My employer renewed my visa at the end of my contract then terminated me. What are my rights?
My employer signed a visa renewal form at the end of my contract and now when 15 days are left in my residency expiration, they want to terminate me.
What are my rights in this case?
Can't they not terminate me and at the end of the contract just say that my contract is finished and we don't want you anymore?
What about my notice period and what are my rights in this situation?
Greetings,
If your employer signed the visa renewal form, it indicates an intent to continue your employment. Terminating you 15 days before residency expiration raises legal concerns, especially regarding:
Contract Termination: If your contract was renewed, your employer must follow proper termination procedures, including serving a notice period as per UAE Labour Law.
Notice Period: Unless terminated for valid reasons, you are generally entitled to a notice period (usually 30 days) or compensation in lieu of notice.
End of Service Benefits: You are entitled to gratuity and any pending dues based on your total service duration.
Your employer cannot simply dismiss you without following legal procedures. Book a consultation with Future Vision for Advocacy and Legal Consultancy to assess your case and take the necessary legal action.

Dear Sir/Madam,
Thank you for bringing this matter to our attention.
I understand your concern regarding the potential termination of your employment, especially given the recent visa renewal form signed by your employer.
Please allow me to provide you with a professional overview of your rights and the legal considerations in this situation.
1. Notice Period:
As per UAE Labour Law, your employer is obligated to provide a notice period ranging from 30 to 90 days, as specified in your employment contract.
Should they fail to adhere to this requirement, you are entitled to compensation equivalent to your salary for the duration of the notice period.
2. Termination Grounds:
Your employer must present valid reasons for termination, such as documented performance issues or misconduct. Arbitrary dismissal is prohibited under UAE labor regulations.
3. Contract Expiration:
If your fixed-term contract is nearing its end, your employer has the right not to renew it. However, the recent signing of a visa renewal form may complicate this situation and could potentially be viewed as an implicit agreement to continue employment.
4. Visa Status:
Upon visa cancellation, you will typically be granted a grace period to either secure new employment or make arrangements to leave the country.
5. Compensation for Arbitrary Dismissal:
Should the termination be deemed arbitrary, you may be entitled to compensation of up to three months' salary, as per UAE labor law.
6. End of Service Benefits:
Depending on your length of service, you may be eligible for end-of-service gratuity.
7. Dispute Resolution:
In the event of a disagreement, you have the right to file a complaint with the Ministry of Human Resources and Emiratisation (MoHRE) for mediation and resolution.
Given the complexities of your situation, particularly the recent visa renewal form signing, I strongly recommend you engage in a formal discussion with your employer to clarify their intentions and your position.
Should you be unable to reach a satisfactory resolution, it would be advisable to seek guidance from the MoHRE or consult with us.
Please do not hesitate to contact us if you require any further clarification or assistance in this matter.
Yours sincerely,
Abdul Wahied
Greetings,
At the end of the labor contract, it is either of two probabilities:
1- to renew by consent of the two parties.
2- to lapse without renewing.
In the latter, you have a one-month grace period. You are entitled to the gratuity of the end of service plus any other unpaid entitlements.
Best Regards

When faced with the potential termination of employment after your employer has signed a visa renewal form, it’s crucial to understand your rights, which include recognizing the terms of your employment contract (whether fixed-term or indefinite), the implications of the visa renewal as an acknowledgment of employment intent, adherence to any notice periods stipulated in your contract, and any legal protections against arbitrary termination under local labor laws.
If you believe the termination is unjust, document all communication, consider discussing the issue with HR or seeking mediation, and consult legal professionals for tailored advice regarding your rights and options.
Your employer’s actions raise important legal concerns regarding your employment rights in the UAE.
If they signed the visa renewal form, it suggests an intention to renew your employment, which may affect their ability to simply terminate you at the last moment without proper notice.
Under UAE labor law:
Termination & Notice Period: If your contract was renewed (explicitly or implicitly), your employer must provide the required notice period as per your contract (usually 30 to 90 days) or compensate you in lieu of notice.
Unfair Termination: If they attempt to terminate you without valid grounds or without following proper legal procedures, you may have a case for unfair dismissal and claim compensation.
End-of-Service Benefits: Regardless of the situation, you are entitled to your end-of-service gratuity (if you have completed more than one year of service), pending salary, and any other contractual benefits.
Your case requires a careful legal review to ensure you receive full compensation and protection under UAE law.
I can assist you in assessing your rights, negotiating with your employer, and taking legal action if necessary.
Please reach out to me on WhatsApp or by phone so we can discuss your situation in detail and take the necessary steps.
Best regards,

Dear questioner
They should provide a notice period and salary for the notice and also a visa to stay until you complete the notice period because it is their fault which puts you in the situation of the notice period at the time of visa expiry and the grace period.
You will be receiving the full salary even if they want to terminate you without completing the notice period or with the completion as well as the other end-of-service benefits.
If they are not ready to provide the notice period salary with immediate termination or visa costs to cover the notice period or extension, you can file a complaint in MOHRE.
Dear questioner,
If your employer signed a visa renewal form, it indicates an intent to continue employment. Termination must follow legal procedures, including valid reasons and adherence to the notice period as per your contract.
If they terminate you unlawfully, you may be entitled to compensation. You should review your contract and, if necessary, file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE).
