I resigned and joined a new company but they terminated me after one month. What can I do?

Hi,

I joined a new company under the visa of my previous employer from December 4, 2024, to January 7, 2025, after resigning from my previous company.

My previous employer canceled my visa on February 16, 2025, after I had completed my work with them on November 28, 2024. I have not received my salary for the month I worked with my new employer (from December 4, 2024, to January 7, 2025).

On January 7, 2025, my new employer terminated my contract, citing that I did not meet their requirements, even though I had worked and performed my duties during the period of my employment.

Despite reaching out repeatedly via email and messages, my new employer has only responded with vague references to dates.

Unpaid Salary: You are entitled to receive your salary for the period you worked (Dec 4, 2024, to Jan 7, 2025), despite termination on Jan 7, 2025.

Communication: Keep sending formal requests (via email/letter) to your employer regarding unpaid wages. Document all correspondence.

MOHRE Complaint: If the employer doesn't pay, file a complaint with the Ministry of Human Resources and Emiratisation (MOHRE) for wage disputes.

Labour Court: If MOHRE doesn’t resolve the issue, consider taking legal action in the Labor Court for unpaid salary.

Consult a Lawyer: Seek advice from GS Advocates for legal assistance in pursuing your claim.

I worked with them on my previous company visa.

Is that an issue to file a case?

20 Feb 2025, 07:25

But the previous company canceled your visa.

20 Feb 2025, 07:38

Yes, the visa was canceled after two months on Feb 16.

20 Feb 2025, 08:02

So you are still on that visa?

20 Feb 2025, 08:03

I mention the details in the above message, Sir.

20 Feb 2025, 08:07

Since your old visa was canceled, you should have transferred your sponsorship to your new employer within 30 days of cancelation.

If this didn't happen, you need to resolve your visa situation first.

20 Feb 2025, 08:26

After my termination from the company I got a new job and the visa process had already started.

20 Feb 2025, 08:28

The visa process for the new one?

20 Feb 2025, 08:29

You need to be more precise, that would help me understand better.

Thank you

20 Feb 2025, 08:29

If you are still on the canceled visa right now, you need to look at that first.

20 Feb 2025, 08:30

And then proceed to the next legal steps.

I worked with [Company 1] in Dubai for two years and resigned on November 28.

After that, I joined [Company 2] in the first week of December after receiving an offer letter.

However, I was terminated by [Company 2] in the first week of January, and they have yet to pay me for the one-month salary I worked there.

The issue has been further complicated because [Company 1], my previous employer, did not cancel my visa, which delayed my ability to fully transition into a new role.

I’ve since joined [Company 3] on January 20 and am currently waiting for the cancellation of my first company visa.

On February 16, [Company 1] finally canceled my visa, and now [Company 3] has applied for a new one.

Despite this, my main concern remains the unpaid salary from [Company 2]. I would like to know what steps I can take to recover my one-month salary from them.

Do you have any advice or know of any formal actions I can take?

20 Feb 2025, 10:01

Send a Formal Demand Letter: Write a formal letter to [Company 2] requesting the payment of your outstanding salary. Clearly state the amount owed, the period worked, and a deadline for payment.

File a Complaint with the Ministry of Human Resources and Emiratisation (MOHRE): If the company fails to settle the matter after your formal demand, you can file a complaint with MOHRE.

They handle labor disputes in the UAE and can mediate between you and the employer.

Legal Action: If the above steps do not resolve the issue, you can take legal action by filing a case in the UAE courts, which we can help you with

Ok, thank you, Sir.

You are likely entitled to receive payment for the work performed from December 4, 2024, to January 7, 2025.

The cancellation of your previous employer’s visa does not retroactively affect wages owed for work completed during valid employment.

Taking formal steps may be necessary if informal communication continues to yield no results.

Thank you for reaching out.

Based on your situation, your new employer is legally obligated to pay your salary for the period you worked, regardless of their claim that you did not meet their requirements.

Under UAE labor laws, employees are entitled to wages for work performed, and failure to pay constitutes a serious violation.

Since your employment was informal due to your visa status, there may be additional legal implications, but you still have the right to claim your dues.

We can take formal legal action by filing a complaint with the MOHRE (Ministry of Human Resources and Emiratisation) or pursuing a labor case to ensure your salary is paid.

I highly recommend we discuss this in detail to assess the best approach for recovering your unpaid salary.

Please reach out to me directly via WhatsApp or phone to discuss this further and proceed with the necessary legal steps.

Best regards,

Suhail Rana

Greetings,

Your situation involves unpaid wages for work performed under your new employer, despite your visa still being under your previous employer.

Legally, your new employer is responsible for paying your salary for the period you worked for them. Their failure to do so could be a violation of UAE Labour Law.

To recover your dues, you may need to file a formal complaint with MOHRE (Ministry of Human Resources & Emiratisation) or take legal action.

Given the complexities of working under a different visa, professional legal support can strengthen your case.

Book a consultation with Future Vision for Advocacy and Legal Consultancy today for expert guidance or to initiate legal proceedings.

Best regards.
