What are the legal requirements for hiring therapists in a mobile beauty business?

Hello,

I have set up a mobile beauty business in Sharjah under a free zone and plan to offer home beauty services through my app platform.

I hold a trade license, but many therapists I am hiring do not have their own trade licenses and are already employed by other salons. I need clarity on the legal requirements for them to work under my business:

1. Can freelancers legally provide treatments under my trade license without needing their own trade license?

2. If they have a UAE residence visa (e.g., sponsored by a family member or another employer), can they work for me with a No Objection Certificate (NOC) and a MOHRE work permit?

3. If a MOHRE work permit is needed, how do I apply for one under my trade license?

4. Are there any risks or liabilities for my business if they do not hold their own trade license?

5. Would it be more compliant to employ them instead? If so, what are the costs and requirements for doing so?

I want to ensure my business fully complies with UAE law.

Dear Questioner,

Operating a mobile beauty business in the Sharjah Free Zone requires compliance with UAE laws:

1. Therapists cannot legally work under your license unless directly employed or allowed by Free Zone regulations.

2. They may work for you with an NOC from their sponsor and a MOHRE work permit (if applicable).

3. Requires an application, NOC, and relevant documents, subject to Free Zone rules.

4. Unauthorized hiring can result in fines and legal issues.

5. Sponsoring therapists is the safest option, costing AED 5,000–10,000 per employee.

We have extensive experience in UAE labor laws and can assist you in structuring your business legally.

Thank you!

Is MOHRE expensive?

No, it is for free.

Dear questioner,

If you are setting up an app facilitating beauty parlour services, then the persons registered as service providers must have a freelance work permit or a work permit.

A NOC cannot substitute this requirement. If you are employing these beauty professionals in your venture, you should provide a MOHRE contract and work permit. It would be better to discuss the scope of work in detail.

Kindly share your WhatsApp number to discuss this further.

Operating a mobile beauty business in the Sharjah Free Zone requires full compliance with UAE labor laws.

Here are key legal points:

- Freelancers cannot legally work under your trade license without their own license or permit.

- If they have a residence visa (family/employer-sponsored), they need an NOC and a MOHRE work permit to work for you legally.

- You can apply for a MOHRE work permit under your trade license through the ministry’s portal.

- Hiring without proper permits risks legal penalties, fines, and business closure.

To ensure full compliance, direct employment is safer but involves visa costs, labor contracts, and WPS salary compliance.

1. The key issue is that providing services to clients, especially in regulated sectors like beauty, often requires adherence to specific professional licensing and labor regulations. Essentially, your trade license authorizes your company to perform the services, but the individuals performing the services must also be authorized to do so.

2. NOCs have specific limitations, and their validity depends on the terms of the original employment contract.

3. Contacting MOHRE directly, or a business service provider that works with MOHRE, is the best way to get the most up-to-date information on the process.

4. You could be held liable for any damages or injuries caused by therapists working under your business.

5. Employing therapists directly is generally the most compliant option. This provides greater control and ensures that all legal requirements are met.

We will discuss the possibilities in detail. Kindly share your WhatsApp number to discuss this further.

Greetings,

Thank you for reaching out. Ensuring compliance with UAE labor laws is crucial for your mobile beauty business.

Here are key points to consider:

- Freelancers & Trade Licenses:

In most cases, therapists must either hold their own trade license or be legally sponsored by your business to work under your license.

- Working with a UAE Residence Visa:

If a therapist is sponsored by a family member or another employer, they typically need a No Objection Certificate (NOC) and a MOHRE work permit to legally work for you.

- MOHRE Work Permit Application:

The process depends on your free zone regulations, as some free zones have their own labor laws separate from MOHRE.

- Risks & Liabilities:

Hiring individuals without proper legal documentation can lead to fines, business penalties, or even license suspension.

- Employment vs. Freelancing:

Hiring therapists as full-time employees under your business can be more legally secure. However, this comes with costs such as work permits, labor contracts, and visa sponsorship fees.

To ensure full compliance and avoid legal risks, we strongly recommend a legal consultation to assess the best approach for your business.

Thank you for reaching out!

Your situation involves important legal and regulatory considerations under UAE labor and business laws, especially given that your business is operating from a Sharjah free zone and offering home services.

Here are general guidelines regarding your queries:

- Freelancers & Trade License:

Typically, individuals need their own trade license to legally provide services. Working under your license without their own may not be permitted unless your free zone allows subcontracting arrangements.

- NOC & MOHRE Work Permit:

If they hold a UAE residence visa (sponsored by a family member or another employer), they may be eligible to work with a No Objection Certificate (NOC) from their sponsor and a MOHRE work permit. However, this depends on whether your free zone is under MOHRE’s jurisdiction or follows its own labor regulations.

- Applying for a MOHRE Work Permit:

If your free zone permits MOHRE-issued permits, you may need to apply through the Ministry of Human Resources and Emiratisation (MOHRE) system. This process includes securing an NOC, meeting work permit conditions, and ensuring compliance with labor laws.

- Risks & Liabilities:

If your therapists work for you without a proper legal arrangement, your business could face legal penalties, fines, and potential immigration issues. Misclassification of workers is taken seriously in the UAE.

- Employment vs. Freelance Arrangements:

Employing therapists under your company may be the most compliant approach. You would need to provide employment contracts, visas, and labor benefits. Costs include visa fees, insurance, salary commitments, and compliance with UAE labor laws.

Since regulatory details vary based on the free zone and specific circumstances, I highly recommend a detailed legal consultation to ensure your business operates fully within UAE laws.

Please reach out to me via WhatsApp or phone at [----------] to discuss further and find the best solution for your business.

Best regards,

Suhail Rana

Sharjah doesn’t allow MOHRE. They said I have to apply for part-time work permits for employees who are only on a Golden Visa or dependent visa.

Dear Valued Client,

Thank you for your inquiry regarding the legal requirements for operating your mobile beauty business in Sharjah Free Zone.

I appreciate the opportunity to guide this complex matter. Based on the information you've provided and current UAE regulations, please consider the following:

1. Freelancer Legality:

Freelancers typically cannot operate under your trade license without their license. UAE regulations generally require individuals providing professional services to possess their own trade license or work permit.

2. Residence Visa and NOC:

Individuals with UAE residence visas sponsored by family or other employers may potentially work for you with a No Objection Certificate (NOC) from their sponsor and a work permit from the Ministry of Human Resources and Emiratisation (MOHRE). However, this arrangement may have limitations and associated risks.

3. MOHRE Work Permit Application:

To apply for a MOHRE work permit under your license:

- Register your company with MOHRE.

- Submit required documentation (employee passport copy, visa copy, educational certificates).

- Pay applicable fees.

4. Risks and Liabilities:

Operating without proper documentation poses significant risks:

- Potential fines and penalties for non-compliance

- Legal liability for treatment-related issues

- Risk of business closure or license revocation

5. Employment Option:

Direct employment of therapists aligns more closely with UAE labor laws. This entails:

- Visa sponsorship

- Provision of health insurance

- Payment of end-of-service benefits

- Compliance with additional employment regulations

Associated costs include visa fees, insurance premiums, and mandatory benefits, which vary based on factors such as salary and job role.

6. Recommendations for Ensuring Compliance:

a. Consult with us.

b. Engage with the Sharjah Free Zone Authority where your business is registered for specific guidance.

c. Consider direct employment of therapists or partnerships exclusively with those holding valid trade licenses.

d. Ensure all staff possess the necessary qualifications and health cards required for beauty treatments in the UAE.

Please note that regulations are subject to change, and specific rules may apply to your free zone. It is crucial to verify current requirements with relevant authorities to maintain full compliance.

Should you require any further clarification or have additional questions, please do not hesitate to contact us.

Yours sincerely,
