How can we find out why the Abu Dhabi court is deducting my husband’s salary?

Hello,

My husband's salary is automatically debited by the Abu Dhabi court as per the bank statements.

However, we do not know exactly what case has been filed against him, and we also do not know the total amount we need to pay; they are just debiting it.

Could someone please advise us on what we should do?

Dear Questioner,

Thank you for your message!

Regarding your concern about your husband’s salary being automatically debited by order of the Abu Dhabi Court, yet without clarity on the case details or the total outstanding amount, please be advised as follows:

1. Case Information Retrieval:

You or your husband will need to visit the Abu Dhabi Judicial Department (ADJD) in person or access their online services. Using his Emirates ID, you can request details of any execution case or judgment registered against him.

Alternatively, you can log in using UAE PASS to check case status and outstanding amounts through the Case Inquiry system.

2. Bank Confirmation:

We recommend requesting a formal letter from your husband’s bank stating:

- The case number,

- The authority requesting the deduction, and

- The amounts debited to date.

This will help in matching the transaction to the correct court case.

3. Legal Representation:

If you're unable to obtain case details directly or need further support, you may authorize us as a legal representative via Power of Attorney (POA) to obtain case documents and communicate with the court on your behalf.

Next Steps

Once you have the case information:

- We can assist in reviewing the case,

- Advise whether a settlement, payment plan, or objection can be filed, and

- Work toward stopping or reducing the salary deductions, if appropriate.

Please let us know if you would like our support in following up with the Abu Dhabi Court or preparing the necessary documents.

Kind regards,

Mohammed Salah

Hi there!

A power of attorney must be issued to the lawyer so that he can review the file for which the salary is being deducted and take legal action to stop the disbursement.

Greetings,

It seems that your husband’s salary is being automatically debited due to an ongoing court order, likely related to a financial obligation or judgment.

If you’re unsure about the case or the total amount to be paid, the first step is to request detailed information from Abu Dhabi Courts regarding the case number, the exact amount owed, and the reason for the deductions.

We strongly recommend seeking legal advice to clarify the situation, ensure that payments are being made correctly, and explore any potential options for resolution.

Please book a consultation with us for detailed guidance and to discuss the next steps.

Dear Client,

Thank you for your message and for explaining your situation!

When a salary is being automatically debited by order of the Abu Dhabi court, this typically means there is a court judgment or enforcement order against your husband-often related to a debt, loan, or other financial obligation.

The bank is required by law to comply with such orders and transfer funds directly to the court or creditor.

What you should do:

1. Obtain Case Details:

Visit the Abu Dhabi Judicial Department (ADJD) in person or access their online portal. You can request information about the case using your husband’s Emirates ID, case number (if available), or bank account details.

This will help you understand the nature of the case, the party who filed it, and the total amount due.

2. Request a Statement:

Ask the court or the bank for a detailed statement showing the total amount owed, the amount already paid, and the remaining balance. This is your right as the affected party.

3. Consult the Bank:

Contact your husband’s bank and request information about the court order and the deductions being made. Banks are required to provide details about any court-ordered salary garnishments.

4. Seek Legal Advice:

If you are unable to get clear answers or need help understanding the case, consider consulting a legal professional. They can assist in obtaining official documents, negotiating payment terms, or appealing the court’s decision if appropriate.

Summary:

- The salary deductions are court-ordered and legally enforced.

- You have the right to know the case details and the total amount due.

- Visit the ADJD or contact the bank for documentation and clarification.

- Legal support is available if you need further assistance.

If you would like, our office can assist you in obtaining the necessary information from the court and bank, review your husband’s case, and advise on the best steps forward. Please let us know if you would like to schedule a consultation.

Best regards,
