Can the company pay the labor execution amount in cash rather than in court?

I opened execution one month ago and Abu Dhabi labor enforcement already seized the trade license, company cars, and bank accounts

Now the company called and offered to give me the money but they want to give me cash at Enjaz office Mussafah in Abu Dhabi.

I heard that once the execution is opened, the company must deposit the amount in the enforcement labor court only.

Then, the court will transfer the amount into my bank account and I already provided my bank account details while opening execution before.

Actually, I am not satisfied with getting cash money in this way. I feel satisfied with getting money through court and I don’t know why the company wants to give cash.

Please advise me, should I receive cash money in this way in Enjaz office or should I refuse with the company and tell them to deposit it in the court bank account?

As per law, what should I do?

Please advise

Hello,

In general, enforcement orders are designed to be followed through legal channels, and you are correct in assuming that the company should deposit the owed amount into the court's bank account.

Once the payment is made through the court, it will be transferred to your bank account. This method ensures transparency and legal compliance.

If the company is attempting to pay you cash at an office like Enjaz in Mussafah, it might not comply with the official court procedure, and you could be exposed to risks (such as not having a record of the payment, or possible manipulation or fraud).

You should contact the enforcement labor court to confirm the official procedure. Ask if the company is legally allowed to pay you in cash or if they must deposit the amount into the court's bank account.

If they confirm that the payment must be made through the court, you should politely refuse the cash offer and request that the company follow the correct procedure.

Dear Client,

Thank you for reaching out regarding your concerns about receiving payment after initiating the execution process through the Abu Dhabi Enforcement Labor Court.

Below is a detailed response addressing your situation:

Legal Position on Receiving Payment

1. Court-Directed Payment:

As per UAE law, once the execution process is initiated, the judgment debtor (in this case, the company) is required to deposit the awarded amount into the court’s account.

The court then transfers the funds directly to your bank account, which you have already provided during the execution filing.

2. Cash Payment Outside Court:

While the company offering to pay you in cash at an external location (such as Enjaz office) is not illegal, it is not the standard procedure for execution cases. Accepting such a payment could lead to complications, including:

- Lack of official documentation confirming full payment.

- Potential disputes over whether the judgment amount has been fully settled.

3. Why Companies Offer Cash Payments:

Companies may prefer cash payments outside the court to avoid additional penalties, fees, or delays associated with depositing funds into the court's account.

However, this approach does not align with the formal execution process and could expose you to unnecessary risks.

Recommended Course of Action

1. Refuse Cash Payment: Politely inform the company that you are not comfortable accepting cash payments outside of court and that they must deposit the amount into the enforcement court’s account as per legal procedures.

2. Communicate Through Court: If the company insists on cash payment, request that they coordinate directly with the court to ensure proper documentation and compliance with legal requirements.

3. Follow Legal Process: Continue working with the enforcement labor court to ensure that any payment made by the company is officially documented and transferred to your bank account by the court.

This will protect your rights and provide clear evidence of settlement.

Conclusion

It is advisable to adhere strictly to the formal court process for receiving payment. This ensures transparency, avoids potential disputes, and guarantees that your rights are fully protected under UAE law.

If you require further assistance or legal representation in this matter, please do not hesitate to contact us.

Best regards,

Hello!

You should politely refuse to receive the cash at Enjaz office and ask the company to make the payment through the court's official process to ensure everything is properly documented and handled according to the law.

Greetings,

As you have already initiated execution proceedings, the standard legal procedure requires the company to deposit the owed amount with the Enforcement Court, which will then transfer the funds to your bank account as per the details you provided.

Receiving cash directly outside the court process, especially at a third-party location like Enjaz, is not advisable, as it may affect your legal rights and documentation of the payment.

The company’s attempt to bypass the court process raises concerns.

For your protection, it is best to insist that the payment be made through the court’s designated bank account. If the company refuses, legal action can ensure enforcement.

According to UAE law, once an execution has been opened, the company must deposit the amount owed into the enforcement labor court.

The court will then transfer the amount into your bank account. It is not necessary for you to receive cash directly from the company.

If the company insists on giving you cash at the Enjaz office, you have the right to refuse and request that they deposit the amount into the court's bank account.

This is the proper and legal way for the payment to be made. If the company continues to insist on giving you cash, you may want to seek legal advice and assistance from a lawyer or the labor court to ensure that your rights are protected and the payment is made in accordance with the law.

The purpose of the execution order is to ensure that the debt is settled through official channels. Clearly and firmly inform the company that you will only accept payment through the official court channels.

State that you will not accept any cash payments. Reiterate that you have already provided your bank account details (IBAN) to the Enforcement Labor Court.

Once an execution order is issued, the debtor is legally obligated to comply with the court's instructions.

If you need further clarification you may ask.

In this case, if you have already filed a judicial execution and the court has ordered the confiscation of the company's assets through legal proceedings, it is best to conduct all financial transactions related to this execution through the court rather than in cash or through other offices such as the Enjaz office in Musaffah.

When the execution is filed, your bank account details have been submitted to the court, and the amount due must be deposited into the court account in accordance with the law and then transferred to your bank accounts.

Any financial transaction conducted outside the court framework may violate legal procedures and could lead to future legal issues.

Therefore, it is best to refuse to accept cash at the Enjaz office and insist that payment be made through the court as agreed upon.

You can inform the company of the need to comply with legal procedures and direct them to the execution court where the case was filed.

If you feel the company is trying to manipulate the legal process or pay money outside the official framework, you can contact us by phone or WhatsApp.
