I resigned and joined a new company but they terminated me after one month. What can I do?
Hi,
I joined a new company under the visa of my previous employer from December 4, 2024, to January 7, 2025, after resigning from my previous company.
My previous employer canceled my visa on February 16, 2025, after I had completed my work with them on November 28, 2024. I have not received my salary for the month I worked with my new employer (from December 4, 2024, to January 7, 2025).
On January 7, 2025, my new employer terminated my contract, citing that I did not meet their requirements, even though I had worked and performed my duties during the period of my employment.
Despite reaching out repeatedly via email and messages, my new employer has only responded with vague references to dates.
Unpaid Salary: You are entitled to receive your salary for the period you worked (Dec 4, 2024, to Jan 7, 2025), despite termination on Jan 7, 2025.
Communication: Keep sending formal requests (via email/letter) to your employer regarding unpaid wages. Document all correspondence.
MOHRE Complaint: If the employer doesn't pay, file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) for wage disputes.
Labour Court: If MOHRE doesn’t resolve the issue, consider taking legal action in the Labor Court for unpaid salary.
Consult a Lawyer: Seek advice from GS Advocates for legal assistance in pursuing your claim.
You are likely entitled to receive payment for the work performed from December 4, 2024, to January 7, 2025.
The cancellation of your previous employer’s visa does not retroactively affect wages owed for work completed during valid employment.
Taking formal steps may be necessary if informal communication continues to yield no results.
Thank you for reaching out.
Based on your situation, your new employer is legally obligated to pay your salary for the period you worked, regardless of their claim that you did not meet their requirements.
Under UAE labor laws, employees are entitled to wages for work performed, and failure to pay constitutes a serious violation.
Since your employment was informal due to your visa status, there may be additional legal implications, but you still have the right to claim your dues.
We can take formal legal action by filing a complaint with the MOHRE (Ministry of Human Resources and Emiratisation) or pursuing a labor case to ensure your salary is paid.
I highly recommend we discuss this in detail to assess the best approach for recovering your unpaid salary.
Please reach out to me directly via WhatsApp or phone to discuss this further and proceed with the necessary legal steps.
Best regards,
Suhail Rana
Greetings,
Your situation involves unpaid wages for work performed under your new employer, despite your visa still being under your previous employer.
Legally, your new employer is responsible for paying your salary for the period you worked for them. Their failure to do so could be a violation of UAE Labour Law.
To recover your dues, you may need to file a formal complaint with MOHRE (Ministry of Human Resources & Emiratisation) or take legal action.
Given the complexities of working under a different visa, professional legal support can strengthen your case.
