Despite a waiver, the case is still with the public prosecution. Can I travel?

Hello,

I had a case regarding fraud by technical means, and we did a tanazul.

It was attested and submitted to the court, but the case still hasn’t been dropped and is now with the public prosecution.

What do I do now, as I need to travel urgently?

Either you should require a guarantor for temporary removal of the case if you need to travel immediately, or you need to treat the case from the beginning and either appoint a lawyer or take necessary advice to defend the matter and clear the case, including the stop search.

Even though a tanazul has been signed and attested, the Public Prosecution has the final say in whether to drop the criminal case.

They will review the tanazul agreement and the circumstances of the fraud to ensure that the victim's rights have been fully addressed and there are no remaining public interest concerns that warrant further prosecution.

If the prosecutor is satisfied with the tanazul and intends to drop the case, request an official No Objection Certificate (NOC) or a case closure letter addressed to the relevant immigration authorities to lift any travel ban.

Dear,

You can bring someone as a guarantor for you, deposit their passport, and submit a request to the Public Prosecution to replace the guarantee in the case and allow you to travel and return to the UAE.
