Q: Dear Madam, I have an unlimited contract with the employer and I have not completed the 6-month probation period. The company gave me a termination letter without any warning letter before. 1. If I get a job in some other company, will I get a labour ban or not? Some people told me even if you have an unlimited contract, but your company terminated you under probation period. I must have completed 1 year to avoid the ban. Please advise me, what do I do? 2. The company gave me termination letter one day before my completion of the 6-month probation period. My question is that I joined the company on 27 August 2017 and the company gave me the termination letter on 26 February 2018, but if I count the days then it is 184 days, while 6 month means 180 days. Please advise? 3. If 184 days are considered 6 months what are my rights? Can I demand the company to pay my settlement, air tickets and half year leave salary... etc? The HR told me that under probation, the company do not pay me any benefits like back home tickets, gratuity...etc.

س: مرحبًا سيدي. أنا الدكتور ( ب. ب.)، طبيب أسنان عام. قامت العيادة التي كنت أعمل لصالحها في السابق بإنهاء عقد عملي أثناء فترة الاختبار دون إعطائي أي إخطار ثم طلبوا مني جواز السفر لإلغاء التأشيرة. بما أنها كانت فترة اختبار، قبلت الإنهاء، ولكن طلبت راتبًا عن الأيام التي عملت فيها معهم. أخبروني أنهم سيعطونني التسوية النهائية وطلبوا مني جواز سفري لإلغاء التأشيرة. قاموا الآن بإلغاء التأشيرة ولكن لم أستلم الراتب. ما الذي ينبغي علي فعله؟

س: كنت أعمل خلال السنتين الماضيتين في شركة ما. كانت مهمتي في العمل هي معالجة التأشيرات للموظفين والعمال وترخيص الشركة. لذلك فقد كانوا يعطونني المال. تحصلت على عدد قليل جدًا من الإيصالات بسبب قيامي بالعمل من خلال وكلاء. لكنني احتفظت بسجل لجميع المبالغ التي دُفعت وأبلغت عن ذلك إلى الشركة بشكل يومي. قاموا الآن بإنهاء خدمتي وعندما قدمت مستحقات التسوية الخاصة بي، قالوا إنهم بحاجة إلى مراجعة الحسابات بسبب شكوكهم في قيامي بالاختلاس، وبعد ذلك سيدفعون مستحقاتي. سمعت من زميلي أيضًا أنهم يريدون فتح قضية ضدي حتى لا يدفعون لي أي أموال. وقد تم تقديم خطاب الإنهاء إليّ وذكر فيه إلى عدم الحاجة إلى فترة إخطار مدتها 30 يومًا. سيذهبون إلى أبعد مدى للفوز في هذه القضية ولن يعجزهم المال فهم أغنياء أيضا. ليس لدي سجلات لإثبات براءتي. ماذا يجب أن أفعل؟ لم أقم بفتح أي شكوى حتى الآن في المحكمة العمالية.

س: مرحبًا، قدّمتُ شكوى ضد صاحب العمل لعدم دفع راتبي والتسوية النهائية. وصلتني رسالة من وزارة الموارد البشرية والتوطين تفيد بأنهم تواصلوا مع صاحب العمل ورفض الدفع. في هذه الحالة، ماذا أفعل للحصول على التسوية النهائية؟

Q: Dear Lawyers, My employer didn't proceed with processing my employment visa. They managed to apply for a labor card, but then held the process and sent me a WhatsApp message stating they would not proceed. I worked with them for one month. They decided to terminate the contract and stop the visa process. I signed the job offer with a 10k salary, but the labor contract mentioned only 5k. Until now, they have not paid my one-month salary. They told me they would pay my one-month salary after I returned all the company equipment they gave me, such as phones and a laptop. My question is, do I have a chance to get my settlement? I already filed a complaint with MOHRE, but I know it will take time, and I have no idea if I even stand a chance. Please advise.

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
