How can we lift a travel ban after an acquittal?

Hello,

My husband had a small case and was completely acquitted, clean and clear. However, the travel ban has not yet been lifted.

The judgment was passed on January 20, 2025.

Kindly advise!

Wishing you a pleasant day ahead,

According to the UAE Penal Code, a travel ban can be imposed on an individual if they are suspected of committing a crime or if they are involved in a criminal case. This travel ban can be lifted once the case is resolved, and the individual is cleared of any charges.

In your husband's case, since he has been acquitted completely, the travel ban should be automatically lifted.

However, if the travel ban is still in place, you can contact the Public Prosecution or the court where the case was heard and request for the travel ban to be lifted.

They will require a copy of the judgment stating that your husband has been acquitted. If the travel ban is not lifted despite providing the necessary documents, you can seek the assistance of our side to resolve the issue.

We can file a petition with the court to lift the travel ban and provide legal representation for your husband.

Thank you for the response. Public prosecutor has sent a clearance to the relevant police station to lift the ban. So it gets removed immediately right ?

Submit a request to the Public Prosecution to stop investigating the case and submit it to the competent police station.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

Given that your husband was acquitted on January 20, 2025, the travel ban should have been automatically lifted by now.

However, since it's still in place, you should take immediate action. First, verify the ban status through the relevant online judicial services.

If it's still active, contact the judicial authority or immigration department directly, providing the court's acquittal judgment as evidence.

Explain that the case has been resolved in your husband's favor and request immediate removal of the ban. If you encounter any difficulties or delays, consult with us to expedite the process.

It's crucial to follow up promptly to ensure the ban is lifted as quickly as possible, allowing your husband to resume normal travel activities.

If you need further clarification or additional support, you can contact us via WhatsApp. We are dedicated to providing professional, timely, and comprehensive assistance tailored to your situation.

Thank you!

Dear Questioner,

Thank you for reaching out, and I understand the concerns regarding the travel ban that is still in place despite your husband's acquittal.

As you mentioned, the judgment was passed on 20th January 2025, and the travel ban has not yet been lifted. Generally, under UAE law, once an individual is acquitted, any associated travel ban should be automatically lifted, as there are no longer legal grounds for its continuation.

However, there may be administrative delays or procedural issues that could cause the ban to remain on record for some time. Here’s what we can do:

1. Verify the Status of the Ban

You should first verify with the General Directorate of Residency and Foreigners Affairs (GDRFA) or Federal Authority for Identity and Citizenship (ICA) whether the travel ban has been updated in the system following the acquittal. You may contact them directly or inquire through the online portals.

2. Request Formal Lifting of the Travel Ban

If the travel ban has not yet been lifted, it’s important to formally request its removal. This can be done by submitting a written request to the relevant authorities (GDRFA/ICA), along with the following documents:

- A copy of the acquittal judgment issued by the court.

- Any other documentation that proves the case has been closed and your husband has been cleared of all charges.

3. Follow-Up with the Court

In some cases, the court itself may have issued the travel ban. If this is the case, we may need to approach the court directly to request that the ban be lifted. If you have a copy of the court ruling, it may explicitly mention the lifting of the ban, which can be used as evidence to support the request.

4. Legal Assistance

If you encounter any difficulties or delays in getting the ban lifted, I can assist you in drafting the necessary letters and filing requests with the authorities. Additionally, I can guide you through the process of escalating the matter if needed.

5. Conclusion

Verify the status of the travel ban with GDRFA or ICA. Request the formal lifting of the ban, submitting the acquittal judgment.

If necessary, contact the court to ensure the travel ban is removed from their system.

Please let me know if you would like me to assist in drafting the requests or following up with the authorities. I’m happy to help ensure this matter is resolved swiftly.

Best regards,

Under UAE law, a travel ban can be lifted after an acquittal, but it may take some time for the court records to be updated.

It is advised to consult with a specialized lawyer to follow up on lifting the ban. You can also reach out to us via WhatsApp for assistance. We are experts in these matters.

Hello,

If the travel ban is still in place after the acquittal, your husband can file a request with the relevant authorities (such as the court or the police) to have the ban lifted, presenting a copy of the acquittal judgment.

It is important to have the official document of acquittal and submit it to the authorities to show that the case was dismissed.

Thank you for reaching out!

Since your husband has been acquitted, the travel ban should ideally be lifted. However, in many cases, the travel ban is not automatically removed after an acquittal and requires a separate process to request its cancellation.

To proceed, we would need to check whether the travel ban was imposed by the Public Prosecution or the Court and whether there are any administrative procedures still pending. A formal request may need to be submitted to the relevant authorities to lift the ban.

I can assist in reviewing the case details and taking the necessary legal steps to ensure the travel ban is removed promptly.

Please reach out to me on WhatsApp or call me at [------------] to discuss further.

In these circumstances, you need to apply for a stop-searching request.

If the travel ban is still in place after the acquittal, your husband can file this request with the relevant authorities (such as the court or the police) to have the ban lifted.

If you need further clarification, you may ask.

4 Feb 2025, 07:17

If we apply for clearance, how many days will it take to lift the ban?

4 Feb 2025, 07:26

Normally in a week.

We can run a security check to see the current status of the case and travel ban with the relevant authorities like the police, immigration authorities, and the concerned courts.

We will need the following details to proceed with the security checks:

1. In which Emirates did the events happen?

2. Power of attorney

3. Emirates ID and email ID

4. Copy of the judgment

Please note that the time taken for conducting security checks will be 1 to 3 days and for securing the Power of Attorney, it will take 3 to 7 days.

After running the security checks, we can inspect the nature of your travel ban and assist you further by providing you with potential legal solutions.
