the situation didn`t permit. Hence, my visa was not cancelled. I also had a horrible employer and they used to deduct money from my salary for mistakes that happened or losses that occurred to the company because of my negligence. That way I had AED 600 due to them. I don`t know whether they have put any ban on me or whether they reported me as absconding or if any other charges have been framed against me. Just when I informed them that I am not joining back, they sent an email asking me to send my passport for cancellation and pay AED 600. However, I couldn`t trust sending the passport by courier for visa cancellation. Now, I would like to travel on a visit visa to Dubai with my family. It`s been more than 4 years now but I am afraid if there is any kind of case filed against me then I will be detained at the airport or will be asked to pay a heavy fine.2018/02/05

Clearance of a bounced cheque case after payment
Q: Hi. I had a bounced cheque case with my ex-landlord which I recently settled. He filed a case against me. My brother paid the amount and their Local UAE National will be doing some paperwork in ON TIME government service office. Then later, he was advised to go to Court to take the NOC and pay the fine. Once the NOC is taken and fine paid, do we need to take this paper to the Police Station or Immigration to clear my name so they won`t stop me at the Airport when I enter Dubai again, or it will be done automatically? If it will be done automatically, then how much time it takes?

Employer's maneuvering to escape paying the end of service benefits
Q: I am the only employee in the company and my job included sales, marketing, accounting, administration and delivery. I worked using my own personal desktop, phone, internet connection and car since the company has not provided any. I started work in this Free Zone company on Dec 1, 2014, under unlimited contract and on my husband`s visa. I have resigned last Dec 11, 2017, and served my 30 days’ notice period last Jan 11, 2018. My employer was supposed to pay the final settlement on my last day but then she re-scheduled to meet on Jan 14, then on January 16 and lastly on Jan 18. Just before the day of agreed final settlement, she accused me that all my previous work emails have been allegedly deleted. She filed a complaint of Breach of Contract on Jan 18 and I also filed a complaint about her delay in paying my end of service benefits. She has continuously intimidated me with her plans to file it in court. These false allegations have caused me and my family emotional distress. Please advise.2018/02/04

استرداد دين شخصي دون اتفاق مكتوب
س: مرحبا. أود أن أستفسر عن المبلغ الذي تحاسبون عليه مقابل استشارة لأنني بحاجة إلى بعض المساعدة القانونية فيما يتعلق بأموال قد أقرضتها إلى شخص. شخص ما يدين لي بمبلغ كبير من المال، 51000 درهم إماراتي على وجه الدقة. لقد قمت بإعطائه مبلغ 60000 درهم إماراتي والتي كان سيقوم بسدادها بصورة شهرية على مدى 24 شهرًا. ومع ذلك، بعد دفع 3 أشهر، توقف عن الدفع لي حتى الآن. أود الحصول على عرض أسعار حول تكلفة الحصول على مساعدة قانونية في مثل هذه الحالة. شكرًا لك.

العواقب القانونية المترتبة على عدم سداد فواتير " اتصالات "
س: لدي زميل سكن قام بالتقديم على الإنترنت المقدم من شركة " اتصالات "، ولكن عندما ذهب في عطلة، لم يعد مرة أخرى. ثم استمر مالك الشقة باستخدام الإنترنت ولكن لم ينقل الحساب باسمه. بعد عودتي من عطلتي وجدت أن هناك مالكًا جديدًا للشقة بالفعل. قامت المالكة الجديدة بإزالة الإنترنت من منزلنا وذلك لأنها قامت بالتقديم على حساب جديد. حدث هذا منذ سنتين تقريبًا. لا أدري لماذا تقوم " اتصالات " الآن بمهاتفتي وإرسائل رسائل إلي لكي أدفع المبلغ المستحق، وقد قاموا باتخاذ إجراء قانوني ضدي، ووضعوا منعًا من السفر ضدي. قامت " تسهيل " بإخباري بذلك عن طريق الرسائل. هل يمكن رجاءً لأي شخص أن يساعدني في ما ينبغي علي فعله؟2018/02/04

Acting against a case of robbery and ban of entry to the UAE
Q: I`m on my husband`s permanent visa. Due to my delivery, I came to India in September 2017, and now I`m finding myself on the blacklist because of some minor robbery case. It is a case in which I`m not involved, as it is of my very close relative. My question is, how can I enter the UAE because it`s a matter of my self-respect and family. I want to fight against it.
