Employee’s bank account seized, but I haven’t received payment. What can I do as an employer?

Hello,

I am the employer and received a labor court decision in my favor.

I submitted the execution request, and the court seized the employee's bank account, but she has still not paid the amount mentioned in the labor case decision.

What should I do in this case?

Greetings,

Since the court has ruled in your favor and an execution request has been filed, but the employee has not yet paid, you may consider the following legal actions:

- Follow Up on Bank Seizure:

Ensure that the bank has complied with the court’s order and transferred the seized funds.

- Request Further Enforcement Actions:

If the seized funds are insufficient, you can request additional measures, such as a travel ban, asset seizure, or salary garnishment if the employee is still working in the UAE.

- Explore Alternative Legal Remedies:

If the employee has no visible assets, legal options like insolvency proceedings may be considered.

For tailored legal advice and to expedite the enforcement process, book a consultation or appoint us to handle your case.

Dear Sir/Madam,

Thank you for your inquiry regarding the enforcement of a labor court decision in your favor!

Since the court has already seized the employee's bank account but payment has not yet been made, here are the steps you can take to address the situation:

1. Follow Up with the Execution Court:

Contact the court handling the execution request to inquire about the status of the seized funds. Provide them with your case details and request an update on when the funds will be transferred to you.

2. Request Garnishment or Additional Action:

If the seized amount is insufficient or inaccessible, you may request further enforcement measures, such as garnishing additional assets or wages of the employee, through a court-appointed executor.

3. File a Complaint for Non-Compliance:

If there is evidence that the employee is deliberately avoiding payment despite sufficient funds in their account, you may escalate the matter by filing a formal complaint with the court or seeking legal advice to address non-compliance.

4. Consult Legal Counsel:

Engage with a legal professional specializing in UAE labor law to ensure all necessary steps are taken to enforce the judgment effectively and within legal boundaries. They can assist in expediting the process and resolving any complications.

Please note that while delays in execution are not uncommon, maintaining regular communication with the court and legal counsel will help ensure that your rights are protected and that payment is received as soon as possible.

Should you require further assistance, please do not hesitate to contact us.

Yours sincerely,

Thank you for reaching out regarding your case!

Based on your description, it seems that the employee has not complied with the court's decision despite the bank account being seized.

In such cases, if the amount remains unpaid after the bank account seizure, there are additional enforcement measures you can take.

You may consider requesting the court to initiate further enforcement actions, such as:

- Garnishment of other assets: If the employee has any other assets, the court can seize them to fulfill the payment.

- Wage garnishment: You can request the court to direct the employee's employer to deduct part of her salary until the amount owed is fully paid.

- Travel ban: If the employee continues to avoid payment, a travel ban can be enforced, restricting her ability to leave the country.

Additionally, if you haven’t already done so, I recommend reviewing the case with a legal expert to ensure all avenues for enforcement are explored.

If you'd like to discuss this further and understand your next steps, feel free to reach out to me directly via WhatsApp or phone. I’ll be happy to guide you through the process and help ensure your rights are fully enforced.

Best regards,

Suhail Rana

In some cases, other creditors might have prior claims on the employee's bank account. This can affect the amount you receive.

Reach out to the execution department of the labor court. They can provide updates on the status of your case.

If you have serious concerns that the employee might leave the country, you can request a travel ban. However, this is usually reserved for significant debts.

If you need further clarification, kindly share your WhatsApp number.

Dear,

You must submit a disbursement request to the court so that the amount can be transferred to your bank account.

Dear Questioner,

Thank you for your inquiry regarding the execution of the labor court decision!

Given that the court has already seized the employee's bank account, but the amount owed has still not been paid, the following steps should be considered:

- Follow Up with the Court:

First, I recommend confirming with the court the status of the seized bank account, including whether the funds have been transferred or if there are any issues preventing payment. It is crucial to ensure that the seizure has been properly executed.

- Additional Enforcement Actions:

If the bank account seizure has not been successful or if there are insufficient funds, we can request further enforcement actions such as:

- Wage Garnishment:

If the employee is employed elsewhere, we can request that their wages be garnished directly from their employer.

- Property Seizure:

If bank accounts are not yielding sufficient funds, we can request the court to seize any real estate or movable property owned by the employee to satisfy the judgment.

- Court-Ordered Sale:

If any assets are seized, we may seek the court's assistance in selling the property to recover the owed amount.

- Request for Follow-up Execution:

We can formally request the court to initiate further steps in the execution process, such as investigating additional sources of income or assets.

- Contempt of Court:

If the employee is actively refusing to comply with the court's order, we may explore filing for contempt of court, which can lead to penalties such as fines or imprisonment.

- Legal Assistance:

If you wish to proceed with any of the above steps, I am available to assist you further in liaising with the court and ensuring the proper legal actions are taken.

Please let me know how you would like to proceed, and I will take the necessary steps to enforce the judgment and recover the owed amount.

If the employee hasn't paid as per the labor case decision, you can take the following steps:

- File a police complaint for non-compliance.

- Request a travel ban to prevent the employee from leaving the country.

- File with the Execution Court to enforce payment.

- Hire a debt collection agency to recover the amount.

Always follow legal procedures and consult a lawyer before taking action. Would you like to schedule a meeting with us to discuss this in more detail and assist you further?
