Will you be arrested due to non-payment in a civil case if you have no assets or money?

Greetings,

Dear Lawyers,

If a debtor does not pay a Dubai Court judgement and has no assets in the UAE, will he be arrested due to non-payment in a civil case?

Please advise.

Thanks

If the creditor can prove that the debtor has deliberately concealed or transferred assets to avoid payment, the court may take enforcement action, which could include arrest.

If a debtor demonstrably lacks assets within the UAE, it becomes more challenging for a creditor to prove this ability.

Ultimately, the execution judge retains discretion in determining the appropriate enforcement measures.

Factors such as the debtor's cooperation, the nature of the debt, and the creditor's evidence will be considered.

Dear questioner

Generally, in debt matters, the court will not issue an arrest warrant. However, if you try to travel or try to do some visa renewals, then the authorities have the power to detain you unless you are not detained.

If you need more details, kindly share your WhatsApp number.

Dear G. W.,

Thank you for your inquiry.

Arrest in a civil case for non-payment of a judgment is generally not applicable under UAE law, unless there is fraud or intentional evasion of payment.

However, there are other legal measures, such as travel bans, asset seizures, or salary garnishment, that can be pursued to enforce the judgment.

If you need more detailed guidance or assistance with enforcement, I recommend consulting with us as a lawyer who specializes in debt recovery and enforcement actions in the UAE.

Please let me know if you require any further clarification or assistance.

Best regards,

Mohammed Salah

Greetings,

Thank you for your inquiry.

In the UAE, if a debtor fails to comply with a Dubai Court judgment and has no assets to seize, the court may issue an arrest warrant in civil execution cases, particularly if the debtor is found to be willfully avoiding payment.

However, each case depends on specific legal and financial circumstances.

To explore your enforcement options or take action, we recommend booking a consultation or appointing our firm to represent you in the execution process.

We are a legal firm specializing in civil cases in the UAE.

According to UAE law, a debtor cannot be arrested solely for non-payment of a civil court judgment, but other measures such as freezing bank accounts or seizing assets can be taken.

If the debtor has no assets in the UAE, the court may continue enforcement through other legal channels.

We are here to assist you in taking the necessary steps to protect your rights.

Hello,

Hope you are doing well.

This is from Fawzia Mohd Lawyers and Legal Consultancy. Thank you for reaching out.

In the UAE, a debtor cannot be arrested solely for non-payment of a civil case judgment unless it involves fraudulent actions or other criminal elements.

However, if the debtor has no assets in the UAE, enforcement actions such as wage garnishment or bank account seizure may be pursued.

If you need further assistance, feel free to contact us by phone.

Yes, the execution judge can order the debtor's arrest—but only after:

- All other enforcement measures (e.g., asset seizure) fail,

- The debtor is not declared insolvent, and

- The creditor specifically requests this action.

In such cases, the court may jail the debtor to pressure repayment.

If a debtor does not pay a Dubai court judgement and has no assets in the UAE, the likelihood of arrest due to non-payment in a civil case is low.

However, creditors may still have options to enforce the judgment, such as applying for a travel ban or seeking international cooperation to track down assets abroad.

It is essential for debtors and creditors to seek professional advice from a qualified lawyer to understand their rights and obligations under UAE law.
